(THE FY26 NATIONAL DEFENSE AUTHORIZATION ACT) — Action this week

Dec. 9, 2025 — ACTION IN THE HOUSE RULES COMMITTEE

On 12/9/25, the House Rules Committee adopted the Rule to bring the bill to the floor the FY26 NDAA, this time in the form of  S. 1071 (a bill that until now had nothing to do with the NDAA, but is now being re-purposed to play this role). The Rule provided for consideration of an amendment in the nature of a substitute comprised for the most part (but not entirely) of the text of the FY26 NDAA as passed by the House on 9/10/25 in the form of HR 3838 (for coverage of HR 3838, including Middle East-related provisions and amendments, see; here and here).

NOTE: A number of amendments to S. 1071 were submitted to the Rules Committee, including amendments related to Israel and the Middle East, but the Rule adopted by the Committee does not permit any of those amendments to be considered on the House floor (aka, a Closed Rule). Those amendments (which represent important signaling by members) were:

  • Ansari (R-AZ), “Establishes a special envoy for Iranian women, girls, and human rights.”
  • Higgins (R-LA), “Strikes ;Section 8370. Repeal of Authorizations for Use of Military Force relating to Iraq.’

Dec. 10, 2025 — ACTION ON THE HOUSE FLOOR

On 10/10/25, the House passed S. 1701 by a vote of 312 – 112 (with 94 Democrats and 18 Republicans voting “no”.

summary of the FY26 NDAA, as brought to the House floor, was published by the House Armed Services Committee. It touts the bill’s inclusion of the following Middle East-related provisions:

Under the heading: “DEFENDING ISRAEL” [and the subheading “The FY26 NDAA provides unprecedented levels of support for the security of Israel” [and yes, tellingly, the “Combats Antisemitism” provisions are included under this heading…]

Strengthens Joint Military Programs

  • Fully funds the U.S. commitment to defend Israel through joint U.S.-Israel cooperative missile defense programs, including Iron Dome, Arrow, and David’s Sling.
  • Declares that supporting further defense cooperation with Israel is the policy of the United States.
  • Directs the establishment of a U.S.-Israel Defense Industrial Base Working Group to study opportunities for greater collaboration on defense production and potential integration of Israel into the U.S. National Technology and Industrial Base (NTIB).
  • Establishes and authorizes $35 million for a new emerging technology cooperative program with certain partners, including Israel, to jump-start development and testing of cutting-edge technologies, including AI, quantum, cybersecurity, robotics, and automation.
  • Adds $80 million in authorized funding for DoW to continue the U.S.-Israel Anti Tunnel Cooperation Program.
  • Adds $70 million in authorized funding to expand cooperation with Israel on countering unmanned systems of all variants, including emerging threats from aerial one-way attack drones and ground and maritime attack systems.
  • Encourages DoW to expand joint training exercises with Israel to strengthen our shared readiness to face regional threats and reinforce deterrence.

Combats Antisemitism

  • Requires a continuous assessment of the impact of international arms embargoes
    on Israel and an evaluation of opportunities to reinforce Israel’s defense production
    needs.
  • Directs DoW to avoid participating in international defense exhibitions and forums
    that prohibit participation by Israel as part of the Boycott, Divestment, and Sanctions
    (BDS) movement.

Under the heading: “COUNTERING OTHER ADVERSARIES”

Iran, Iranian Proxies, And Other Foreign Terrorist Organizations

  • Extends DoW’s authority to build the capacity of Iraqi and Syrian partner forces in the fight
    against ISIS.
  • Restricts defense funding to Iraq until the Government of Iraq has taken credible and
    verifiable steps to reduce the malign influence of Iran in its security and political
    institutions.
  • Protects funding for critical counterterrorism allies in the Iraqi Kurdistan Region.
  • Extends the annual report on the military power of Iran and requires DoW to maintain a greater focus on Iran’s use of terrorist proxies, as well as advancements in nuclear weapons technology, and its ability to produce, sustain, and employ novel weapons delivery methods such as one-way attack drones.
  • Provides vital accountability for U.S. servicemembers wounded and killed in action by requiring the declassification of records related to the Iran-backed terrorist attack on Tower 22 in January 2024.
  • Extends DoW’s authority to provide assistance to countries that partner with the U.S. to combat terrorism across the Middle East.
  • Requires DoW to study opportunities to expand regional security partnerships through the Comprehensive Security Integration and Prosperity Agreement (CSIPA) signed with the Government of Bahrain.
  • Requires DoW to establish a strategy for increased security partnerships with the Governments of Jordan and Lebanon.
  • Prohibits DoW funds from assisting the Badr Organization, an Iranian terrorist proxy in Iraq, and its affiliates.
  • Authorizes additional counter-terrorism support for regional partners in the Middle East to combat the transnational threats posed by Hezbollah, Hamas, and ISIS, including those to Israel.

