1. Bills, Resolutions & Letters

(FY23 NDAA/OMNIBUS AUTHORIZATIONS) HR 7900: This week the Senate began getting set to take up HR 7900, the FY23 NDAA (which includes various other authorization bills). As readers of the Round-Up know, every year the annual National Defense Authorization bill (NDAA) is an occasion – in both the House and Senate — for members to submit many, many, many, many (etc) amendments (see the Round-Up’s tracking of amendments offered in the House to the FY23).  Many of these amendments have nothing to do with the underlying bill. All of them reflect pet issues/initiatives of various members of Congress, including with respect to the Middle East. As such, regardless of whether the amendments are ever voted on, they are worth paying attention to, offering a valuable window into the intentions/plans/aspirations of lawmakers.

(IRAN POLITICAL PRISONERS) HR 9075: Introduced 9/29/22 by Schiff (D-CA) and 9 cosponsors (all Democrats), “To call on the Islamic Republic of Iran to immediately end violations of the human rights, and facilitate the unconditional, immediate release, of all arbitrarily detained individuals, including peaceful protesters, political prisoners, and prisoners of conscience, and for other purposes.” Referred to the House Committee on Foreign Affairs. (CONDEMNING IRANIAN GOVT) H. Res. 1397: Introduced 9/28/22 by Kim (R-CA), Fitzpatrick (R-PA), Elvira (R-FL) and Spanberger (D-VA), “Condemning the Government of Iran’s torture and murder of Mahsa Amini and its crackdown on protesters seeking basic human rights, and supporting the protesters in their demands for freedom.” Referred to the House Committee on Foreign Affairs. (COMMENDING IRANIAN WOMEN) H. Con. Res. 110: Introduced 9/29/22 in the House by Tenney (R-NY), McCaul (R-TX) and Malinowski (D-NJ), and reportedly to be introduced imminently in the Senate by Blackburn (R-TN), “Commending the bravery, courage, and resolve of the women and men of Iran demonstrating in more than 80 cities and risking their safety to speak out against the Iranian regime’s human rights abuses.” Referred to the House Committee on Foreign Affairs. (SAUDI ARABIA/KHASHOGGI MURDER) HR 9064: Introduced 9/29/22 by McCollum (D-MN), Schiff (D-CA) and Connolly (D-VA), “To enshrine the legacy of Jamal Khashoggi by protecting dissidents and journalists, codifying the Khashoggi Ban, and introducing the Khashoggi Amendment to the Foreign Sovereign Immunities Act, and for other purposes.” Referred to the House Committee on the Judiciary.

(ISIS & SYRIA) S. 4996: Introduced 9/28/22 by Shaheen (D-NH) and Graham (R-SC), “A bill to amend the National Defense Authorization Act for Fiscal Year 2020 to modify the establishment of a coordinator for detained ISIS members and relevant displaced populations in Syria, and for other purposes.” Referred to the Committee on Foreign Relations. LETTERS

(SANCTION ALGERIA FOR BUYING RUSSIAN ARMS) McClain et al letter to Blinken: On 9/29/22, Rep. McClain (R-MI) led a letter, cosigned by 26 House colleagues (bipartisan) to SecState Blinken – demanding sanctions against Algeria for its purchase of Russian arms, allegedly a violation of the Countering America’s Adversaries Through Sanctions Act.  Also see: McClain press release.

(FIFA – QATAR HUMAN RIGHTS MATTER) Schakowsky et al letter to FIFA president: In 9/29/22 Reps. Schakowsky led a letter, co-signed by 14 fellow House Democrats, to the CEO of FIFA calling for the appropriate compensation of migrant workers in Qatar in advance of the 2022 World Cup. Also see:

(META-IRAN COLLUSION?) Cotton letter to Zuckerberg: On 9/28/22, Sen. Cotton (R-IN) sent a letter to META CEO Mark Zuckerberg raising concerns that META may be cooperating with Iran in suppressing dissent from the Iranian people. Cotton writes: “News reports indicate that at least one of your company’s subsidiaries, Instagram, may have removed documentation of the Iranian regime’s vicious attempts to crush recent peaceful protests. This is particularly concerning given prior allegations that Iran attempted to bribe your content moderators to remove accounts that challenged or criticized the Iranian regime.” Cotton asks Zuckerberg to answer a list of questions related to these allegation (to which Cotton says he looks forward to Zuckerberg’s  “prompt and detailed responses” (notwithstanding the fact that Cotton has no legal authority to demand answers from Zuckerberg, and Zuckerberg has no legal obligation to respond). (TARGETING ESG VIA INVOKING BDS) Cruz Blackburn letter to Secretary of Commerce: On 9/28/22, Sens. Cruz (R-TX) and Blackburn (R-TN) sent a letter to Secretary of Commerce Raimondo alleging, “Advocates of economic warfare against Israel have increasingly sought to use ESG criteria as pretexts for boycott advocacy. Companies that rely on ESG ratings in their business decisions have minimal transparency into the details let alone motivations behind how the ratings were set. The practice introduces exposure to American anti-boycott laws along the entire chain, and most acutely for the firms opaquely designing and setting the ESG criteriaand “We are concerned that… the Commerce Department is not sufficiently engaging Morningstar and similar companies. The ratings and implicit advocacy from Sustainanalytics come remarkably close to blackletter violations of prohibitions described at the federal level by the EAR and in laws of states such as Texas. The Commerce Department, both generally and as the agency housing the Office of Antiboycott Compliance, is charged with ensuring American companies are aware of these risks and working with them to mitigate and end any exposure. It is also charged with insuring [sic] the integrity of those federal prohibitions, as necessary.” Also see:

