A Stunning, Expansive Time for Israel’s West Bank Annexation
Over the past two weeks, Israel has unleashed a flurry of settlement activity that makes its annexation of the West Bank complete. Even a small sampling of those acts, detailed below along with other news, are stunning when taken together. Indeed, Israeli National Missions Minister Orti Strock called this “a miraculous time,” referring to the control her and her allies have over key government bodies and how easy it is for them to fund settlement construction. Strock is a member of the Religious Zionism party, along with Bezalel Smotrich.
Renowned Israeli human rights lawyer Michael Sfard encapsulates this time powerfully in an article entitled, “Smotrich Has Completed Israel’s Annexation of the West Bank”:
“The only thing the annexationist criminals must be saying to themselves now is: why did we wait for 57 years? It’s so easy.”
Civil Admin Seizes Patchwork of Plots as “State Land” in Order to Legalize the Evyatar Outpost
On July 8th, the Israeli government declared 16 acres (66 dunams) of land south of Nablus as Israeli “state land” in order to pave the way for the legalization of the Evyatar outpost. Palestinians who have private ownership claims to the land have 45 days in which to submit an appeal. The declaration is the result of three years of “work” by Smotrich’s Settlements Administration to examine the status of the land in order to find a way for the state to take control of the land in order to legalize the outpost. The declaration comes one week after the Israeli Security of Cabinet decided in favor of legalizing the Evyatar outpost along with four other outposts.
The Evyatar outpost was illegally built by settlers on a strategic hilltop named Mount Sabih, located just south of Nablus on land historically belonging to nearby Palestinian villages Beita, Yatma, and Qablan. It was evacuated by the Israeli government in 2021 in the context of an agreement with settlers that left all construction at the site in place, maintained an IDF presence at the site, and made clear the government’s intent to legalize settlement at the site in the future – a goal which was made more than official when it was agreed to in writing as part of the coalition agreements that formed the current Israeli government.
To underscore the absurdity which has characterized the State’s blatant intent to legalize Evyatar even though Israeli law makes that an impossibility because parts of the land are recognized by the State as privately owned by Palestinians (which is the only reason Evyatar has yet to be legalized), the State’s new declaration of “state land” is a complete patchwork. The order does not include the land on which the central square of the outpost is built, nor does it include 11 buildings, or, very importantly, the access road leading from the main road to the outpost. The implications of this patchwork is that even though the privately owned land was not seized, Palestinians will remain unable to access the land and will, in practice, lose that land as well as land abutting the settlement as it grows, expands, and establishes control over the area with the assistance of the IDF.
Peace Now reports that this is the fifth “state land” declaration so far in 2024 bringing the total land in the West Bank taken into Israeli control this year to 5,879 acres (23,572 dunams), breaking all previous annual records combined. Israel invented the concept of “state land” in order to find means by which to confiscate land in the occupied West Bank, and to do so Israel cites Ottoman law which provided that land which has not been cultivated in consecutives years becomes the property of the sovereign. Peace Now explains:
“The declaration process is essentially a legal maneuver developed by Israel to circumvent the prohibition in international law against expropriating private property of the occupied population for the benefit of the occupying power. To “convert” private land into public land (termed “state land”) without expropriating it, Israel claims that it is not changing the land’s status but merely “declaring” it officially.
According to Israel’s interpretation of Ottoman land law, which underpins the land laws in the occupied territories, if a landowner does not cultivate their land for several years, the land is no longer theirs and becomes public property. To this end, the mapping personnel of the Civil Administration, now operating under the Settlements Administration with legal counsel under Minister Smotrich, examine aerial photographs to identify uncultivated lands and mark them as “state land.”
The declaration map for the Evyatar outpost shows that there were indeed several cultivated lands, even by Israel’s stringent interpretation. For example, the declaration creates an enclave of about 3.5 dunams in the middle of the area designated for the settlement, considered private land. In principle, Israel would argue that it is not expropriating this area and that the Palestinian landowners are still recognized as the owners. However, as in hundreds of similar cases, it is clear that they will not have access to their land and no possibility of using it when it is located in the middle of an Israeli settlement.
To enable an access road connecting the outpost to the main road without crossing private land, the map’s designers managed to “find” an 11-meter-long and 1.5-meter-wide corridor of land that they claim was uncultivated and thus considered state land. This interpretation of Ottoman law brings it to absurdity.
According to this, if a person has a plot and cultivates it intensively, but there is a small uncultivated strip on the edges, say a rock that cannot be plowed, that small part of the plot is not owned by the landowner. This interpretation is far removed from the purpose of the Ottoman law, which was to encourage the empire’s subjects to cultivate the lands to increase its tax revenues.
Regarding the access road – in any case, for modern vehicles, a road 1.5 meters wide is insufficient, and it is clear that to allow access to the settlement, the state will encroach on private Palestinian lands (requiring another legal maneuver). Thus, it can be said that this entire declaration of state land is essentially an unlawful expropriation under international law.”
Government Establishes Jurisdiction for New Settlement on World Heritage Site Near Bethlehem
On July 9th, the IDF Commander signed an order establishing the jurisdiction for a new settlement on the lands just west of Bethlehem, lands that are recognized as a World Heritage Site by UNESCO. Notably, the jurisdiction for the new settlement, called “Nahal Heletz”, does not include the land on which two illegal outposts already exist on Battir’s land. The new settlement is being planned for land that is between Bethlehem and several villages to its west (Walaja, Battir, and Husan) – meaning that construction on this land will sever the territorial continuity of Palestinian land in the Bethlehem region, and, in the words of Peace Now: “turn them [the villages] into an enclave within Israeli territory.”
There are several extraordinary facts about this land and Israel’s legal acrobatics to establish a new settlement at this location:

- The status of the land within the new jurisdiction is unclear, and quite possibly includes privately owned Palestinian land. The Israeli Blue Line Team (a government effort to precisely map the boundaries of state land in the West Bank) has prepared updated maps to show the boundaries of state land in the area, but has yet to release it – meaning that the status of the land is unclear. The jurisdiction appears to stretch beyond the previously understood boundaries of land that Israel seized as “state land” in the 1980s, onto land that is privately owned by Palestinians. The updated boundaries might change that fact in the eyes of the Israeli government. But,once the new Blue Line in the area is made public, Palestinians will/should be able to contest it.
- There is no access road to the area, and it is surrounded by privately owned Palestinian land. Israel will have to unilaterally expropriate privately owned Palestinian land in order to pave a road to the new settlement – – an extraordinary act which Israel has done in the past (having invented a legal basis on which to do it, a concept which considers Israeli settlers as part of the “local population” of the West Bank).
- The jurisdictional area established by this new order is too small for real development – just under 30 acres (120 dunams). Peace Now explains that “small settlements severely impact open spaces, require substantial resources for infrastructure and transportation, and contradict fundamental planning principles. The sole reason for establishing such a settlement is political: the desire to prevent a Palestinian territorial continuity in the Bethlehem area and the possibility of a viable Palestinian state.”
- The jurisdiction is a stones throw away from Palestinian houses and Area B.
Settlers Takeover New Building in Hebron
Peace Now reports that in early June 2024 settlers have taken over a building (“Beit HaTkuma”) in Hebron and established a new settlement enclave there. The house, which settlers illegally entered once before but were removed under the Bennet-Lapid government, on the main road leading from the Kiryat Arba settlement to the Tomb of the Patriarchs/Al-Ibrahimi Mosque.
Settlers claim to have purchased the house, which is a three-story building, from its Palestinians owners, and report that the Civil Administration has recently issued them a permit to begin the registration process. The timing of this permit coincides with the first days of Hillel Roth’s assumption of his role in the Defense Ministry as the civilian in charge of all land matters in the West Bank. Upon receiving the permit (allegedly), the settlers decided to enter and occupy the building although the permit does not provide for that. [map]
Historic Year for Land Grabs: Israel Seizes Over 3,000 Acres in the Jordan Valley as “State Land”
On June 25th, the head of the IDF signed an order declaring 3,138 acres (12,700 dunams) of land in the Jordan Valley as “state land” – the largest state land seizure since the Oslo Accords were signed in 1993. This is the first declaration enacted under the authority of Hillel Roth, the new civilian deputy in the Civil Administration responsible for land policy in Area C of the West Bank. Peace Now reports that the legal opinion supporting this massive declaration of state land was crafted by lawyers in the Department of Defense and not legal advisors with the IDF.
Peace Now further reports:
“A significant part of the area that was declared as state land was previously defined as a nature reserve, and also as a “fire area”, for military use, for decades. Today’s announcement completes the Israeli takeover of this area that has been done so far through the declaration of the area as a military area and as a nature reserve – something that imposed many restrictions on the Palestinians’ ability to use their lands. The declaration creates a territorial continuity between the settlements in the Jordan Valley (Yifit and Masu’a) and the settlements at the eastern end of the mountainside (Gitit and Ma’ale Efraim).”
So far in 2024, Israel has declared 5,852 acres as “state land” a figure eclipsing any other year since the Oslo Accords were signed in 1993. The highest previous total was in 2014, and it was for 1,181 acres.
Civil Admin Advances Plans to Legalize Three Outposts & Build 5k New Units Across West Bank
On July 4th, the Israeli Civil Administration approved the advancement of plans for 5,295 settlement units, including plans which would in effect legalize three outposts under the guise of being “neighborhoods” of existing settlements. This is the first time the Civil Administration’s High Planning Council has met since it came under the authority of a civilian official, Hillel Roth, who was appointed by Bezalel Smotrich. The HPC last met in March 2024. The Associated Press has called Israel’s advancement of plans a “turbo charged settlement drive [that] threatens to further stoke tensions on the West Bank.”
The three outposts that are now on their way to legalization, once given final approval, are:
- Mahane Gadi – to be legalized as a neighborhood of the Masu’a settlement in the northern Jordan Valley. This outpost was built in 2018 on an abandoned Isareli military camp. The outpost currently functions as an educational campus and pre-military academy. Plans advanced this week are for the construction of 260 settlement units. Masu’a settlement, and its outpost satellites, were recently benefitted by the Israeli government’s massive declaration of state land that borders Masu’a.
- Givat Hanan (Susya East) – to be legalized as a neighborhood of the Susya settlement located in the South Hebron Hills.
- Kedem Arava – it appears that the Kedem Arava outpost was legalized along with Beit Hogla in February 2023 (previously unclear), located south east of Jericho. Plans advanced this week are for 316 settlement units in the Kedem Arava outpost area, but filed as if they are plans for the Beit Hogla settlement.
The settlement plans that were approved for validation (a near final step in the West Bank planning process) are:
- Beitar Illit – 298 settlement units. An additional 453 units were approved for deposit (751 settlement units total).
- Givat Zeev – 452 settlement units
- Mitzpe Yericho – 365 settlement units
- Nokdim – 290 settlement units
- Immanuel – 266 settlement units
- Elon Moreh – 186 settlement units
- Kiryat Arba – 165 settlement units
- Negohot – 158 settlement units
- Tzofim – 74 settlement units
- Ganei Modiin – 46 settlement units
- Etz Efraim – 12 settlement units. An additional 24 units were approved for deposit (36 units total)
- Eli – 24 settlement units
- Mitzad (Asfar) – 6 settlement units
The settlement plans that were approved for deposit (an earlier step in the West Bank planning process) are:
- Neria – 436 settlement units
- Modin Illit – 300 settlement units
- Gva’ot – 250 settlement units. There were over 1,000 plans for the Gva’ot settlement on the High Planning Council’s agenda, but only one plan was advanced, the rest continue to be worked on.
- Yakir – 168 settlement units. Haaretz reports that these units are slated to be built on land that is discontiguous from the built up area of the Yakir settlement, on the far side of the settlement’s access road, effectively building a new settlement. The construction of these units requires the evacuation of a military base.
- Kiryat Netafim – 136 settlement units
- Hagai – 135 settlement units
- Maale Shomron (Elamatan) – 120 settlement units
- Almon (Anatot) – 91 settlement units
- Shilo – 90 settlement units
- Pduel – 37 settlement units
- Revava – 16 settlement units
- Elkana – 8 settlement units
- Shaarei Tikva – 6 settlement units
Peace Now said in a statement:
“Netanyahu and Smotrich’s agenda became evident through the decisions of the Planning Council: approval for thousands of housing units, the establishment of three new settlements, and strategic appointments of Smotrich’s allies in key roles instead of military personnel underscore the annexation occurring in the West Bank. Our government continues to change the rules of the game in the occupied West Bank, leading to irreversible harm. While the north is neglected and citizens across the country are abandoned, with 120 hostages still in Gaza, the process of annexation and land theft continues to expand, contrary to Israeli interests. This annexationist government severely undermines the security and future of both Israelis and Palestinians, and the cost of this recklessness will be paid for generations to come. We must bring down the government before it’s too late.”