Dec. 11, 2025 – SENATE BEGINS ACTION ON S. 1701

  • Senate action on S. 1701 kicked off with the a number of senators offering amendments to the bill (8 so far – no text available of any of them yet, but it is likely that all are unrelated to Israel/Middle East). As of this writing (10am EST on 12/12/25) it is not known of Senate leadership will permit amendments to the House-adopted text (which would slow down final passage of the bill). Stay tuned!

***Members re: the NDAA: Many, many House members weighed in on the NDAA following the House vote. Check members’ websites and social media for details. Notable: DeGette (D-CO) X-post – “I have been saying for months that I would not support additional offensive weapon sales to Israel that could be used against innocent Palestinians. That’s why I voted against the NDAA today. This bill contains provisions that force the United States to provide further weapons, including offensive weapons, to Netanyahu as our European allies limit their military support. More weapons are the last thing we need in the region. We need a permanent ceasefire, a massive surge of humanitarian aid, and lasting peace for both Israelis and Palestinians.

December 16, 2025: The House Judiciary Committee will hold a hearing entitled, “Partisan and Profitable: The SPLC’s Influence on Federal Civil Rights Policy”. No further information is available at this point.
December 10, 2025: The House Foreign Affairs Committee’s Subcommittee on the Middle East and North Africa held a hearing with the super instructive title (in terms of conveying the clear political/ideological intent behind the hearing): Understanding Judea and Samaria: Historical, Strategic, and Political Dynamics in U.S.–Israel Relations (video). Witnesses were: Eugene Kontorovich, Heritage Foundation/Kohelet Forum (statement); Morton Klein, Zionist Organization of America (statement); and Jon Alterman, CSIS (statement) [Center for International Policy’s Matt Duss trenchantly observed on X: “A great demonstration of what “diversity” means in hearings on Israel-Palestine: Zionist, batshit right wing Zionist, and an actual Israeli settler. Imagine a hearing on the history and political dynamics of eastern Ukraine featuring only Russian or pro-Russian witnesses.“]
For details of this hearing — which offered a window into just how deep into Greater Israel, anti-Palestinian, fact-challenged crazy-land some people in this Congress and on this Committee are — watch it for yourself. One note: at around 1:25:30 in the hearing, Rep. Fine (R-FL) launches into a speech alleging the existence of apartheid in the West Bank, based on the fact that when he was traveling there he encountered a sign reading “Jews May Not Enter.” Fine goes on to suggest that these signs represent a Palestinian Authority policy of preventing Jews from accessing certain areas. Of course, Fine knows – or should know, since he presents himself as an expert on all things related to Israel and the West Bank, as does (or should, Mort Klein, who does not correct Fine’s mistake) – that this sign (and the many others like it, placed at the entrance to Palestinian cities and villages across the West Bank), was produced and placed there BY THE GOVERNMENT OF ISRAEL, reflecting an ISRAELI policy that makes it illegal for Israeli citizens to enter Area A of the West Bank [note that Fine is also incorrect in alleging the signs say anything about “Jews.” The signs refer in Hebrew to “Israelis” and in Arabic and English to “citizens of Israel”; Jews who are not citizens of Israel can and do travel into these areas; Israeli citizens who choose to enter these areas are breaking Israeli law, which in the case of settlers goes unpunished, and in the case of Israelis human rights activists, can be one of the many pretexts for Israeli authorities use to detain and/or ban them from the areas]. The only witnesses present were from the Heritage Foundation, the Zionist Organization of America, and the right-wing Center for Strategic and International Studies. We asked the Congressmen and the witnesses if they thought this was a fair hearing. They regurgitated the same propaganda we’ve heard for years. It’s not complicated. Palestine is for Palestinians.

December 10, 2025: The Senate Foreign Relations Committee held a hearing entitled, ARMS RACE 2.0 [video]. Witnesses were: Marshall Billingslea, Hudson Institute (statement); and Rose Gottemoeller, Stanford University (statement). In his opening comments, Chairman Risch (R-ID) stated: “…as troubling as these developments from Russia and China are, we cannot take our eye off rogue states with nuclear ambitions. Fortunately, President Trump took action to destroy Iranian nuclear facilities earlier this year. By doing so, he prevented a dangerous, ideologically driven Islamic autocracy from acquiring a nuclear weapon that could threaten the U.S., Israel, and others around the world. But the Iranian regime won’t stop there, and we need to stay vigilant.