(TARGETING “WOKE” UNIVERSITIES) Comer-Foxx letter to Education Secretary Comer: On 9/28/22, Reps. Comer (R-KY) and Foxx (R-NC) sent a letter informing Secretary of Education Comer that the are “conducting oversight over the U.S. Department of Education’s (the Department) administration of taxpayers’ dollars awarded to public and private colleges and universities under various federal programs. Specifically, we are concerned many of these colleges and universities are undermining free speech and academic freedom on their campuses. Despite this problem, the Department does not seem to be engaged in promoting the free exchange of ideas within our colleges and universities…” The 5-page letter goes on to offer arguments and supposed evidence of the alleged problem — focused entirely on cases of alleged undermining of right-wing speech and alleged tolerance of left-wing speech. It also enumerates US government funding for universities and concludes, “For this reason, these institutions of higher learning should be havens of free speech.Instead, school administrators are undermining the very purpose of their institutions. The proliferation of cancel culture in American higher education threatens the ability of students and faculty to push themselves past their academic limits. The Department should be signaling to these institutions that academic freedom is paramount for the success of students, faculty, and society, and should help them see that limiting free speech is counter to the intellectual goals of academia.” It closes with: “To assist Committee Republicans in conducting important oversight of the Department’s administration of funds for higher education, including what the Department is doing to promote free speech and academic freedom, we request a staff-level briefing as soon as possible, but no later than October 5, 2022.” NOTE: The letter’s authors — in their robust defense of academic and free speech — neglect to mention whether this includs free speech on campus critical of Israel and/or in support of Palestinian rights… Also see: House Republicans Launch Probe Into Education Department’s Funding of Woke Universities (Free Beacon 9/28/22)

(TARGETING OBERLIN/IRANIAN PROFESSOR) Banks-Foxx letter to Oberlin Administration (letter text included at the bottom of the Fox News article): On 9/28, Reps. Foxx (R-NC) and Banks (R-IN) sent a letter to Oberlin University’s president and vice president expressing “concern regarding Mohammad Jafar Mahallati, a Professor of Religion and a Presidential Scholar in Islamic Studies at Oberlin College.” The letter references Mahallati’s “well-documented involvement in human rights abuses while part of the government of the Islamic Republic of Iran as well as his alleged “continued support for Iran’s tyrannical regime” while at Oberlin. The letter goes on to attack Oberlin’s “apparent decision to whitewash Mr. Mahallati’s actions” and concludes that this alleged decision raises “serious questions about the ideals of Oberlin college and its willingness to allow foreign interference on its campus.” The letter goes on to direct Oberlin to provide answers — within 2 weeks of the date of the letter — to a list of highly invasive questions related to this specific professor and his courses, as well as Oberlin’s internal hiring/vetting practices in general (notably: Foxx and Banks have no legal authority to demand answers on anything from Oberlin, and Oberlin has no legal obligation to respond). (PROSECUTE IRANIAN PRESIDENT) Scott letter to POTUS: On 9/23/22, Sen. Scott (R-FL) sent a letter to President Biden condemning the Biden Administration for issuing a visa to allow the Iranian president to attend the UN General Assembly in New York, and, once Raisi arrived in the US, failing to take the opportunity to arrest the Iranian president and put him on trial in the US. Scott wrote: “…your administration ignored the wishes of so many Americans and allowed Raisi entrance to America and a stage to spread his lies to the world. You could have arrested him and held him accountable for his abuses, but you looked the other way. When you could have stood up for security and freedom, and prosecuted Raisi for his crimes, you floundered. Fortunately, it is not too late to reverse course and deliver justice to all those he has wronged. The protests in Iran are continuing, and the Iranian people are standing up for civil liberties and basic rights. The regime continues to support terrorist cells throughout the world, destabilize the region, threaten our ally, Israel, and do harm to Americans. Raisi is a danger to us all. I urge you to use the powers of the Department of Justice to prosecute Raisi and bring him to justice for his crimes.” Also see Scott press release.