Israeli Cabinet Gives Civil Admin Authority Over Antiquity Sites in Area B
In late June, the Israeli Cabinet approved several punitive measures against the Palestinian Authority, measures which included usurping the Palestinian Authority’s singular responsibility for antiquity sites in Area B. Under the decision passed last week, the Civil Administration was granted enforcement powers over antiquity sites in Area B that are alleged to be damaged.
Emek Shaveh explains why this is incredibly significant:
“Approximately 6,000 archaeological sites have been identified in the West Bank. Almost every village or settlement contains archaeological and historical remains that require archaeological supervision to prevent damage to sites, structures, or findings. Thousands of sites are located in Areas A and B…expanding the powers of the [Civil Administration] into these areas represents another Israeli departure from the Oslo Accords. The implications of the decision for Palestinian residents are far reaching. The Staff Officer for Archaeology [in the Civil Administration], which derives its authority from the antiquities law effective in the West Bank (the Jordanian Antiquities Law of 1966), will now be empowered to perform various enforcement actions in Area B including:
- Declaration of archaeological sites, determining their boundaries.
- Issuing work stoppage orders for any development within the boundaries of a declared site or a site suspected of containing archaeological remains.
- Imposing fines for damage to an antiquity site, whether the site is declared or not.
- Demolishing structures located within a declared archaeological site or one that will be declared in the future.
- Collecting information, investigating, and requesting the arrest of suspects in antiquities theft or illegal antiquities trade.
This decision taken together with other decisions for Area B aimed at promoting annexation will dramatically reduce Palestinian space. It should be noted that the SOA consistently avoids enforcing the law when it comes to heritage site destruction by settlers (this is true in Hebron, Battir, and in other places)….
The expansion of archaeological activity into the oPt, especially as reflected in this cabinet decision, indicates the government’s intention to promote annexation by any means. It also fundamentally challenges the possibility of conducting impartial archaeological-scientific activity as long as it operates as part of an oppressive mechanism under military auspices. Israeli archaeological activity in the West Bank necessarily becomes an act of land appropriation and a deepening of Israel’s hold on the West Bank. This action violates international law and ethics, disregards the existence of the Palestinian community, and serves as a weapon for oppression.
The destruction of sites cannot and should not serve as a pretext for political action, and political action should not be disguised as archaeological activity. Blurring the distinction between heritage preservation and settlement and annexation activities turns the practice of archaeology into a weapon of oppression while undermining its professional legitimacy.”
Notably, Israel Hayom credits this Cabinet action to a settler group called “Keepers of the Eternal,” (or, “Guardians of Eternity” – an offshoot of Regavim) the leader of which called the new powers granted to the Civil Administration “dramatic.” FMEP has reported on this group repeatedly as it has increased its pressure on and work with the government to take control of West Bank antiquity sites. Dating back to June 2020, the “Guardians of Eternity” began surveying areas in the West Bank that Israel has designated as archaeological sites, looking for Palestinian construction (barred by Israel in such areas) that they could then use as a pretext to demand that Israeli authorities demolish it. The group systematically began communicating its findings to the Archaeology Unit of the Israeli Civil Administration.
Then in January 2021, the Israeli government committed funding to a settler initiative to surveil archeological sites under Palestinian control. While the objective of protecting antiquities might appear uncontroversial and apolitical, the true (and transparently self-evident) objectives behind this effort are: to support yet another pretext to surveil and police Palestinians; to establish and exploit yet another means to dispossess Palestinians of their properties; to expand/deepen Israeli control across the West Bank; and to further entrench Israeli technical, bureaucratic and legal paradigms that treat the West Bank as sovereign Israeli territory. It is the result of a campaign that has taken place over the past year in which settlers have escalated their calls for the Israeli government to seize antiquities and “heritage sites” located in Palestinian communities across the West Bank, especially in Area C, which Israel today treats as functionally (and legally) indistinguishable from sovereign Israeli territory.
Israeli Cabinet Supports Knesset Considers Bill to Transfer West Bank Antiquities Control from Civil Admin to Domestic Body
Emek Shaveh reports that the Israeli cabinet gave its support to a bill in the Knesset that would transfer authority over West Bank antiquity sites from the Defense Ministry’s Civil Administration to the domestic Israeli Antiquities Authority, bringing the cultural, heritage, and archaeological sites in the West Bank under the direct control of the Israeli government in which West Bank Palestinians have no rights.
The bill, as proposed by Likud’s Amit Halevi, explains that the move is justifiable because the West Bank antiquity sites (unbelievably) “have no historical or other connection to the Palestinian Authority.” The bill passed a preliminary vote in the Knesset on July 10th.
U.S. Issues New Round of Sanctions Against Settlers & Settler Organizations
On July 11th, the United States announced another round of sanctions targeting Israeli settlers and settler organizations it asserts are perpetrating violent crimes against Palestinians and Israeli solidarity activists in the West Bank. These sanctions expand the web or already sanctioned individuals and entities.
The individuals and entities sanctioned by the U.S. this week are:
- 1 settler organization:
- Lehava – a settler group led by Benzi Gopstein, who is already under U.S. sanctions.
- 3 individuals:
- Issachar Manne – who established the Manne’s Farm outpost.
- Reut Ben Haim – the co-head of the Tzav 9 settler group, which is already under U.S. sanctions;
- Shlomo Sari – the co-head of the Tzav 9 settler group, which is already under U.S. sanctions;
- Four illegal outposts:
- Meitarim Farm (established by Yinon Levi, who is already under U.S. sanctions);
- HaMahoch Farm (established by Neria Ben Pazi, who is already under U.S. sanctions);
- Neria’s Farm (established by Neria Ben Pazi, who is already under U.S. sanctions); and,
- Manne’s Farm, established by Issachar Manne, who came under sanctions this week, and located in the South Herbon Hills.
Notably, The Times of Israel has previously reported that in 2021 a corporation owned by the Har Hebron Regional Council signed a legally binding contract with Yinon Levi (a previously sanctioned individual) to establish Meitarim Farm. This legal connection exposes the settlement municipality to US sanctions as well.
Aaron David Miler, a former state department Middle East negotiator now a senior fellow at the Carnegie Endowment for International Peace, tells The Guardian that the expanding targets of U.S. sanctions are creeping closer towards the Israeli government, saying:
“It appears that [the U.S. State Department] not just targeted extremist settlers but … introduced a linkage to territoriality by citing illegal outposts…It doesn’t take much imagination to conclude that the next target would be [Israeli] government financing for illegal outposts. And that would be a new departure to be sure.”
Sara Yager, Washington director of Human Rights Watch, said:
“In this case we’re pleased that the Biden administration is going farther than before with the alert…Now it’s time for sanctions against the Israeli authorities that are approving and inciting. We want to see the US, UK, Canada and others focus on power behind all this in the West Bank.”
Israeli Court Orders 11 Families Out of Homes in Batan al-Hawa, Silwan
This week the Jerusalem District Court ruled on two significant cases affecting 11 Palestinian families in Silwan facing forcible eviction from their homes at the hands of the Ateret Cohanim settler organization. Both cases were found in favor of the settlers, leaving 11 families at risk of imminent mass displacement from East Jerusalem. The Palestinians plan to appeal the ruling to the Israeli Supreme Court – though it was only a month ago that the Supreme Court rejected an appeal by the Shehadeh family whose case is similar to those decided this week.
On July 9th, the Israeli court rejected the final appeal of the Gheith and Abu Nab families (4 family units totalling 22 individuals) and ordered their immediate eviction. The families were also ordered to pay the legal fees incurred by Ateret Cohanim.
On July 10th, the Israeli court rejected the final appeal of the Rajabi family (7 family units, 65 individuals), ruling that the 66-member family must vacate their longtime home by January 2025.
In both cases, Ateret Cohanim claims ownership of the buildings becuase it gained control of the historic Benvenisti Trust, which oversaw the assets of Yemenite Jews who lived in Silwan in the 19th century. In 2001 the Israeli Charitable Trust Registrar granted Ateret Cohanim permission to revive the trust and become its trustees following 63 years of dormancy. In 2002, the Israeli Custodian General transferred ownership of the land in Batan al-Hawa to the Trust (i.e., to Ateret Cohanim). Since then, Ateret Cohanim has accelerated its multi-pronged campaign to remove Palestinians from their homes, claiming that the Palestinians are illegal squatters. Silwan is just one site of Ateret Cohanim’s work to establish Jewish enclaves inside densely populated Palestinian neighborhoods of East Jerusalem, for the explicit purpose of “reclaiming” Palestinian parts of Jerusalem for Jews.
Ir Amim explains:
“These families are among some 85 Palestinian families, consisting of over 700 individuals, who face largescale displacement and settler takeovers of their homes in Batan al-Hawa. This is a result of eviction claims filed by a Jewish trust established in the 19th century, which is now controlled by the Ateret Cohanim settler group who is exploiting it to take over Palestinian homes.
While carried out under a veneer of legitimacy, the proceedings are underpinned by discriminatory laws, political motivations, and a system that is rigged against Palestinians from the outset which deprives them of equal access to justice. Moreover, theses measures are a violation of international law and could amount to a form of forcible transfer.
Rather than adjudicating these cases from a broader perspective, which includes moral, geopolitical, and humanitarian considerations, as well as international law, the Israeli judiciary is instead complicit with these moves.
These cases are part and parcel of a coordinated and systematic political campaign aimed at uprooting Palestinians and expanding Jewish settlement in the heart of Palestinian neighborhoods. While the eviction claims themselves are initiated by settlers, they are aided and abetted on all levels of the state, which carry far-reaching implications on the future of Jerusalem and the conflict as a whole.”
Israeli Court Rules to Demolish Wadi Hilweh Info Center in Silwan
On July 3rd, the Jerusalem Court of Local Affairs ruled that the Wadi Hilweh Information Center will be demolished within a year, and fined the Center over $5,000 (NIS 20,000). The Wadi Hilweh Information Center is run by prominent activist Jawad Siyam, who along with the center is a fixture in Silwan and an important interlocutor with diplomats and alternative tourism who are seeking to learn about Palestinian history in the area and current struggles to remain there while enduring state + settler harassment and displacement.
The Center was opened in 2009, at which time the Jerusalem Municipality issued a warning notice demanding the demolition of part of the building that was recently “renovated” (the roof was repaired) because the Center did not obtain an Israeli-issued building permit to do the work. The Center says that the building itself predates Israel’s control of the area in 1967. It currently stands in the shadow of the massive “City of David Visitors Center” complex that the Elad settler organization has built over the years.
Peace Now said in a statement:
“Instead of taking care of all the residents of Jerusalem, Jews and Arabs, the Jerusalem Municipality works to harm the Palestinian residents and make their lives difficult. The tourist settlement in the Palestinian neighborhoods around the Old City, which is massively supported by the government, is aiming at erasing the Palestinian presence from the public space in East Jerusalem. The pressures exerted by the municipality against the Wadi Hilweh Information Center in Silwan and the intention to demolish it, are for the political purpose of not allowing the residents to organize and make their voices heard in the public domain.”
Israeli Court Tells Settlers To Leave Khalidi Library in Old City of Jerusalem
On June 30th, the Jerusalem District Court made a group of settlers vacate ta building in the Khalidi Library complex located in the Old City of Jerusalem after they broke into the building and occupied it three days prior. The library is within eyesight of the Western/Wailing Wall plaza (Kotel Plaza), on Chain Gate Road, which leads to the Haram al-Sharif. There is an IDF checkpoint right outside of the door, reflecting what an intensely sensitive area it is in.
The settlers had forged documents claiming to have purchased the building, but upon review of the Khalidi families’ own documents which show the family has owned the building for at least 160 years, the Court ordered the settlers to leave. There is another hearing set in the coming weeks which will allow the settlers, if they choose, to make their case.

In a statement, the Khalidi family said:
“Despite this temporary success, there is an ongoing fear of settler violence and the chilling effect of the occupation. Two of the settlers involved have been identified as Eli Attal ad Erez Zaka, the former linked to previous takeovers of Palestinian properties in the old city. After today’s ruling, scores of settlers remain lingering outside the house and on the rooftops filming and occasionally bagining on the doors and windows, posing a threat of breaking and entry and further illegal actions.”
Israel to Advance 6,000+ Settlement Units in East Jerusalem in Coming Weeks
Ir Amim reports that within the next two weeks Israel is planning to advance plans for 6,700 new settlement units in East Jerusalem. Plans to be advanced include:

- Givat Hamatos – plans for 3,500 new units, 1,300 new hotel rooms, five synagogues, and two mikvahs (ritual baths). This plan wouldl double the number of units in the settlement and expand its size by nearly 40%;
- Gilo – two plans for a total of 1,288 new settlement units, expanding hte settlement to the south east, further choking the Palestinian neighborhood of Beit Safafa and severing neighborhoods in southern Jerusalem from the Bethlehem area;
- Ramot – plans for 800 new settlement units.

