(TARGETING US EMPLOYEES OF AMNESTY INTERNATIONAL) S. 3999 (pdf): Introduced 4/5/22 by Scott (R-FL) and Braun (R-IN), “A bill to prohibit Amnesty International and its employees from receiving financial assistance from the United States Government.” Referred to the Committee on Homeland Security and Governmental Affairs. - IMPORTANT: This bill — which is almost certainly unconstitutional — is an effort to legislate sanctions on the world’s most important human rights org as punishment for the sin of reporting factually on the situation in Israel/Palestine & holding Israel to the same standard (international law) as the rest of the world. Whether you agree or disagree with this effort, it is critical to note that Amnesty International, as an organization, doesn’t get any U.S. funding. Scott and Braun’s bill gets around this problem by targeting Amnesty’s US employees, rather than targeting Amnesty itself (notwithstanding the fact that they still present the bill as targeting the organization). As such, this bill is a template for members of Congress with literally any ideologically-motivated axe to grind to target the employees of literally any companies/businesses/orgs they hate.

(DON’T LIFT IRAN SANCTIONS, SUPPORT US ENERGY PRODUCTION!) H. (NO WEAPONS TO *SOME* HUMAN RIGHTS ABUSERS) HR 7367 (pdf): As previewed in last week’s Round-Up (before the bill was officially intro’d), on 4/1, Rep. Jacobs (D-CA) introduced HR 7367, “To amend the Arms Export Control Act to provide for better monitoring and verification of the use of defense articles and defense services by countries of concern, and for other purposes.” Referred to the Committees on Foreign Affairs, Intelligence (Permanent Select), and Rules. As noted last week, this is the House companion to S.3558, which was introduced 2/2/22 by Murray (D-WA), one day after Amnesty International released its blockbuster report concluding that Israel is committing the crime of apartheid. Now, two months later, my comment on S. 3558 (in the 2/4/22 edition of the Round-Up), applies equally to this House version, with respect to anyone thinking that this bill might actually mean some kind of concern over/focus on/accountability for Israeli violations of the rights of Palestinians: what are you smoking and are you going to share it with the rest of us? Because these bills, of course, explicitly exempt weapons exports to Israel, along with those to NATO and NATO members, Japan, Australia, the Republic of Korea, and New Zealand, from this new oversight requirement. LETTERS
(ARM ISRAEL TO GO TO WAR WITH IRAN) Cotton et al letter to Biden: On 4/7/22, Sen. Cotton (R-AR) led a letter to President Biden, co-signed by 10 Senate Republican colleagues, urging him to “ provide Israel with the military capabilities it needs to defend itself and prevent Iran from achieving a nuclear-weapons capability.” The letter goes on to argue: “since the purchase has already been approved, your administration must expedite the delivery of KC-46A aerial refueling tankers to Israel as rapidly as possible without interrupting deliveries to our own Air Force. Accelerating delivery of tactical aircraft like the F-35I and F-15I and helicopters like the CH-53K would continue to bolster Israel’s ability to defend itself. While providing improved tactical aircraft is vital, your administration must also ensure that Israel retains adequate stockpiles of U.S.-made precision guided munitions. Finally, you must ensure that Israel possesses robust, multi-layered air defenses to mitigate attacks by Iran and its proxies, to include continued support for the Iron Dome, David’s Sling, and Arrow systems.” Cotton press release is here. (FREE & FAIR LEBANESE ELEX) Meeks et al letter to Blinken: On 4/6/22, House Foreign Affairs Committee Meeks (D-NY) led a bipartisan group of totally 24 members in a letter to SecState Blinken urging the Biden Administration to continue to “call upon and work with Lebanese officials to ensure that parliamentary elections scheduled for May 15, 2022, are carried out on time, transparently and free of corruption.” Press release is here. (US OUT OF UN HUMAN RIGHTS COUNCIL) Lankford et al letter to Blinken: On 4/1/22, Sens. Lankford (R-OK), Cruz (R-TX), Cotton (R-AR) and Hagerty (R-TN) sent a letter so SecState Blinken urging him “again to instruct the Department of State to withdraw the United States from the United Nations Human Rights Council (UNHRC).” The letter contends that “With the Council’s 49th session underway—and no indication that the UNHRC will eliminate its unprecedented permanent Commission of Inquiry (COI) on the Israel-Palestinian conflict—it is imperative that the United States ends its membership on the Council immediately.” It goes on to argue that, “it is evident that your decision to re-join the Council without first securing a commitment to reform it was naïve and misguided. American participation has done little to halt the Council’s relentless demonization of Israel. With the COI backed by a 24-nation majority on the Council, it is evident to any clear-eyed observer that attempting to reform the Council from within is wishful thinking at best and dangerous at worst. The United States should not legitimize this sweeping, open-ended probe of Israel’s conduct by remaining on the Council.” Also see Lankford press release.
