1. Bills, Resolutions & Letters

(FY23 NDAA) HR 7900: Public action on the NDAA in the Senate (and all the stuff attached to it) is on hold until the Senate returns to session. For details, see last week’s Round-Up. NOTE: Since last week’s Round-Up was published, a giant stack of additional NDAA amendments was dropped (on 9/30/22) — for total (for now) of a whopping 963 amendments. The new batch includes many amendments related to the Middle East (including an amendment to require a report on Israeli settlement activity).  Check out my handy-dandy table tracking Middle East-related amendments offered in the Senate to HR 7900 to see what’s new!

(US TROOPS & MISSILE SYSTEMS OUT OF SAUDI ARABIA & UAE) HR XXXX (pdf): On 10/5/22, Reps. Malinowski (D-NJ), Casten (D-IL), and Wild (D-PA) announced that they “are introducing a bill that would mandate the removal of U.S. troops and missile defense systems from the Kingdom of Saudi Arabia and the United Arab Emirates. The bill would also relocate the equipment and defense systems to other areas in the Middle East for the purpose of protecting U.S. troops elsewhere.” As of 10/7/22, that bill is not does not yet appear in the Congressional Record. 2. Hearings

October 3, 2022: The House Homeland Security Committee held a “field hearing” (from Teaneck, New Jersey) entitled, “Countering Violent Extremism, Terrorism, and Antisemitic Threats in New Jersey”. Witnesses were: Laurie Doran, NJ Office of Homeland Security and Preparedness (testimony); Scott Richman, ADL (testimony); Rabbi Esther Reed Rutgers Hillel (testimony); Susan Corke, Southern Poverty Law Center (testimony); Kenneth Stern, Center for the Study of Hate, Bard College (testimony); and Holly Huffnagle, American Jewish Committee (testimony).

  • Vice Chairman Torres (D-NY) Opening Statement. Notable from Torres’ statement: “In early April of 2022, in New York City, following a wave of terror in Israel that left multiple Israelis dead, a set of extremists—in a rally entitled ‘Globalize the Intifada’—took to the streets of New York and publicly called for Zionists students and professors to be purged from college campuses and classrooms. The substitution of the word ‘Zionist’ for ‘Jew’ has become the modus operandi of a new insidious strain of antisemitism that has taken hold in college campuses and on social media platforms.” This appears to be a reference to a period of intensified violence in April 2022, on both sides of the Green Line, in which — according to the UN — 3 Israelis were killed and 29 injured, while during this same period at least 15 Palestinians were killed and 945 injured. But for Torres, apparently Palestinians lives don’t matter enough to merit even a passing mention alongside Israelis, even as context for why activists for Palestinian rights might choose that moment to organize and protest Israel/Zionism. Of course, Torres’s erasure of Palestinian rights and Israeli violence against Palestinians makes perfect since, given that his overall framing starts from the assumption that the only reason people would hold a rally for Palestinians would be because they are “extremists” motivated by antisemitism — as opposed to activists/citizens/human beings with legitimate grievances focused, logically, on the source of those grievances].
  • Unsurprisingly, the ADL and AJC witnesses also framed the issue of antisemitism in part in the conflation of criticism of Israel and anti-Zionism with antisemitism, and promoted the adoption/enforcement of the IHRA definition of antisemitism as key to combating antisemitism.
  • And notably, Ken Stern – who was the lead author of the IHRA definition, offered a very different perspective. It’s worth watching the whole hearing to see how the conflation of criticism of Israel/anti-Zionism and antisemitism played out in general, and particularly interesting is Stern’s exchange with Rep. Torres about the IHRA definition, starting at about 1:55 in the video (with Torres defending the IHRA definition and in effect dismissing Stern’s concerns, including by raising the current (and manufactured) controversy over alleged antisemitism at UC Berkeley as an example of why the IHRA definition is needed). In addition, Stern noted in his written testimony:

“I’ve also been outspoken against the broad adoption of the definition (which included language about Israel but was written primarily to help data collectors, and was intended to take a temperature of antisemitism over time and across borders) as a type of hate speech code. The definition has been used primarily to suppress and chill some pro-Palestinian political speech, and it is particularly inappropriate to use it in this fashion on university campuses, where the point is to examine ideas, including ones that might be contentious or disturbing. It is important to make a distinction between actual harassment, intimidation and bullying, on the one hand, and expression of opinions, on the other. The parallel situation would be adopting and employing a state-endorsed definition of racism with political examples, like opposition to the Movement for Black Lives or affirmative action or the removal of Confederate statues. Further, there are also church/state concerns (the question of whether a particular view of Israel and Zionism is necessary to be inside the Jewish ‘tent’ is an internal question that shouldn’t be decided by lawmakers), and concerns that, just as there’s a danger of promoting hate when people take complex systems and try to reduce them to simple formulas, anti-hate programs that rely on a simple formula also are to be discouraged. They are like black holes sucking away attention from other things that can actually be much more effective. I see a parallel here to the mantra that the obvious and go-to answer to antisemitism is Holocaust education. Holocaust education is of course important and to be encouraged, but it makes little sense to think it will be a panacea for curing antisemitism…”