Amidst Wave of Violence, Settlers Lead Progrom On Massafer Yatta Region
Palestinian residents in Masafer Yatta, an area of small villages in the South Hebron Hills, have been live streaming the frequent and intensifying terror that Israeli settlers have been inflicting on them for years. The terror peaked to unimaginable levels over the last weeks when, on multiple occasions, armed settlers descended on villages in the area inflicting terror, violence, and intimidation.
Eid Suleman, a prominent activist in Umm al-Khair, told the Associated Press:
“We know what this is. They’re trying to expel us out of here. The military did the dirty job last week and now the settlers are following up.”
Some of the events that have transpired include:
On June 26th, the IDF arrived in Umm al-Khair early in the morning and proceeded to demolish a third of Umm al-Khair’s structures (11 homes), leaving 38 people (30 children) homeless).
On July 1st, armed settlers descended on Umm al-Khair, some dressed as IDF officers, and fired live ammunition toward Palestinians, deployed tear gas, and attacked people with wooden sticks. Israel soldiers and police were nearby but did not intervene.
On July 2nd, settlers were accompanied by Isreali soldiers as the entered the village of Umm al-Khair and built a tent in the center square, where 40 settlers gathered in a sort of celebration. When they eventually left, the settlers cut the water pipes supplying the village and warned of their plans to return the next day.
On July 3rd, settlers descended on the nearby village of Khalled al-Daba’a and set agricultural crops and trees on fire. The settlers then proceeded to march on the homes in the village carrying cans of gasoline and guns.
On July 4th, Palestinian residents reported that 100 settlers attacked the village of Khaled al-Daba, setting fire to fruit trees and shooting live ammunition directly towards Palestinians. Settlers proceeded to beat villages with sticks. Israeli forces arrested one Palestinian.
Settlers then moved to Mufagarah, a nearby village, where they destroyed vehicles and prevented emergency medical workers from reaching Palestinians and internationals in need. Palestinians report several Palestinians and two internationals were injured by the settlers.
On July 7th, the IDF arrested members of the Hureini family – who are all prominent activists in the area – who had called the police to report that settlers had shepherded flocks of sheep onto the Hureini’s land.
The Center for Jewish Nonviolence (which maintains a protective presence in Masafer Yatta and closely allied with the local population there) reports that “the attacks on Umm al-Khair after the demolition on Wednesday are being led by a settler named Shimon Atiya (or Atia), a leader of the nearby illegal outpost, Havat Shorashim (or “Roots Farm” in English). For months, he has been one of countless settlers acting with impunity while wreaking havoc on Palestinian communities across Area C.”
The events in Massafer Yatta bring into stark relief the intensity and persistence of settler terrorism in the West Bank, especially since October 7, 2023. AIDA (Association of International Development Agencies) has recorded 1,000 incidents of settler violence since October 7th.
The outgoing head of the Israeli Army’s Central Command, Yehuda Fuchs, used his farewell speech to criticize Israel policy makers for their failure to deter settler terrorism in the West Bank.
Ariel Settlers Close Access Road to Palestinians
The Mayor of the Ariel settlement has blockaded on the main access road leading to the nearby Palestinian village ofSalfit, boasting about his actions in an Instagram post. In addition to building a blockade of boulders and a welded gate, workers also destroyed parts of the road. The Civil Administration has attempted to remove the blockades and restore use of the road, but each time the settlers have re-constructed the blockade.
The Ariel settlement Mayor, Yair Chetboun, said in the video:
“Security is foremost upon us, upon the city. We trust the IDF, love the IDF, but if the senior levels don’t understand the importance of blockading this route – which led to attacks and enables car theft. We won’t permit such a reality. We are also operating on the political front but also on the ground.”
IDF Demolishes Outposts, Clashes With Settlers
On July 3rd, settlers clashed with Israeli authorities as they attempted to demolish the illegal outpost “Oz Zion B.” Haaretz reports that five settlers were arrested for violence against Israeli Border Police, and four were quickly released without questioning or restrictions. One settler who pepper sprayed an officer was brought to court for a hearing but later released and forbidden from going near the outpost.
The demolition of the outpost was reportedly ok’d by Prime Minister Netanyahu – going over the head of Bezalel Smotrich and the Settlement Administration, which has seized control of building enforcement in the West Bank. The outpost, according to the Shin Bet, was the source of violent terror.

Fuel on the Fire: Netanyahu Advances E-1 Settlement Plans
On February 26th, the High Planning Council of the Israeli Civil Administration deposited for public review two separate plans (for a combined total of 3,401 units) for the construction of the infamous E-1 settlement. This move sets in motion a 60-day public commenting period, after which the committee can grant final approval for construction. Long called a “doomsday” settlement by supporters of a two-state solution, construction of the E-1 settlement would sever the West Bank effectively in half, foreclosing the possibility of drawing a border between Israel and Palestine in a manner which preserves territorial contiguity between the northern and southern parts of the West Bank. It would likewise consolidate the isolation of Palestinian neighborhoods in East Jerusalem from the West Bank. In combination with the recent advancements on Givat Hamatos and new tenders for Har Homa, Prime Minister Netanyahu’s Greater Jerusalem settlement construction announcements – leading up to the third round of Israeli elections – have crossed red lines (in the eyes of the international community) that Netanyahu didn’t dare cross in the past.
The day before the High Planning Committee’s decision to deposit the plans, Netanyahu announced that he had lifted the freeze on E-1 that his government has imposed since 2012. Though the plans were approved for deposit in 2012, the administrative act of actually depositing the plans (which requires the plans to be published in at least three newspapers to inform the public) never occurred, largely as a result of intense international opposition to E-1. Under the recently released Trump Plan, the area where E-1 is located is slated to become part of Israel, meaning the long-held U.S. opposition to E-1 has transformed into apparent support.
Peace Now explains important context to Netanyahu’s flood of East Jerusalem settlement approvals:
“This move to promote settlement units in E1 should be understood in the context of government actions to promote settlement construction in Givat Hamatos and Har Homa to sever the Bethlehem-Jerusalem continuum, and the early promotion of a plan to turn the decommissioned Atarot Airport into a new Jerusalem settlement that would work toward severing the Ramallah-Jerusalem continuum. With E1 added to the mix, the pattern of severing the East Jerusalem and the West Bank is a clear policy direction of this government. While this announcement may be connected to the upcoming election, Netanyahu should be taken at his word and his comments should not be written off as campaign bluster. Indeed just this week he fulfilled a promise he made the week prior to publish tenders in Givat HaMatos, another area that was seen as a red line by the international community. It is likely that if moving on E1 is not met with deterring action domestically or abroad then it will further encourage settlement activity, seeing as E1 is the most recognized red line on settlement construction. The US, which has traditionally played a large role in deterring activity in E1, will likely not do so now with its current administration. Indeed, the Trump Plan envisions E1 as part of Israel, and allows for Israeli annexation pending coordination with the US and not negotiations with the Palestinians.”
Ir Amim adds:
“Although these advancements have taken place against the backdrop of the upcoming Israeli elections, they should also be seen as an alarm bell in the context of a new reality which has been created with the publication of the US Peace Plan. Carte blanche has essentially been given to Netanyahu and the Israeli government to further carry out unilateral measures in the Jerusalem area with little to no resistance. An acute exemplification of this major shift is the spate of new settlement plans (Atarot, Har Homa E, Givat Hamatos) being advanced over the Green Line in East Jerusalem, and now within the E1 area. After years of restraint due to international opposition, Israel is now set to advance construction in some of the most controversial areas in Jerusalem and along its perimeter. The realization of these plans will serve as an immense obstacle towards the future establishment of a Palestinian capital in the city and the prospect of a negotiated agreement based on a viable two-state framework.”
PLO Executive Committeewoman Hanan Ashrawi said in a statement:
“With the active participation and support of the current US administration, Israel is unilaterally and illegally annexing Palestinian territory and trampling on the Palestinian people’s most basic rights. These announcements are the practical translation of an extremist, ideologically-driven, and dangerous right-wing agenda that trounces Palestinian human rights and threatens to unravel the international order in favor of unilateralism, exceptionalism and political bullying.”
UN Special Coordinator for the Middle East Peace Process, Nikolay Mladenov, said:
“I am very concerned about Israel’s recent announcements regarding the advancement of settlement construction in Giv’at Hamatos and Har Homa, as well as the worrying plans for 3,500 units in the controversial E1 area of the occupied West Bank. All settlements are illegal under international law and remain a substantial obstacle to peace. If the E1 plan were to be implemented, it would sever the connection between northern and southern West Bank, significantly undermining the chances for establishing a viable and contiguous Palestinian state as part of a negotiated two-state solution. I urge the Israeli authorities to refrain from such unilateral actions that fuel instability and further erode the prospects for resuming Palestinian-Israeli negotiations on the basis of relevant UN resolutions, international law and bilateral agreements.”
Making Good On Bibi’s Promise, Israel Issues Tenders for Givat Hamatos Settlement – And Plans for More
As expected, on February 24th the Israeli Lands Authority published a tender for the construction of 1,077 housing units in the Givat Hamatos settlement. Haaretz reports that the tender relates to plans for “state land” and are intended to be sold as part of the the Treasury Ministry’s subsidized housing plan for young Jewish couples. Private companies will invited to bid on the project starting March 5th, with bidding set to close on June 22nd.
In addition to issuing tenders, the Jerusalem District Planning Committee met on February 27th to discuss the possibility of creating a new master plan for Givat Hamatos, in order to allow for more construction in the area. Ir Amim reports that the committee is considering a plan allowing for 6,500 residential units – which nearly doubles the total outlined in the current plan.
Ir Amim writes:
“This is the first time since the late 1990’s that Israel is constructing a new neighborhood/settlement in East Jerusalem. Furthermore, the location of Givat Hamatos means that its consturction will have dire consequences: It will serve to detach Bethlehem and the south of the West Bank from East Jerusalem while isolating the Palestinian neighborhood of Beit Safafa. For several years Netanyahu has abstained from publishing the Givat Hamatos tenders, serving as a source of frustration among rightwing parties. Netanyahu’s announcement therefore constitutes a break in the longstanding restraint. This dramatic change of policy should be seen in the context of his re-election campaign and against the backdrop of the formal release of the US Peace Plan.”
In announcing his support for the construction of the Givat Hamatos settlement last week, Netanyahu also mentioned plans to build 1,000 new homes for Palestinian residents of Beit Safafa – an East Jerusalem neighborhood which will be completely encircled by Israeli construction if/when the Givat Hamatos and Har Homa West settlement plans are implemented. According to Haaretz, the plan was/is to build 1,000 units on “Arab-owned” land — and that plan, in fact, is frozen.
In reaction to the tender for construction of the Givat Hamatos settlement, European Union High Representative Josep Borrell said in a statement:
“The Israeli authorities have announced an imminent decision regarding settlement construction in the Givat Hamatos and Har Homa neighbourhoods in East Jerusalem. Such steps would be deeply detrimental to a two-state-solution. As set out clearly on numerous occasions by the European Union, including in Council conclusions, such steps would cut the geographic and territorial contiguity between Jerusalem and Bethlehem, isolate Palestinian communities living in these areas, and threaten the viability of a two-state solution, with Jerusalem as capital of both states. Settlements are illegal under international law. The EU will not recognise any changes to the pre-1967 borders, including with regard to Jerusalem, other than those agreed by the parties. We call on Israel to reconsider these plans.”
High Planning Council Advances Plans for 1,739 Settlement Units, Including a New Industrial Zone
On February 27th, the High Planning Council – a body within the Israeli Civil Administration responsible for regulating all construction in the West Bank – approved the advancement of plans for 1,739 settlement units in the West Bank. These advancements come on the heels of the publication of tenders to build the E-1 settlement , the initiation of plans to massively expand the Har Homa settlement, and the recommitment of Israel to build a new massive new settlement in East Jerusalem, at the site of the disused Atarot airport. All of these plans deal with construction on the edges of Jerusalem and serve collectively to sever the connection between Palestinian neighborhoods of East Jerusalem and the West Bank (consolidating Israel’s uncontested sovereignty over “Greater Jerusalem”).
Of the total, 703 units received final approval, including:
- Plans to grant retroactive legalization to 620 units in the Eli settlement, a move which had been frozen by the High Court of Justice for the past 5 years while the Court considered a petition filed by Palestinians (with the assistance of Yesh Din and Bimkom) claiming to own the land. Last week, the High Court ruled against the Pallestinian petition and removed the injunction against the plans. The Eli settlement is located south of Nablus and southeast of the Ariel settlement in the central West Bank
- 48 units in the Har Bracha settlement, located just south of Nablus
- 35 units in the Givat Ze’ev settlement, located south west of Ramallah (north of Jerusalem).