2. Are House Democrats Really Rallying Against an Iran Nuclear Deal?
This week, with a great deal of fanfare, some House Democrats – led by Reps. Gottheimer (D-NJ) and Luria (D-VA) came out publicly to express their “concerns” about ongoing US negotiations with Iran over its nuclear program. Did this episode indicate deep concern/opposition among House Democrats to the Biden Administration’s efforts to secure a new deal to curb Iran’s nuclear program? An examination of how this whole drama went down suggests, in fact, the opposite conclusion.
Act 1: Promoting the Big Press Conference!
- Tweet from Jewish Insider’s Marc Rod 4/5/22: “NEW: 15 Democrats to hold a press conference tomorrow morning raising concerns about the Iran Deal. Several of the scheduled speakers have yet to express concerns publicly, growing the list of House Dems opposing the deal.”
- Message Reps. Gottheimer (D-NJ) and Luria (D-VA) circulated to fellow Democrats (pic): “Please join Reps. Gottheimer and Luria in bringing attention to the dangerous concessions the Biden Administration is reported to be making to Iran. There are several critical issues that remain on the table — including the potential lifting of the IRGC FTO designation and of sanctions placed on the Supreme Leader. Without adequately addressing Iran’s role as the world’s leading state-sponsor of terror — which was noticeably absent from the 2015 JCPOA — and simultaneously providing billions in sanctions relief, the United States would be providing a clear path for Iranian proxies to continue terrorism.”

Act 3: Trying to Spin the Flop as a Success!

We must not lift the FTO designation off the IRGC, remove sanctions on Iran, or let Russia hijack the negotiations. Act 4: But Your Own Press Release Doesn’t Back Up that Narrative
According to the opening paragraph of Gottheimer’s press release celebrating the press conference: “Today, April 6, 2022, eighteen Democratic Members of Congress joined together to raise critical concerns about the looming Iran deal.”
The first problem with this statement is the fact that (as noted above) only 5 members of Congress showed up for the press conference associated with this press release – a number that actually looks even worse now that Gottheimer is talking about a joint effort of 18 members (as opposed to 15, as referenced in the earlier reports).
The second problem is that the actual quotes included in the press release — including from members who didn’t show up to the press conference — suggest that not all the listed members are “concerned” in the way, or with the same degree of negativity, as suggested by Gottheimer. For example, see:
- Rep. Brown (D-OH): “I have long hoped that negotiations with Iran would result in a longer and stronger agreement. I look forward to closely reviewing any announced deal to determine whether it will make the U.S. safer, improve stability in the region, and strengthen the security of our longtime ally Israel.”
- Rep. DeSoto (D-FL): “Congress must stand united in ensuring that we impose strict nuclear restrictions on Iran. As the Biden Administration continues negotiations to achieve an agreement, we hope they will take Iran’s role as one of the world’s leading state-sponsors of terror into consideration. I am hopeful that our concerns will be addressed, and the safety of our international community will take priority.”
- Rep. Gonzalez (D-TX): “Iran continues to pose a threat to the stability and security of the Middle East. The United States must do everything in its power to limit the regime’s ability to acquire or develop dangerous nuclear weapons and prevent Iran from becoming a nuclear power.”
