1. Bills & Resolutions
(TARGETING US PASSPORTS & MORE IN NEW STATE DEPT BILL) HR 5300: Introduced 9/11/25 by Mast (R-FL), the “Department of State Policy Provisions Act.” Referred to the House Committee on Foreign Affairs. HR 5300 is scheduled to be marked up in HFAC next week, 10/17/25. The bill includes
- a terrifying provision – Sec 226: “No passports for terrorists & traffickers” – to allow passport denial/revocation for anyone charged (not convicted) with supporting an FTO, or who SecState “determines” has “knowingly aided, assisted, abetted, or otherwise provided material support to an FTO.” Under this provision, the ONLY recourse for someone targeted with this wholly subjective/unaccountable determination is to request/be granted an appeal hearing at which they can try to convince SecState–acting as judge, jury, & executioner–to change his mind. Based on the way this Admin and some in Congress have been throwing the term “terror” around — accusing people of views and protest that “align” with terrorists, etc — it seems clear that this provision would in effect enable, and likely be used, to target ANY/ALL American citizens who hold disfavored views and/or engaged in disfavored speech/protest, and to either ban them from travel or effectively strand/exile them abroad, at will, with no meaningful recourse.
- SEC. 323. American-Hellenic-Israeli Eastern Mediterranean Counterterrorism and Maritime Security Partnership Act.”
- SEC. 404. Foreign Military Financing program with regard to Jordan.
- SEC. 405. Extension of War Reserve Stockpile Allies-Israel. [“For fiscal year 2026, section 514(b) of the Foreign Assistance Act of 1961 (22 U.S.C. 2321h(b)) shall not apply to defense articles to be set aside, earmarked, reserved, or intended for use as reserve stocks in stockpiles in the State of Israel.”]
- SEC. 609. Report on country United Nations voting practices. [report to include: “a listing of all plenary votes cast by member countries of the United Nations in the General Assembly which provides a comparison of the votes cast by each member country with the vote cast by the United States, including a separate listing of all plenary votes cast by member countries of the United Nations in the General Assembly on resolutions specifically related to Israel that are opposed by the United States“]

(TARGETING ACADEMIA – FREE SPEECH/CRITICISM OF ISRAEL) HR XXXX [bill text, pre-amendments in full committee]: On 9/9/25, the House Appropriations Committee passed the FY26 Labor, Health and Human Services, Education, and Related Agencies Bill. The text, as passed by the Committee (which now head to the House floor) includes Section 536: “SEC . 536. (a) None of the funds appropriated or otherwise made available by this Act may be made available to a United States institution of higher education unless and until such institution adopts a prohibition on antisemitic conduct that creates a hostile environment in violation of Title VI of the Civil Rights Act of 1964 in all documents relating to student or employee conduct. (b) None of the funds appropriated or otherwise made available by this Act may be made available to a United States institution of higher education that has failed to take administrative action against any student, staff member, or student group that commits acts of antisemitism while utilizing the facilities, grounds, or resources of such institution.” In addition, the report accompanying the bill includes:
- a requirement for a “Report on Antisemitism in Health Care“
- a declaration that the Committee “supports efforts by the Office for Civil Rights to provide technical assistance regarding antisemitism on campuses and to complete pending investigations of complaints relating to antisemitism under Title VI of the Civil Rights Act of 1964“;
- a section entitled “Antisemitism Investigations” which reads: “The Committee remains concerned by instances of antisemitism on campuses and commends the new Administration for taking steps to address this increase. Following the explosion of antisemitism at IHEs across the U.S. after the terrorist attack on Israel and the subsequent failure of some IHEs to address antisemitic conduct on campus, it was unclear what actions OCR took under the prior Administration to respond to submitted complaints. The Committee requests an update in the fiscal year 2027 congressional justification on such efforts, including the processing of shared ancestry investigations, responses to complaints, investigation completions, and related activities to address antisemitism.”