Of the total, 1,036 units were approved for deposit for public review, including:
- A new industrial zone – called “Shaar Hashomron” – to be located south of the Palestinian village of Qalqilya (a town which is literally surrounded on three sides by the Israeli separation barrier – which in this area is, indeed, a massive wall). Peace Now reports: “[the new industrial zone is] close to Green Line, east of Salfit and South of Qalqilya, near the planned Nahal Rabah cemetery. In the area of Nahal Rabah, there existed a firing zone for years that prevented the use of the land. The land’s designation as a firing zone was lifted a few years ago, and the government’s Blue Line team set new boundaries for the state lands that comprised this area, all in preparation for a plan to build a new industrial zone. Industrial zones are a type of settlement in of themselves, and the planned cemetery is likely to be the first component toward establishing the new industrial zone. The plan for this new industrial park is separate from the 1,739 housing units advanced in the HPC announcement.”
- A winery in the Kiryat Arba settlement, located on the border of Hebron.
- 534 units in the Shvut Rachel settlement, located near the Shilo settlement in the central West Bank. Shvut Rachel only recently became an authorized settlement area when Israel extended the jurisdiction of the Shiloh settlement to include it as a “neighborhood” (along with three other outposts).
- Two plans for a total of 156 units in the Tzofim settlement, located just north of the Palestinian village of Qalqilya, a town completely encircled by Israel’s seperation barrier (except for a single road connecting it to the rest of the West Bank) – in the northern West Bank.
- 110 units in the Alon Shvut settlement, located south west of Bethlehem.
- 106 units in the Ma’aleh Shomron settlement, located east of the Palestinian village of Qalqilya.
- 105 units in Kfar Eldad (formally a part of the Nokdim settlement), located south of Bethlehem.
- 24 units in the Karnei Shomron settlement, located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron with the stated goal of bringing 1 million settlers to live in the area surrounding the settlement.
The Times of Israel notes that this is the second time the High Planning Council has convened in as many months, marking an uptick in the frequency of such meetings, which until now have taken place quarterly (4x/year) since the Trump Administration came into power.
Peace Now said in a statement:
“The caretaker government, without a public and moral mandate, sets facts on the ground for a small and extreme minority, against the will of the majority. In the battle over the settler right-wing vote, Bennett and Netanyahu are dragging Israel to invest in thousands of harmful and unnecessary settlement units. This is how a cynical and irresponsible leadership that is willing to abandon the Israeli interest for its political survival behaves.”
Netanyahu Orders 12 Outposts Hooked Up to Israeli Infrastructure, with More to Follow
On February 23rd, Prime Minister Netanyahu announced that he had ordered 12 unauthorized outposts to be connected to Israeli infrastructure, and that his government was working to formally legalize over 100 outposts. Connecting outposts to Israeli water, sewer, power, garbage collection, and other municipal services entrenches the permanence of these outposts and furthers the de facto annexation of Palestinian land. It also copiously rewarding settlers for breaking Israeli law (by illegally building outposts), incentivizing further lawbreaking by Israel’s most radical and ideological settlers. 
According to a letter from Netanyahu’s office, the 12 unauthorized outposts that will be connected to Israeli infrastructure were all built with “government encouragement” (though not formal approval or permits). In a perversion of the very notion of the “rule of law,” this unofficial encouragement for illegal actions is now treated by Israel as a valid legal basis for granting those outposts authorization.
The outposts slated for connection to Israeli municipal services are:
- The Nofei Nehemia outpost, located east of the Ariel settlement in the heart of the West Bank.
- The Havot Yair (Yair Farm) outpost, located west of Nablus.
- An outpost called “Hill 851”, located south east of Nablus in the central West Bank.
- The Maoz Zvi outpost, located in the northern West Bank.
- The Shaharit outpost, located in a string of settlements stretching from Israel proper to the Ariel settlement in the central West Bank, and going on to the Jordan Valley.
- The Pnei Kedem Farm outpost, located halfway between Bethlehem and Hebron in the southern West Bank.
- The Tekoa D outpost, located southeast of Bethlehem.
- The Negohot Farm outpost, located west of Hebron.
- The Avigayil outpost, located in the South Hebron Hills near the village of Susya.
- The Asa’el outpost, located east of the Palestinian village of Susiya in the southern tip of the West Bank.
- The Esh Kodesh outpost, located east of the Ariel and Shilo settlements, in a string of settlements stretching to the Jordan Valley.
- Ahiya, located in the Shilo Valley in the central West Bank.
David Elhayani, head of the umbrella settlement body called the Yesha Council, cheered Netanyahu’s announcement, saying:
“This is an important step for the benefit of young communities that have been suffering from electricity problems for years, and will now be able to receive electricity, just like any other citizen in the country.”
Since the passage of the Regulation Law in February 2017 and the invention of the “market regulation” principle by the Israeli Attorney General, the Netanyahu government has undertaken an energetic effort to grant retroactive legalization to outposts for which the Israeli government has not yet found a means to grant retroactive approval (though it has tried). The obstacle in all of these cases has been the fact that the outposts were built on privately owned Palestinian land. Following passage of the Regulation Law, Netanyahu immediately formed a committee tasked with finding a way to suspend the property rights of Palestinians; that committee produced the Zandberg Report in May 2018 — a report that, indeed, offers several justifications for the government to expropriate privately owned Palestinian land (one of the Report’s recommendations is to connect the outposts to Israeli municipal services). Following the publication of the Zandberg report, Netanyahu formed another committee tasked with implementing the report’s recommendations, by preparing individualized plans for each outpost to gain retroactive legalization. That taskforce, headed by notorious settler Pinchas Wallerstein. helped secure Cabinet approval for another bill to grant authorization to 66 outposts. All but two of the outposts named by Netanyahu this week (Hill 851 & Negohot) were part of a December 2018 bill to regulate 66 outposts – a fact that has drawn the wrath of settler leaders who bemoan Netanyahu’s delayed implementation.

Israel is Planning New West Bank Electricity Grid to Serve the Settlements
Haaretz reports that the Israeli government is close to approving a Master Plan for a new electricity grid in the West Bank, which will service Israel’s settlements. It may also serve Palestinian villages but only if — and it is a big if — the Palestinian Authority agrees to jointly implement the project. The plan is in the hands of Israel’s National Infrastructure, Energy and Water Ministry, which seeks to “provide a blueprint for the electricity market in the West Bank through 2040 and to develop infrastructure for Israeli settlements as well as for the Palestinians residing there.” However, the Israel-conceived plan calls upon the the Palestinian Authority to take responsibility over the Palestinian side of the equation, and the PA has refused to play that role and has condemned the plan.
In a statement, the Palestinian Authority’s Energy Authority said that the plan is designed:
“to establish Israeli sovereignty in the West Bank and to support the brutal presence of the settlements on our land.”
Settler leaders concurred with the PA’s assessment. Gush Etzion Regional Council chairman Shlomo Ne’eman told Haaretz:
“All moves point to sovereignty, and when we build infrastructure, there is also a basic understanding that the State of Israel is the sovereign. We are pleased that more and more government ministries have realized that this sovereignty is the reality.”
The plan, as reported by Haaretz, would see the Israeli Electric Company build a vast network of power lines across the West Bank. Israel will build six substations in Area C of the West Bank to distribute the high voltage power to settlements. Palestinians, if they are willing, are called upone to build eight substations in order to distribute power to Palestinian homes. The project is expected to cost between $870 million to $1.2 billion. The integration of settlements into Israel’s domestic planning schemes and the construction of massive infrastructure in the West Bank to service the settlements are significant advancements in Israel’s ongoing, de facto annexation of land in the West Bank.

Haaretz reports that the Israeli Civil Administration planned to evacuate the unauthorized Mitzpe Yehuda outpost, located east of Jerusalem, in September 2019, but was directed to cancel the evacuation by one of Netanyahu’s personal aids in the Defense Ministry – Avi Roeh. The political interference was revealed in a High Court case filed by Palestinians claiming to own the land upon which the outpost was illegally constructed. The Palestinians are seeking to have the outpost immediately evacuated. Settlers claim to have purchased the land, and even submitted an application to have the outpost retroactively legalized by the government.
At the time of the scandal, Deputy Attorney General Erez Kaminitz wrote to Ronen Peretz, acting director of the Prime Minister’s Office, criticizing Roeh’s role in the Mitzpe Yehuda case, as well as the recurrence of political interference on behalf of the outposts. Citing several cases in which such interference occurred (Sde Ephraim, Givat Assaf, and Havat Negohot), Kaminitz wrote:
“This is a very alarming accumulation of cases that raises the specter of the emergence of a highly problematic trend that undermines the rule of law. It’s important to make clear that, as a rule, the political echelon is not authorized to intervene in decisions related to law enforcement.
Joint U.S.-Israeli Annexation Mapping Team Begin Work in Ariel
On February 24th, members of the U.S.-Israeli team tasked with mapping Israel’s annexation of West Bank land under the Trump Plan met for the first time to “explore the terrain.” At a vista near the Ariel settlement, Netanyahu underscored the significance of the project:
“The joint mapping process of the Israeli team and the American team is underway here in Ariel. This is a major mission. The area has an 800-km. perimeter. There is serious work, but we will work as quickly as possible to get it done…[the mapping process will] allow for the application of Israeli law [sovereignty] on these areas and later American recognition as well…[once complete] sovereignty can happen immediately.”
U.S. Ambassador David Friedman said:
“In Israel rain is a blessing, and I hope that our efforts should be blessed as much as the rain is coming down right now,” Friedman declared before the meeting started, the US Embassy in Jerusalem said in a statement. “We have our team here, and we’re going to get to work right away. We hope to complete it as soon as possible, and complete it the right way for the State of Israel.”
Ariel Mayor Eli Shaviro – one of the few settler leaders who publicly supports the Trump Plan – praised the mapping team, saying:
“The sovereignty ship is under way. As I have said in the past, I believe that the prime minister will advance the ‘Deal of the Century’ with President Trump and US officials. believe that the application of Israeli law in the Jordan Valley and in the communities of Judea and Samaria is closer than ever.”
Shaviro recently resigned from the settler Yesha Council over the group’s disavowal of the Trump Plan.

ICC Opens Formal Investigation into Israeli War Crimes, Including Israeli Settlements
On December 20, 2019 the Chief Prosecutor of the International Criminal Court (ICC) Fatou Bensouda announced that the court has found a reasonable basis upon which to open an investigation into Israeli war crimes against Palestinians in the West Bank, East Jerusalem, and Gaza. Bensouda said that the preliminary investigation, launched five years ago, established sufficient evidence of war crimes, citing Israeli settlements and Israel’s conduct during its 2014 incursion into the Gaza Strip, which Israel gave the title “Operation Protective Edge”. The statement said that the Court found evidence that Hamas and armed Palestinian groups also committed war crimes during the 50 days of hostilities in 2014.
Before proceeding with a formal investigation, Bensouda requested a pre-trial chamber to rule on the Court’s territorial jurisdiction, as outlined in the Rome Statute, over the West Bank, East Jerusalem, and Gaza Strip. Bensouda requested a ruling on the matter within 120 days. Bensouda has previously articulated her opinion on the matter, suggesting that questions regarding Palestinian statehood do not necessarily need to be resolved because Palestine acceded to the Rome Statute and formally became a “State Party” to the court.
Israel to ICC: You Do Not Have Jurisdiction & You Will Not Stop Us from Advancing Settlements and Annexation
Prior to Bensouda’s announcement on December 20th that the ICC will proceed with an investigation into Israeli war crimes in the West Bank, East Jerusalem, and Gaza, Israeli Attorney General Avichai Mandleblit published a 34-page legal opinion arguing that the Court does not have jurisdiction over those territories because Palestine does not meet the criteria for statehood, and non-sovereign entities cannot confer jurisdiction to the Court. Notably, that opinion doesn’t address (let alone dispute or challenge) the assertion that Israeli actions might constitute war crimes.
Going beyond Mandleblit’s legal arguments, Netanyahu launched a disingenuous attack on Bensouda’s criticism of Israeli settlements, saying:
“[Bensouda] says it is a crime, a war crime, for Jews to live in their homeland, the land of the Bible, the land of our forefathers.”
Netanyahu later said:
“This will not deter us — not in the slightest”
Netanyahu is riding a wave of defiant, ultra-confident language following his Dec. 27th victory in the Likud primaries, after which he promised to secure U.S. recognition for Israeli sovereignty over the Jordan Valley and all settlements in the West Bank. In his victory speech, Netanyahu laid out a 6-point plan he will implement if he goes on to win the March 2020 elections:
“First, we will finalize our borders; second, we will push the US to recognize our sovereignty in the Jordan Valley and the northern Dead Sea; third, we will push for US recognition of our extension of sovereignty over all the communities in Judea and Samaria, all of them without exception; fourth, we will push for a historic defense alliance with the US that will preserve Israeli freedom of action; fifth, stop Iran and its allies decisively; and sixth, push for normalization and agreements that will lead to peace accords with Arab countries. The opportunities are within reach.”