- Rep. Demings (D-FL): “As a 27-year law enforcement officer and chief of police, I know a habitual offender when I see one. Iran’s corrupt leaders are habitual offenders, sponsors of terror, and a threat to U.S. national security, Israel, and stability around the world. I continue to support all efforts to destroy the Iranian government’s terror networks, break up their ballistic missile program, disrupt their meddling in Latin America, and gut their nuclear program.”
- Rep. Costa (D-CA): “As a member of Congress, I have a responsibility to ensure that Iran in this instance is prevented from developing nuclear weapons with the capability to deliver them. My top priority here is to ensure peace and prosperity in the region, especially for our critical partner Israel. Iran has done very little to indicate they’re a serious, trustworthy partner in pursuit of this goal. I echo the administration’s call that nothing is final until everything is final, and I’ll be observing closely as the critical components of this deal are negotiated.”

3. Ritchie Torres & A Lesson About Who can say What on the Hill
This week AIPAC darling Rep. Ritche Torres (D-NY) appeared on an AIPAC forum to speak about “Concerns About a Dangerous Iran Nuclear Deal.” During that forum, Torres offered what is, objectively, a rather remarkable statement for a US lawmaker, commenting that when it comes to an Iran nuclear deal:
“I try to approach the issue not from the perspective of an American, but from the perspective of an Israeli.”
When called out by J Street’s Dylan Williams (“Shouldn’t a US lawmaker approach it from the perspective of US interests?”) Torres shot back with a tweet that appeared to in effect accuse Williams of antisemitism:
“You are taking what I said out of context and reframing empathy for a US ally as though it were a form of ‘dual loyalty.’ The fact that I might hold an opinion that differs from yours does not mean I care about America any less than you do. Your tweet is a cheap shot.”
Some people will no doubt rally around Torres’ outrage and the righteousness of his empathy for Israel. Such people will also no doubt be un-bothered by a non-Jewish member of Congress implicitly accusing a Jewish commentator of antisemitism for challenging that non-Jewish members’ statement of support for Israel (others find this accusation outrageous and have challenged it – for example see Zak Witus’s tweet – “Question for @RitchieTorres: Is @AIPAC endorsing congressional reps who tried to overturn the 2020 election: (a) a good thing (b) a bad thing, or (c) my question perpetuates the antisemitic trope of dual loyalty b/c it suggests that AIPAC values Israel more than US democracy.”) And, of course, AIPAC moved quickly to deflect focus from Torres’ original words, by accusing J Street of being “more critical of Torres than of terrorists”.
But regardless of how one feels about this specific exchange, it is a great opportunity for a thought experiment about who is allowed to say what on the Hill. Let’s consider 3 comparable scenarios:
- Scenario 1: In the context of taking a position with respect to Iran sanctions that directly impact the lives of Iranian civilians, a member of Congress says that (as a matter of empathy for fellow human beings): “I try to approach the issue not from the perspective of an American, but from the perspective of an Iranian.” Just sit back for a moment and try to imagine the outraged responses.
- Scenario 2: In the context of taking a position with respect to the provision of US weapons to Israel, a member of Congress says that (as a matter of empathy for fellow human beings): “I try to approach the issue not from the perspective of an American, but from the perspective of a Palestinian.” Again, it doesn’t take much imagination to know how that would turn out.
- Scenario 3: In the context of a disagreement over an Iran nuclear deal, imagine what would happen if Congressperson X (a supporter of Iran diplomacy and a deal) said that the position of Congressperson Y (an opponent of Iran diplomacy and a deal) reflected the fact that Congressperson Y “tries to approach the issue not from the perspective of an American, but from the perspective of an Israeli.” [i.e., exactly what Torres said about himself]. In such a case — and irrespective of any context/explanation that might be provided to back up such a statement — it is a solid bet that Torres and AIPAC would be at the front of the line accusing Congressperson X of brazen antisemitism (for suggesting dual loyalty), and insisting that Congressperson Y’s support for Israel was wholly a reflection of US interests, the will of his/her constituents, shared values, etc…