- A note that “The Committee provides $4,000,000, which is the same as the fiscal year 2024 enacted level and $4,000,000 above the fiscal year 2025 budget request, for a bilateral cooperative program with the Government of Israel for the development of health technologies.“
(FY26 NDAA – Senate) S. 2296: This week the Senate continued its consideration of S. 2296, the FY26 National Defense Authorization Act (NDAA). As previously covered in the Round-Up, the base text includes (as always) some key provisions related to the Middle East and funding for Israel. Also, as always, a huge number of amendments to the bill were offered (832 total as of 10am 9/11/25), including many related to the Middle East and Israel. Many/most of these likely will not be considered, but they are all worth paying attention to, since NDAA amendments are always good indicators of members’ priorities (with respect to both policy and grandstanding). For a full account of Middle East/Israel-related provisions in the base bill, as well as Middle East/Israel-related proposed amendments, see my comprehensive analysis (published 8/8/25; updated 9/11/25). NOTE: S. Amdt. 3748, an amendment in the nature of a substitute proposed by Wicker (R-MS), is now for all intents and purposes the base text under consideration.
(FY26 NDAA – HOUSE) HR 3838: Introduced 6/9/25 by Rogers (R-AL), the “Streamlining Procurement for Effective Execution and Delivery and National Defense Authorization Act for Fiscal Year 2026.” On 9/8/25, the House Rules Committee met (hearing part 1, hearing part 2) to consider amendments submitted to the bill (final total: 1170), ruling a total of 298 amendments “in order” [i.e., to be considered/vote on by the full House), with 10 minutes allotted for debate on each of them, plus one hour of general debate/statements/grandstanding on the overall bill. Also see: Rules Committee Report (which includes text of all amendments ruled “in order”). The table below lays out the Israel/Middle East-related amendments that were ruled “in order” and their fate on the House floor. As always, regardless of whether a given amendment gets a vote and/or is ultimately attached to the bill, it is useful to pay attention to all the amendments, since they offer valuable information about members’ priorities and intentions. September 17, 2025: The House Foreign Affairs Committee will hold a markup entitled, State Reauthorization Bills Markup. Bills on the agenda include HR 3300, “To guide the foreign policy of the United States, and for other purposes,” which includes a number of Israel/Middle East-related provisions, in addition to a stunning/terrifying provision to empower the Secretary of State to deny/revoke the US passport of any US citizen based merely on being charged (but not convicted) of support for a terrorist organization, or merely on the Secretary of State “determining” – a subjective, unaccountable determination – that the person supports terrorism. September 17, 2025: The Commission on Security and Cooperation in Europe (CSCE) will hold a briefing entitled, Conspiracy Theories, Antisemitism, and Democratic Decline. We have the blood of what is happening to those innocent people on our hands. I started by talking about innocent people. They are among the innocents. We can’t care more about some babies than other babies. We will allow the killing of Palestinian babies and maybe every now and then say something about how wrong this is, but we are not going to say that about other babies. We want to make sure that people understand that those babies have the right to life, that those babies should grow up, and they should have an opportunity to succeed in the world. Palestinian babies and children haven’t been to school in years now. What is going to happen to them? We have now allowed Mr. Netanyahu to go into Palestine, into Gaza, and go to Gaza City. It is obvious that he is trying to destroy it. Yes, he is trying to destroy it. There will be no home for the Palestinians. They have already destroyed roads, bridges, schools, hospitals. Mr. Netanyahu doesn’t want peace. He wants all of Palestine. I speak in specificities, all of Palestine. He doesn’t want peace. In fact, the Knesset just last year took a vote, and the vote was to say in explicit terms there will be no Palestinian state from the river to the sea, from the river to the sea, not in those exact words. They said west of the Jordan. That is the river, and west of the Jordan is Gaza. From the river to the sea, west of Jordan, West Bank, from the river to the sea. If you say `from the river to the sea,’ you will be sanctioned by this Congress. We can’t say that. The Knesset in Israel can pass in that body legislation saying that there will be no Palestinian state from the river to the sea. Here is my point. From the river to the sea, Palestine and Israel must be free, both of them, two states. I stand for a two-state solution. There are others who stand for evicting the Palestinians, sending them to some other place. This is their land, their home. They have got every right to live where they live, and this war has gone on too long, taken too many lives. What happened at the genesis of this with the attack on Israel was wrong. It was sinful. It was harmful. It was terrorism. It was something that merited a response, but it didn’t merit collective punishment. It didn’t merit ethnic cleansing, and it didn’t merit genocide.