Demonstrating that Netanyahu means what he says, shortly following the ICC’s announcement his government advanced plans for nearly 2,000 settlement units and launched the planning process for annexing the Jordan Valley. Both of these items – in addition to several other significant settlement advancements which were not explicitly linked to the ICC’s announcement – are covered in detail below.
Following ICC Announcement, Israel Advances Plans for Nearly 2,000 Settlement Units
Over the course of a two-day meeting Jan 5-6, 2020, the Israeli Civil Administration’s High Planning Committee approved plans for 1,936 settlement units, of which 786 units received final approval for construction. The Israeli Civil Administration is the body of the Defense Ministry which regulates all construction in the West Bank, both Palestinian and Israeli settler.
The Civil Administration granted final approval to the following plans:
- A plan for 258 units in the unauthorized Haresha outpost, located east of Ramallah, to take them to the final stage of the approval process. If granted final approval, the plan will have the effect of retroactively legalizing the Haresha outpost. This outpost has been one of several test cases for the Israel government’s evolving legal justifications for granting retroactive approval to unauthorized outposts built on privately owned Palestinian land. In the case of Haresha, an outpost built on an island of “state land” surrounded by privately owned Palestinian land, then-Israeli Justice Minister Ayelet Shaked issued a new legal opinion in December 2018 outlining a legal basis for temporarily seizing the private Palestinian land for the construction of a tunnel road underneath it (essentially holding that Palestinian land rights – which can be temporarily infringed upon at any time for the sake of the settlements – do not extend below the ground’s surface). The tunnel road has not yet been constructed, an important qualification that Israel, to this point, has generally required outposts to meet prior to legalization.
- 147 units in the Mitzpe Yericho settlement, located just west of the Palestinian city of Jericho in the Jordan Valley. The plan will have the effect of retroactively legalizing existing illegal construction in the settlement.
- 120 units in the Karnei Shomron settlement, located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron with the stated goal of bringing 1 million settlers to live in the area surrounding the settlement.
- 107 units in the Elon Moreh settlement, located east of Nablus.
- 100 units in the Halamish settlement, (where settlers have built a strategic outpost, with the protection of the IDF, in order to further restrict Palestinian access to the area);
- 25 units in the Peduel settlement, located in the northern West Bank and part of a string of settlements and unauthorized outposts – most notably Ariel – extending from the Green Line into the very heart of the West Bank and on towards the Jordan Valley.
- 12 units in the Ariel settlement, located in the central West Bank.
- 10 units in the Etz Efraim settlement, located in the northern West Bank, one of several settlements slated to become a “super settlement” area.
- 7 units in the Rechelim settlement, located east of the Ariel settlement and south of Nablus, in the heart of the West Bank.
The Civil Administration advanced the following plans:
- 224 units in the Talmon settlement, located west of Ramallah.
- 204 units in the Shilo settlement, located in the central West Bank.
- A plan for 180 units in the unauthorized Mitzpe Danny outpost, located east of Ramallah. If approved, the plan will have the effect of retroactively legalizing the outpost, which was built without Israeli permission in 1999 in an area that includes privately owned Palestinian land. The Binyamin Regional Council – a settler body acting as the municipal government for settlements in the central West Bank – has been angling to retroactively legalize Mitzpe Danny for some time. As part of that effort, the regional council successfully lobbied for approval of a plan to build an educational campus for settlers that will create a territorial link between the Maale Mikhmash settlement (which has official recognition from the government) and the outpost. That plan received final approval in January 2019.
- 160 units in the Kochav Yaakov settlement, located between Jerusalem and Ramallah.
- 92 units in the Tzofim settlement, one of the settlements that flank the Palestinian city of Qalqilya in the northern West Bank.
- 91 units in the Almon settlement, located northeast of Jerusalem.
- 136 units in the Givat Zeev settlement, located south of Ramallah.
- 63 units in the Maale Adumim settlement, located just east of Jerusalem.
- A plan for 204 new units in the Shvut Rachel settlement, which only recently became an authorized settlement area when Israel extended the jurisdiction of the Shiloh settlement to include it as a “neighborhood” (along with three other outposts).
Peace Now said in a statement:
“Despite lacking a clear mandate, for this caretaker government it’s business as usual – Continue the massive promotion of harmful and unnecessary construction in occupied territory and in places that Israel will have to evacuate. Netanyahu continues to sabotage the prospects of peace, dragging Israel into an anti-democratic one-state reality resembling apartheid.”
The Yesha Council, an umbrella group representing all the settlements, celebrated the approvals, saying in a statement:
“To our delight, construction in Judea, Samaria and the Jordan Valley is commonplace and we are pleased to see that every few months plans are up in the Supreme Planning Council. The time has come for extremist Leftist organizations to accept that the U.S. has also declared that settling in Judea, Samaria, and the Jordan Valley is not contrary to international law and that applying Israeli sovereignty is a consensus in the State of Israel. After eight years of unprecedented construction freeze, the government regularly approves construction and we strengthen the hands of the Prime Minister and Defense Minister on their blessed work. We need more and more construction to promote the prosperity and growth of settlement.”
The head of the Binyamin Regional Council, Yisrael Gantz, spoke happily about the settlement advancements but also kept focused on the settlement movement’s ultimate demand: annexation. Gantz told Arutz Sheva:
“This is undoubtedly an important and significant step. I hope we will soon be able to applaud the application of full Israeli sovereignty and the closure of the Civil Administration in order to truly develop the regions of our amazing country, in the same way that it is possible in the entire State of Israel.”
Despite the celebratory remarks, settlers were disappointed with the final number of settlement units, which fell short of the 3,000 units Netanyahu promised to advance on the eve of the Likud primary leadership vote (which went in Netanyahu’s favor). When promising the 3,000 units, Netanyahu also promised:
“We are going to bring [secure] US recognition for our sovereignty in the Jordan Valley [and] in all the settlements, those in the blocs and those that are beyond it.”
Following ICC Announcement, Israel Begins Planning Jordan Valley Annexation
On January 5th, the inter-ministerial committee created to plan the annexation of the Jordan Valley held its first meeting, in an effort to prepare an official proposal for how Israel can annex the Jordan Valley. The committee – dubbed the “Sovereignty Committee” – is headed by the Prime Minister’s Office Director General Ronen Peretz and includes representatives from the Foreign Ministry, the Israel Defense Forces, and the National Security Council.
The meeting took place despite (or perhaps because of) reports that Netanayhu put Jordan Valley annexation plans in a “deep freeze” following ICC Chief Prosecutor Fatou Bensouda’s announcement on Dec. 20th that the Court will open an investigation into war crimes committed by Israel in the West Bank, East Jerusalem, and Gaza. Following those reports, the head of the Yesha Council, the settler umbrella group, David ElHayani spoke to Netanyahu on the phone to gain reassurance that the annexation plan was not frozen, which Netanyahu reportedly gave him.
Haaretz reports:
“Sources familiar with the establishment of the inter-ministerial committee told Haaretz that the insistence on moving forward with the discussions are mainly to show that the idea has not been abandoned due to international pressure.”
Plans Advance in East Jerusalem, Part 1: New Settlement Enclave in Palestinian Neighborhood
On January 8th the Jerusalem District Planning Committee granted final approval to a new 75-unit settlement compound to be built in the heart of the Palestinian East Jerusalem neighborhood of Beit Hanina. If built, it will be the first-ever authorized settlement project in Beit Hanina, located north of the Old City.

The Beit Hanina settlement plan – as FMEP has previously reported – is backed and promoted by settlement impresario Aryeh King, and it provides for the construction of a total of 150 new units in the southern end of the Beit Hanina neighborhood. The land slated for the 150 units is privately owned, 53% of the land is owned by an Israeli who is supportive of the plan, and 47% by a Palestinian company who objects to the plan and has fought against it. Because the land has not been surveyed to demarcate the split ownership, Israeli planning authorities decided that the settlement plan is designated for the entire property, with construction rights split evenly between the parties, meaning the 75 units granted final approval on January 8th represent the Israeli-controlled half of the project.
Ir Amim notes the larger picture of Isreali settlement activity north of the Old City:
“In close proximity to Ramat Shlomo to the southwest and Pisgat Zeev to the northeast, construction of this new compound may signal the beginning of a move to create contiguity between the two settlements, while fracturing the contiguous space between Bet Hanina and Shuafat. As exemplified by the ring of state-sponsored settlement strongholds throughout the Old City Basin, the establishment of a settler enclave in the midst of Beit Hanina will not only impact the fabric of this community, but will further erode opening conditions for a political solution to the conflict based on two capitals in Jerusalem.”
Ir Amim explains essential context:
“the plan will enable an ideologically driven settler outpost in the heart of Beit Hanina, a neighborhood located on the northern perimeter of East Jerusalem that has remained relatively untouched by Israeli settlement within its limits. Since the land in question is not far from Ramat Shlomo to the south-west and Pisgat Zeev to the north-east of it, its construction may mark the beginning of a far sweeping move to create contiguity between the two settlements, while driving a wedge between Bet Hanina and Shuafat.”
Plans Advance in East Jerusalem, Part 2: Reports on Har Homa & Rumors on Givat Hamatos
On January 7th, the popular Isareli broadcaster network Kan reported that the Prime Minister’s office has blocked a plan to build 2,000 new settlement units in the settlement of Har Homa, citing “diplomatic difficulties.” In response to an inquiry, the office did not deny the report, but issued the following statement:
“Israel has built in Jerusalem, is building in Jerusalem and will continue building in Jerusalem — while exercising judgment.”
Jerusalem expert Daniel Seidemann raised a key question and larger concerns about the reports concerning Har Homa, saying:
“The construction potential at Har Homa has been exhausted, and it’s not possible to build anything near 2,000 units. So what are they talking about? Something is clearly going on. Three possibilities come to mind, all problematic…Possibility no. 1: the nearby planned doomsday settlement of Givat Hamatos, which is awaiting tenders. Possibility no. 2: Hirbet Mazmoriyya, to the northeast of Har Homa. The lands owned by Palestinians that will have to be expropriated. Not likely. Too complicated and controversial. Possibility no. 3: the area wedged betw. Mar Elias Monastery, the Hebron Road, the 300 Checkpoint, dubbed Bethlehem Gate or Har Homa West. The land is ownership is a mixture of Palestinian &Church lands, along with settlement developers.”
Ir Amim notes that, while reportedly stalling the Har Homa plan, Netanyahu is – in fact – simultaneously facing mounting pressure to issue tenders for the construction of the Givat Hamatos settlement, the site for which is the northern border of Har Homa. Ir Amim writes:
“Last week, rightwing groups launched a coordinated campaign to exert pressure on Prime Minister Netanyahu to advance construction in the area of Givat Hamatos, which has been essentially frozen for the past six years. While the approval of the plan for 2,610 housing units in the area was formally published in 2014, there has been no announcement of tenders since then. This has been largely attributed to international opposition, namely from the United States and Germany. Likely attempting to ratchet up pressure on Netanyahu in lead-up to the upcoming elections in March, the campaign has been spearheaded on a public level by rightwing organizations. Several prominent rabbis known for supporting the settler movement penned a letter to the Prime Minister calling on him to announce the tenders for Givat Hamatos, while rightwing media outlets have published daily articles demanding an ‘end to the freeze.’ A rightwing institute likewise published a lengthy paper on the significance of establishing a new settlement in the area as a means of thwarting any potential future division of Jerusalem within the framework of a resumed peace process.”
Plan Advance in East Jerusalem, Part 3: Israel Approves Plans for Two More Settler-Run Tourist Sites in East Jerusalem
On December 25, 2019 the Jerusalem Local Planning approved two significant settler-backed schemes in East Jerusalem:
- The committee approved the Israeli government’s plan to seize land in the Palestinian East Jerusalem neighborhood of Sheikh Jarrah, in order to establish a park adjacent to the infamous Shepherd Hotel, an historic/iconic building that was taken over by the radical Ateret Chohanim settler organization in 2011. The new park – called “Hakidron Park” has been discussed and considered by Israeli governments for the past 15 years.
- The committee also approved the Israeli government’s plan to confiscate land in the Ras al-Amud neighborhood of East Jerusalem, for the purpose of opening a tourist and religious services center on the Mount of Olives, adjacent to the Jewish cemetery. The Jerusalem Municipality hired an architect, Arie Rahamivov, who is also employed by the radical Elad settler group for the planning and construction of their crown jewel: the Kedem Center in Silwan. The new center in Ras al Amud will be yet another tourist center under the management of Elad, which already operates another visitors center on the Mount of Olives.
Ir Amim writes:
“Approval of the aforementioned land expropriations would signal intent to begin construction at both sites and will help to further solidify the settlement ring around the Old City Basin. While both plans can be posited as innocuous municipal initiatives to serve local residents and visitors to the areas, such touristic projects play an integral role in expanding the scope of settlement strongholds in the area and creating a more contiguous Israeli space, while diffusing the political agenda behind these efforts.”
Plans Advance in East Jerusalem, Part 4: Tenders for Pisgat Zeev and Gilo
Ir Amim reports that the Israel Lands Authority published construction tenders for the following East Jerusalem settlements in early January:
- 3 tenders for a total of 461 new settlement units in the Pisgat Zeev
- 1 tender for commercial buildings in the Gilo settlement, located
For Second Time, Israeli Court Rules Against Settler Claim to Bakri House in Hebron
On December 23rd, the Jerusalem District Court ruled that the Palestinian Bakri family are the rightful owners of a disputed property in Hebron. This ruling should deal a final blow to the 18-year long legal battle settlers have waged to gain control of the Bakri family house (“should”, not “will”, because the settlers have repeated been dealt defeats in court and each time are able to manufacture a new claim or appeal) .
The ruling – which affirmed a March 2019 ruling by the Magistrate court, which the settlers had appealed – called for the immediate evacuation of the settlers whom Israel has permitted to illegally squat in the house while the legal processes were ongoing. Following the ruling, Peace Now said:
“[the] court again ruled that the settlers had forged [documents] and lied all along… We hope that after [almost] two decades of violence, lies and terror, justice will be carried out and the invaders will be evicted.”
Peace Now Wins Interim Decision Against Secretive Public Funding to Amana
In response to a Peace Now petition, on December 31st the Israeli High Court issued an interim decision that requires state bodies to request approval from the court before transferring funds to Amana, a settlement body which is known to undertake illegal settlement activities across the West Bank. Peace Now filed the petition after discovering that state bodies have been secretly funneling money to Amana.
Peace Now said in a statement:
“Amana is the most significant organization operating in the settlements. For decades, it has overseen the establishment of dozens of illegal outposts and neighborhoods with the help of massive budgets, some of which have been transferred from Israeli taxpayer money through local settlement authorities in violation of the law. The judges’ decision is a dramatic yet necessary step that limits, for the time being, this illicit transfer of funds to illegal projects in the settlements and outposts. We hope that in this spirit, the court will rule that public funds should no longer be transferred to Amana via subsidy procedures. This situation in which the State of Israel backs illegal activities with public funds is unconscionable, and we urge the Israeli government to put an end to it.”
Israeli Court Dismisses Palestinian Landowners’ Petition Against the Ofra Settlement
On January 6th, the Israeli High Court of Justice dismissed a petition filed by Palestinian landowners challenging the legality of the Ofra settlement. The petition was based on the fact that the settlement is partially built on privately owned Palestinian land. The court ruled that the majority of the settlement had been built on land expropriated by Israel, and that the minority of land that Palestinians claim ownership over was not enough to invalidate the entire Master Plan for the settlement. Further, the court stated that the settlement structures built on the privately owned Palestinian land were built by settlers “in good faith,” under the mistaken belief that land had also been expropriated by the Israeli government.

This High Court ruling does not fix the legal status of Ofra settlement buildings, but it is nonetheless significant because it continues to deny Palestinians their property rights. Likewise, it gives a green light to the use of the “market regulation” principle to expropriate land in order to retroactively legalize the structures. As a reminder, the “market regulation” principle – which was invented by the Israeli Attorney General – holds that if settlers acted “in good faith” when they built on privately owned Palestinian land, the state can expropriate that land, thereby making what was illegal before, now perfectly legal.
The Ofra settlement’s legal situation has long been an issue that the Israeli government has tried to fix. Ofra was first established by settlers on land that the Jordanian government had expropriated in 1966, in order to build a military base (which was never built). The Israeli government used this pretext to expropriate the land in 1977, in order to recognize the Ofra settlement, which had been established illegally but with tacit cooperation of the government on the site two years earlier. However, the settlers built the majority of the Ofra settlement on land that was not expropriated by Israel in 1977 — land that was in fact registered to Palestinians from the nearby village of Ein Yabroud. In light of the legal status of the land, no Israeli government has since found a way to fix the legal status of these homes (not for lack of trying) – meaning that the majority of the structures in Ofra were built without permits, making them illegal under Israeli law.
Peace Now elaborates on what is at stake in the Ofra settlement case:
“Most of the houses built in Ofra (approximately 413 out of 625) were built on an area of 550 dunams of privately owned Palestinian land. In addition, hundreds of dunams of Palestinian private land were seized for roads in Ofra, as well as infrastructure and agricultural lands for the settlers. The only way to regulate the theft of these lands would be to expropriate them from the Palestinian landowners for the benefit of the settlers, in complete contradiction to the positions of previous Israeli governments and legal advisors, and contrary to binding rulings of the High Court. Although the current legal advisor (Avichai Mandelblit) allowed land expropriation in some places for settlement purposes (for example, in Haresha), in the regulation of massive land theft such as in Ofra the Israeli government would be crossing a new red line.”

Bennett Launches Initiative to More Aggressively Demolish Palestinian Construction in Area C
Making the most of his appointment as Israeli Defense Minister in the current caretaker government, Naftali Bennett is pushing an initiative to annex Area C and to aggressively demolish Palestinian construction in the area (reminder: Area C constitutes nearly 60% of the West Bank; it is land that under Oslo II was supposed to have been “gradually transferred to Palestinian jurisdiction”).
As part of his efforts, Bennett has launched legal research into how Israeli can bring settlement building in Area C under the direct authority of the Justice Ministry, cutting out the Civil Administration. This Civil Administration, it should be recalled, is the arm of the Israeli Defense Ministry which acts as the sovereign power over the West Bank, in a system of governance Israel created based on its recognition of the different legal status of the area. Bennett has called for that system to be disbanded (in addition to annexing Area C). To be clear: transferring the construction and planning processes in Area C to domestic Israeli jurisdiction would by any definition constitute the Israeli state extending its sovereignty over area — an act of annexation.
Bennett has requested that Defense Ministry officials present several legal options for how Israel can bring planning processes under the Justice Ministry (integrating the settlements into the normal planning process). The settler-run Arutz Sheva outlet attributes the following quote Bennett in a private meeting:
“We are in essence discussing applying procedural sovereignty only. Full sovereignty is under the authority of the political echelon, but this is a step in the right direction. There is no reason that residents of Judea and Samaria should continue being discriminated against. We must stop this. Residents of Beit El and Ariel are no less Zionist than residents of Kfar Saba and Tel Aviv. They pay taxes and serve in the army, and they need to receive the same services from the government.”
Bennett is also advancing several initiatives that will empower and compel the Civil Administration to more aggressively enforce demolition orders against Palestinian construction in Area C (based on Israel’s policy of not granting permits to Palestinians in Area C, nearly every Palestinian structure in this territory has a demolition order pending against it). Bennett is also eyeing ways to combat what he considers illegitimate and nefarious funding from the European Union to Palestinian communities living in Area C. Israel Hayom reports:
“Bennett’s plan to stop the Palestinians from chipping away at Area C demands action in four areas: Operational, economic, legal, and PR. He wants to change enforcement priorities to put an emphasis on eradicating illegal buildings in strategic locations rather than by numbers. For example, home demolitions would be carried out in accordance with Israeli interests, prioritizing illegal buildings next to roads or settlements. Bennett also instructed the Central Command and the Civil Administration to work more closely to implement his plan and asked that the Civil Administration report to him monthly to update him on progress. Meanwhile, the defense minister is weighing the possibility of allocating more resources to the Civil Administration for enforcement, which would entail hiring more personnel. Bennett also wants to take steps to stop the flow of European money that funds the illegal Palestinian construction in the first place, allowing the “Fayyad Plan” to flourish.”
Bennett Appoints Key Settler Ally to Lead New Government Task Force on Area C Annexation Plans, Immediately Announces Plan to Legalize Settlements
In addition to his new initiative targeting Palestinian construction in Area C, Israeli Defense Minister Naftali Bennett announced that he has created an inter-ministerial taskforce to develop settlement and annexation plans for the future of Area C in the West Bank.
Bennett’s chief of staff, Itay Hershkowitz, has been in weeks-long consultations with key settler leaders to decide what items to act on immediately. Haaretz reports their agenda includes:
- Allowing Jews to privately purchase land in the West Bank. [See here for a detailed explanation of this complicated matter]
- Connecting unauthorized outposts to water and electricity.
- Granting official recognition to unauthorized outposts that are located near established settlements by recognizing them as “neighborhoods” of the settlement.
- Repealing a military order that empowers the Civil Administration to evict settlers from privately owned Palestinian land with or without a Palestinian-initiated petition to have the settlers removed.
- Legalizing 30 sheep farms in the West Bank that are under pending demolition orders.
On Thursday, Bennett announced that he has appointed West Bank settler Koby Eliraz to lead the new taskforce. Calling Eliraz a “bulldozer,”Bennett said:
“The territorial future of the Land of Israel is at stake. The State of Israel has simply not been up to the task of stopping [Palestinian construction]. We are changing direction and embarking on a battle that Israel must win… The defense establishment will fight for this territory, and it is essential for someone to lead this campaign.”
Eliraz previously served as Netanyahu’s settlement advisor, but was fired by the Prime Minister in June 2019 reportedly because he was believed to be allied too closely to Netanyahu rival Avigdor Liberman, who Netanyahu also dismissed. At the time of Eliraz’s firing, settler leaders were outraged and published a letter asking Netanyahu to reverse Eliraz’s firing, suggesting that Eliraz’s absence will hinder government efforts to retroactively legalize outposts. The letter noted:
“Kobi has taken care of Israeli settlement and its residents with great professionalism. He is credited for many advancements [on our behalf] in the fields of construction, infrastructure development, security and more.”
The Times of Israel observed, significantly, that the Yesha Council was able to get every single settlement Mayor to sign the letter in support of Eliraz, explaining:
“The Yesha Council in recent years has struggled to get all of its members on board with its initiative, but the umbrella group’s ability to gather the signatures of every Israeli mayor beyond the Green Line is testament to the broad respect that Eliraz holds among settler leader.”
Following ICC Announcement, Pompeo Says Israel Has “Fundamental Rights” to Land
At a press briefing on December 22nd, U.S. Secretary of State Mike Pompeo did not specifically address the ICC announcement, but made lengthy comments regarding statements from European countries and the European Union that were critical of the new U.S. position on settlements (that they are not “per se illegal” under international law). Pompeo’s comments hold relevance to the U.S. position on the ICC case and more generally on the U.S. approach to the Israeli-Palestinian conflict:
“First, the legal analysis that the EU performed [on settlements] we just think is wrong. We think they have an improper analysis of the international law surrounding this. So as the technical legal matter, [EU Foreign Minister] Ms. Mogherini just – she’s just wrong. And so we are doing our level best to demonstrate to them our legal theory, our understandings, and why it is that we’re convinced that under international law these settlements are not per se illegal. So we’re working that element of it as well. But at another level, and perhaps at the level that will lead to the right outcome, which is why we did this, this has to be resolved through political means, and we hope that all nations, including member nations inside of the EU and the EU itself and countries all over the world, will come to recognize the fundamental rights that the Israeli people have to this land, to this space. There are real security needs. The risk that is presented from the world as anti-Semitism is on the rise, we hope that every nation will recognize that and weigh in on this conflict in a way that is constructive, that will ultimately lead to the peace that is so desperately needed.” [Emphasis added by editor]
Pro-Settlement Legal Forum Conference Draws Big Names, Big Promises
The Kohelet Policy Forum, a right-wing advocacy organization that has enormous influence with senior Israeli – and increasingly American – government figures, hosted a “Conference on the Pompeo Doctrine” in Jerusalem, Jan. 7-8, 2020. The conference served as a gleeful celebration and forward-looking projection of what the new U.S. settlement policy towards settlements means for Israel. The conference drew participation from all the leading Israeli politicians and several senior members of the Trump Administration, including Secretary of State. Pompeo. Key quotes from the conference speakers are copied below.
U.S. Secretary of State Mike Pompeo:
“We’re recognizing that these settlements don’t inherently violate international law. That is important. We’re disavowing the deeply flawed 1978 Hansell memo, and we’re returning to a balanced and sober Reagan-era approach. “In doing so, we’re advancing the cause of peace between Israelis and Palestinians.”
U.S. Ambassador David Friedman:
“…when we came into office the lingering issues included three of significant importance: the status of 1) Jerusalem, 2) the Golan Heights and 3) Judea and Samaria. We have approached them in ascending order of complexity…I thank God that President Trump had the courage and the wisdom to recognize Jerusalem as the capital of Israel and move our embassy to Jerusalem from Tel Aviv…In recognizing Israel’s sovereignty over the Golan Heights, President Trump, evaluating the continuous malign and barbarous threats posed by Syria, concluded that no northern boundary for Israel would be secure except a boundary that incorporated the Golan. He acted well within the language of 242. [Judea and Samaria] is certainly the most complicated of the issues because of the large indigenous Palestinian population. Over the years before we came into office, it’s only gotten more complicated and more challenging. The proverbial goalposts have moved and moved – to the point today where they are no longer even on the field….The Pompeo Doctrine does not resolve the conflict over Judea and Samaria. But it does move the goalposts back onto the field. It does not obfuscate the very real issue that 2 million or more Palestinians reside in Judea and Samaria, and we all wish that they live in dignity, in peace, and with independence, pride and opportunity. We are committed to find a way to make that happen. The Pompeo Doctrine says clearly that Israelis have a right to live in Judea and Samaria. But it doesn’t say that Palestinians don’t….it calls for a practical negotiated resolution of the conflict that improves lives on both sides.”
Israeli Prime Minister Netanyahu said:
“I will not let any settlements be uprooted in any diplomatic plan. This idea of ethnic cleansing… it won’t happen. There is a window of opportunity. It opened, but it could close…There was no West Bank separate from the rest of the land. It was seen as the heart of the land. We never lost our right to live in Judea and Samaria. The only thing we lost temporarily was the ability to exercise the right. When Israel returned to the West Bank We didn’t return to a foreign land. That is a distortion of history. Jews lived in Jerusalem and Hebron for thousands of years consecutively…The Pompeo declaration about the status of the towns [in Judea and Samaria] establishes the truth that we are not strangers in our land. In a clearly defensive war, we returned… to the land where our forefathers put down roots thousands of years ago…Unlike some in Europe who think the Pompeo declaration distances peace, I think it will promote peace, because peace must be based on truth, not lies. Settlements are not the root of the conflict. We are standing with justice and the truth. It is a great struggle.”
Israeli Defense Minister Naftali Bennett on Area C annexation and his initiatives in that regard:
“Our aim is that within a decade a million Israeli citizens will live in Judea and Samaria” and later “Our objective is that within a short amount of time, and we will work for it, we will apply [Israeli] sovereignty to all of Area C, not just the settlements, not just this bloc or another. We are embarking on a real and immediate battle for the future of the Land of Israel and the future of Area C. It started a month ago and I am announcing it here today. A month ago, I convened a meeting and I explained the clear directive, the State of Israel will do everything to ensure that these territories [Area C] will be part of the State of Israel.”
Likud MK and former Mayor of Jerusalem Nir Barkat said:
“I am confident that Secretary Pompeo’s statement is an integral part of the American plan and is closely linked to Jared Kushner’s proposal advanced in Bahrain promoting significant economic investment in the Palestinian economy…Now is a perfect opportunity to similarly grow the communities throughout Judea and Samaria at a pace like never before. This declaration is a recognition of the legal and historic right of the Jewish people to live wherever we wish. This is how it should be in other parts of the world and certainly here in the Jewish State. This declaration is therefore an exceptional opportunity for Israel to ensure our continued growth and expansion throughout these areas. Israel needs to set a goal for the settlement of two million people in Judea and Samaria within fifty years. This is a commitment which requires that we already now lay the framework to make that possible and this is an investment which will also benefit the Palestinian people” [Editor’s note: Barkat has been working with Harvard Professor Michael Porter to promote an economic peace scheme, most recently speaking at Harvard about the plan in December 2019]
Eugene Kontorovich, Director of International Law at the Jerusalem-based Kohelet Policy Forum and a key shaper of anti-BDS/pro-settlement legislation in U.S. Congress and across state governments, said:
“American Policy is now clearer than ever, Jews living in Judea and Samaria is not a crime. For decades, the obscure Carter-era memo was used as justification for anti-Israel policies despite the fact that its conclusions were rejected by subsequent administrations. Sec. Pompeo’s statement at the Kohelet conference today makes clear the U.S.’s wholesale rejection of the legal theory that holds that international law restricts Israeli Jews from moving into areas from which Jordan had ethnically cleansed them in 1949.”

Israel Advances Plans for 2,342 New Settlement Units
With little attention, on October 10th the High Planning Council – a body within the Israeli Defense Ministry’s Civil Administration, responsible for regulating all construction in the West Bank – advanced plans for 2,342 new settlement units, as well as for two additional settlement projects. Of that total, 719 units were approved for validation (the penultimate step in the planning process), and 1,623 settlement units were approved for deposit for public review (an earlier but decisive stage in the planning process).
The 719 units which received final approved for validation comprise:
- 207 units in the Bracha (aka Har Bracha) settlement, located south of Nablus. In September 2019, the Israeli Central Command signed an order that expanded the settlment’s jurisdiction, a move which paved the way for the approval of these new units (see our September 2019 report). According to Peace Now, this plan – if implemented – will significantly expand both settlement’s population and its physical footprint.
- 206 units in the Tzofim settlement, located north of the Palestinian town of Qalqilya – a town completely encircled by Israel’s seperation barrier (except for a single road connecting it to the rest of the West Bank) – in the northern West Bank.
- 166 units in the Alei Zahav settlement, located in a string of settlements stretching across the northern West Bank. Alei Zahav and its settlement neighbors create a contiguous Israeli populated areas linking Israel proper (west of the Green Line) all the way to the Ariel settlement, located in the heart of the West Bank (the eastern end of Ariel is closer to the Jordan border than to the Green Line). Notably, Alei Zahav is one of the settlements in which the “market principle” has been applied to legalize settlers theft of land recognized by Israel as belonging to Palestinians (see our July 2019 report).
- 140 units in the Mezadot Yehuda settlement, located at the very southern tip of the West Bank, just south of the Palestinian village of Susya, which the Israeli government has been threatening to demolish for years. This plan would nearly double the number of authorized units in the settlement.
Also receiving final approval for validation:
- A plan to retroactively legalize the illegal Brosh outpost in the Jordan Valley. According to Peace Now, the Brosh settlement serves as an educational institution that houses hundreds of students and families of staff members.
- A plan to build a tourist/visitors center in the Shilo settlement – where settlers and the Israeli government have been investing in developing tourism sites for Jewish and evangelical tourists.
The 1,623 units which were deposited for public review include:
- 609 units in the Beitar Illit settlement, located west of Bethlehem, near the Green Line. Beitar Illit is a massive, fast-growing ultra-Orthodox settlement.
- 382 housing units in the Dolev settlement, located west of Ramallah. This is a significant plan for Dolev, as it will more than double the number of existing units. Prime Minister Netanyahu previously promised to build 300 new units in Dolev in response to a Palestinian-perpetrated bombing at a spring (which settlers had taken over from Palestinians) near the settlement that killed a 17-year old Israeli and injured several others.
- 182 units in the Mevo’ot Yericho settlement, located north of Jericho in the Jordan Valley. The validation of this plan is the actualization of the Israeli security cabinet decision to grant the illegal outpost of Mevo’ot Yericho retroactive legalization, an action for which the security cabinet urgently convened on the eve of the September 19th elections. The plan approved by the High Planning Council on Oct. 10th granted legalization to the existing 20 existing units and, if implemented, will allow the settlement to significantly expand.
- 146 units in the Kfar Etzion settlement, located southwest of Bethlehem.
- 140 units in the Kerem Reim outpost located north west of Ramallah. Peace Now has repeatedly challenged the illegal construction of the Kerem Reim outpost, which the Israeli government retroactively legalized by declaring it a neighborhood of the Talmon settlement even though the areas are non-contiguous. Though a court rejected one Peace Now petition, there is an ongoing case against the Amana settler organization which Peace Now alleges engaged in illegal activities to build the outpost.
- 100 units in the Nokdim settlement, located southeast of Bethlehem. Former Israeli Defense Minister Avigdor Liberman – currently one of the most important figures in the race to form a governing coalition – lives in Nokdim.
- 64 units in the Telem settlement, located west of Hebron.
- A plan to build new shops and services in the Kochav Yakov settlement, located between Jerusalem and Ramallah.
Peace Now said in a statement:
“The figures speak for themselves. Netanyahu continues to sabotage the possibility of a political agreement with the Palestinians by promoting more settlement construction in the West Bank, including in places where Israel may have to evacuate as part of a future agreement. This is yet another dangerous step for both Israel and the Palestinians, led by a transitional prime minister whom the public did not trust in his policies. The next government must put a freeze on the development of settlements and to strive for immediate resumption of negotiations with the Palestinians without preconditions and to end the bloody conflict based on the principle of two states for two peoples.”
The European Union issued a statement criticizing the approvals, saying:
“The European Union’s position on Israeli settlement policy in the occupied Palestinian territory is clear and remains unchanged: all settlement activity is illegal under international law and it erodes the viability of the two-state solution and the prospects for a lasting peace, as reaffirmed by UN Security Council Resolution 2334. Israeli authorities also approved a building permit for the construction of a new tunnel road, which bypasses Bethlehem to the west. The progressive construction of a separate road network, connecting settlements and outposts to each other and to the road network in Israel while circumventing Palestinian towns and communities, is entrenching the fragmentation of the West Bank. The EU calls on Israel to end all settlement activity, in line with its obligations as an occupying power. The EU will continue to support a resumption of a meaningful process towards a negotiated two-state solution, the only realistic and viable way to fulfil the legitimate aspirations of both parties.”
Israeli Government Approves Settler-Initiated Plans for Cable Car in Jerusalem — Despite Professional, Human Rights Objections
On November 4th, the Israeli Housing Cabinet approved a settler-initiated plans to build a cable car line in East Jerusalem, despite the fact that the Israeli Attorney General has not yet rendered a decision on whether plans for such a significant and sensitive project can be advanced by a caretaker Israeli government. Emek Shaveh – an Israeli NGO fighting the politicization of archeology in Jerusalem – announced that it intends to appeal the approval to the Israeli Supreme Court.
As FMEP has repeatedly covered, this Jerusalem cable car project is an initiative of the Elad settler organization (which is building a massive tourism center – the Kedem Center – in the Silwan neighborhood, which will be a stop along the cable car’s route). The scheme is intended to further entrench settler control, via archeology and tourism sites, inside the Silwan neighborhood of East Jerusalem, while simultaneously delegitimizing, dispossessing, and erasing the Palestinian presence there. Non-governmental organizations like Emek Shaveh, Who Profits, and Terrestrial Jerusalem have repeatedly discredited the government’s contention that the cable car serves a legitimate transportation need in Jerusalem, and have clearly enumerated the obvious political drivers behind the plan, the archeological heresies it validates, and the severe impacts the cable car project will have on Palestinian residents of Silwan.
Ir Amim field researcher Aviv Tartarsky told Middle East Eye:
‘The project is a way to whitewash Israel’s taking of areas in Silwan to use for archaeological and touristic reasons…If someone wants to go to the Western Wall of the Old City, they have to go through the ELAD activity centre. This project will give ELAD legitimacy and influence, as it is taking part in a governmental project. This is the political reason for why the government is doing this project,’ Tatarsky said.”
Israel Plans to Build a New Waste Treatment Plant (to serve Israelis) in the West Bank
In October 2019 the Israeli government issued a construction tender to build a waste-to-energy plant in the West Bank, on an area of land that is within the jurisdiction of the Ma’ale Adumim settlement where several Palestinian Bedouin communities live. The plant – which is expected to cost USD $284 million (1 billion NIS) – will treat Israeli-generated waste.
B’Tselem – which previously published a comprehensive report criticizing the illegal Israeli practice of exporting its waste to the occupied territories – writes:
“For many years, Israel has been taking advantage of its power as occupier to transfer the treatment of waste (including hazardous waste) and sewage from its sovereign territory to the West Bank. To that end, it has created a situation in which environmental legislation in the West Bank is much laxer than inside Israel, conveniently overlooking the long-term impact of environmental hazards on the Palestinian population and on natural resources, and neglecting to prepare future rehabilitation plans. This has created a financial incentive to transfer the treatment of environmental hazards from Israel to the West Bank. The Palestinians who live in the occupied territory are the ones to pay the price for this environmental damage, even though they were never asked their opinion on the matter and although, as a population under occupation, they have no political power and no real ability to resist.”
B’Tselem also takes aim at the European Union (EU), which has invested millions in the implementation of the Isareli Ministry of Environmental Protection’s 2030 strategic plan, of which the waste-to-energy treatment plant is a part. B’Tselem writes:
“In 2019, Israel and the EU signed an agreement as part of the EU’s twinning instrument, which establishes cooperation with the EU’s neighboring countries, guaranteeing Israel approximately 1.5 million euros over the next two years to support the Ministry of Environmental Protection’s implementation of its 2030 strategic plan. In the agreement, Israel committed to creating a legal framework that adopts European practices and standardization for sustainable waste treatment. As in every agreement between the EU and Israel, it contains a territorial clause that stipulates that it will not apply beyond Israel’s 1967 borders. Yet the EU’s support for the ministry’s strategic plan – which defines the establishment of the plant at Ma’ale Adumim as a goal and presents the exploitation of West Bank land to resolve environmental problems as a matter of course – empties this annex of meaning. By supporting this plan, the EU will be supplying Israel with knowledge and experience that will help deepen its exploitation of Palestinian land resources and bolster the economic status of the Ma’ale Adumim settlement.”
No More Waiting: MKs Introduce Annexation Bills Despite Political Deadlock
Israeli political figures appear to be done waiting for a new government to be formed before acting on the loud signals from the Trump Administration supporting Israeli annexation of West Bank land.
On November 4th, Yamina party leader Ayelet Shaked filed a bill with the Knesset to unilaterally annex the Jordan Valley, the Ma’ale Adumim settlement just east of Jerusalem, and all 22 settlements and 75,000 Israeli settlers in what is broadly termed the Etzion “settlement bloc” located south of Bethlehem. Shaked’s bill calls for Israel to “apply sovereignty” to these settlements, which in practice would constitute the annexation of the settlements. Applying Israel law to areas outside of Israel’s sovereign borders is de facto annexation, as FMEP has explained and documented.
Shaked urged expeditious consideration of the bill, saying:
“There is a diplomatic window of opportunity and willingness on the part of the US for this kind of annexation that will not return. We cannot afford to hesitate or wait. We must take advantage of this window of opportunity immediately and begin to apply sovereignty over these areas. It is for this reason that the State of Israel cannot be dragged into another election cycle.”
On November 3rd, Likud MK Sharren Haskel submitted a draft bill for the annexation of the Jordan Valley, a bill she has introduced previously without success. Haskel said:
“It’s time to make the residents of the Jordan Valley legal Israeli citizens, thus kick-starting the development and prosperity of the region.The communities of the Jordan Valley and their residents are a strategic resource of the highest order for Israel. There is a wide consensus today about the region, following the long-awaited U.S. president’s recognition of the Golan Heights as under Israeli sovereignty. It is time to do the same with the Jordan Valley. After Blue and White leader Benny Gantz proposed to do the same, I call upon him and my fellow party members to support my proposal.”
In March 2019, ahead of the first round of Israeli elections this year, leaked reports suggested that U.S. diplomats were engaged in discussions with Israel about the latter’s intention to annex several “settlement blocs” – even more so-called blocs than called for by Shaked’s latest plan – following the elections. The reports were not corroborated by U.S. sources, but in the intervening time U.S. Ambassador to Israel David Friedman has made repeated statements to the press (in addition to speculative reporting about a forthcoming U.S. political plan) in support of Israel’s right to annex territory in the West Bank – cues the Israeli government has enthusiastically welcomed. In the lead-up to the September elections, Netanyahu vowed to annex the Jordan Valley should he be reelected, a plan endorsed by his rival Benny Gantz and supported by then-U.S. National Security Advisor John Bolton.
As a reminder, over the years there has been no shortage of attempts to normalize the idea that Israel will retain “settlement blocs” in any negotiated peace agreement — logic that originally applied narrowly to the Etzion bloc (defined on much less expansive terms), Maale Adumim, and, in the eyes of some, Ariel. The terminology has been exploited for decades by the Israeli government to convey legitimacy to building in the so-called “blocs.” Over the years the definition of what is a “bloc” has been twisted to include a much larger idea of the Etzion bloc, as well as the entire Jordan Valley. The implied idea regarding what the blocs are and the fact that they are inarguably Israel’s to keep, is incredibly misleading. The term “settlement blocs” has no formal definition or legal standing, and the future of the blocs – no matter how they are defined – is indisputably a matter at the heart of what will one day be negotiations aimed at a two-state solution (if there is ever to be such a solution). (NOTE: A Haaretz investigation last year estimated that a total of 380,000 Israeli settlers live in the West Bank, of which 170,000 live outside of the so-called blocs, as defined by Haaretz).
Annexation-via-New Roads (the new Smotrich Plan)
On November 1st, Israeli Minister of Transportation Bezalel Smotrich unveiled a new government plan to advance Israeli “sovereignty through transportation.” The plan calls for massive investment (USD $283 million) in new/expanded roads and rails lines, for the express purpose of more seamlessly integrating Israeli settlements into Israel proper. Smotrich made clear that his ultimate goal is the complete integration of the West Bank into the national planning mechanisms of Israel proper. The move will erase the government’s current distinction between transportation projects in the West Bank (across the Green Line) and Israel proper [fun note: the Israeli Ministry of Foreign Affairs has an official map posted on its website entitled, “Transportation and Built-Up Areas” that includes the entire West Bank as part of Israel).
Touting the significance of his plan, Smotrich said:
“I do not give preference to Judea and Samaria [the West Bank] but also am not willing to continue the discrimination. These areas will receive treatment just like anywhere else in Israel. While it is only about roads and trains, it has political significance.”
Smotrich created a new bureau for “Judea and Samaria Planning” within the Transportation Ministry to oversee the implementation of this project, and more generally ensure that the ministry is geared towards serving the settlements as a matter of normal business. The institutionalization of such bureaucratic structures within the Israeli government is a significant, and often overlooked, mechanism by which the Israeli government has been engaging in annexation for years. The new bureau – much like parallel structures former Minister Ayelet Shaked set up in the Justice Ministry – is a formal and public statement that the Israeli government is pursuing (and allocating resources to) annexing the settlements.
It should be noted that Israel has used infrastructure projects in the West Bank to advance its settlement agenda, and to further fragment Palestinian life – two completementary goals powerfully explained by B’Tselem in a recently released interactive: “Conquer and Divide: The Shattering of Palestinian Space by Israel.”

Annexation-via-Movies (Govt-Funded Settlement Hasbara)
On November 6th, Israeli Cultural & Sports Minister Miri Regev announced new government funding for film projects initiated by Israeli settlers. According to the guidelines, the new funding will support Israeli citizens living in West Bank settlements who want to make documentaries and films.It is widely understood that the goal is to encourage the creation of more pro-settlement propaganda.
Celebrating her new initiative, Regev essentially admitted that annexation was her motive, saying:
“I made a promise and I am keeping my promise! We are making history today. The Culture and Sports Ministry will support the regional production of films in the north, and for the first time in Judea and Samaria too, and in the hope that in the near future also in the south… The wheels of cultural justice, which bring to expression the range of voices in Israeli society, have worked quickly and now another stage in correcting the cultural map in Israel has been completed. The artists from the periphery, the north and from Judea and Samaria, will become more and more in the center of things, not just on stage but also on the screens. Soon we will allow them to express their ability and talent.”
One critic of the fund, Israeli producer Liran Atzmor, nailed why the new fund is highly problematic and a tool of de facto annexation:
“Setting up a fund that supports filmmaking in the occupied territories with Israeli taxpayers’ money amounts to creeping annexation, which is happening in many areas, obviously, but is happening now more forcefully in the realm of culture, thanks to this fund. As long as the fate of those territories has not been determined, one cannot accept the fact that public funds are distributed there to people of only one color, one nationality and one religion.”
Shlomo Eldar writes:
“…And that is the whole point, to show life in the settlements in a positive light, as a Zionist enterprise glorifying the State of Israel. Head of the Samaria Regional Council Yossi Dagan described the fund as a ‘giant piece of good news. … I believe this move will bring the story of Judea and Samaria to the big screen. … I call on all artists to take part in this party, to come and film in Judea and Samaria and tell its story, so that we can present the public with other faces and other stories that have yet to be seen on the screen’.”
Libby Lenkinski, Vice President of the New Israel Fund, explained in a tweet:
“Creeping annexation and normalization of settlements is not just happening on the land, it’s also a narrative strategy that uses arts and culture funding to move forward. #StopAnnexation”
Annexation-Via-Education (Ambassador Friedman’s Favorite Medical School)
Despite delays and scandals, the sparkling new medical school at Ariel University has officially launched its first school year, with a ceremony attended by a who’s-who of settlement financiers and supporter rejoicing in the opening of the school and in the implications of its opening for the Greater Israel enterprise.
Dr. Miriam Adelson and her husband, Trump-backer/U.S. casino magnate Sheldon Adelson, were in attendance. The Adelsons donated $20 million to the medical school, which was named after Miriam. Addressing the crowd, Dr. Adelson said:
“In Israel, being Israel, we also had to withstand our tribulations. In Israel, being Israel, there were opponents who tried to block the establishment of a critical institution on ancient Jewish land and to deny us legitimacy. But we won, Zionism won, the truth won.”
U.S. Ambassador David Friedman recited the “shehecheyanu,” a prayer of gratitude to God, as part of his speech, also exclaiming:
“A new medical school has opened in Samaria. It’s worth saying that again: A new medical school has opened in Samaria! How many people ever thought those words would be spoken?…The United States Embassy enjoys warm relations with Ariel University, and we are inspired by its contributions to Israeli society and to the scientific world.” [NOTE: “Samaria” is a biblical name used mainly by settlers and their allies to refer to the northern part of the West Bank]
MK Naftali Bennet put an even finer point on the significance of opening a medical school in Ariel settlement, saying:
“No longer is there a Green Line. We are one [united] Israel and that is how it should be. We are going to serve everyone here.”
There are 70 Israeli students enrolled to attend the settlement university. Even though classes are set to begin, the medical school still does not have an approved budget for the 2020 school year.
As a reminder, the Ariel settlement is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to attach Ariel to Israel will cut the northern West Bank into pieces. Nonetheless, in February 2018, the Israeli Knesset passed a law extending the jurisdiction of the Israeli Council on Higher Education to universities in the settlements (beyond Israel’s sovereign borders) – an act of de facto annexation. The law was necessary to ensure that the Ariel settlement medical school (and its graduates) would be entitled to all the same rights, privileges, and certifications as schools and students in sovereign Israel. Settler Leaders Elect New Chairman of the Yesha Council
David Elhayani was narrowly elected to serve as the next Chairman of the powerful settler Yesha Council – an umbrella body representing all the settlement regional councils. Elhayani is a well known personality, having served for 10 years as the head of the Jordan Valley Regional Council (a quasi municipal body serving the needs and interests of settlements in the Jordan Valley).
The Times of Israel’s settlement correspondent Jacob Magid explains the relevant politics involved behind Elhayani’s narrow victory over Yigal Lahav, a younger, more radical voice:
“Elhayani and Lahav represented opposite sides of an intensifying rift between an older generation of settler leaders that is closely aligned with Prime Minister Benjamin Netanyahu and a younger group of council chairmen who believe in acting more aggressively on behalf of the movement, even if that means being at odds with right-wing governments that the Likud chief has led. Elhayani, from the old-timer’s camp, edged out Lahav 13-12 after the votes of 24 West Bank council chairman plus settler elder Zeev ‘Zambish’ Hever were counted.”
Elhayani addressed the dynamics of the old guard (of which he is a part) vs. new, more radical, guard ahead of the elections, saying:
“There’s a crisis of trust in the Yesha Council where many council chairmen don’t see the body as being capable of serving the needs of their residents. Many council chairmen don’t show up to Yesha meetings at all.”
Elhayani promised a more “aggressive” demeanor so that those the Council represents will see that they “finally have someone who will fight for them.” So, despite being what some settlers may consider the “mainstream,” i.e. less willing to aggressively challenge the perceived slow-walking of settlement expansion and annexation by the Israeli government, Elhayani is still best understood as an ideologue in his own right.
Ahead of the vote, Elhayani did offer strong criticism of what he sees to be the Isareli government’s discrimination against the settlements, saying that he will fight for better “quality of life”for the settlements – making infrastructure as a core part of his agenda:
“Our residents are sick of the poor infrastructure that has led to power outages, water shortages and traffic jams. It is the responsibility of settler leadership to provide adequate services. You cannot improve quality of life until you improve infrastructure. We still need to be aggressive in demanding infrastructure improvements in the meantime, in addition to preventing a Palestinian takeover of Area C so that there will be something to [annex] when the time comes.”
Israeli Official Calls on Evangelicals to Defend Settlements, Fight BDS, and Support “Economic Peace”
Speaking to an audience of leaders in the evangelical media world, a top Netanyahu aid asked the crowd to join Israeli government efforts to defend the legitimacy and permanence of the settlements, and coached the crowd on how to frame settlements in a way that advances their normalization.
This was the third annual “Christian Media Summit” hosted by the Israeli Government Press Office to develop the group into “ambassadors for Israel.” According to Haaretz, the 2019 event was attended by approximately 150 journalists, mostly from the United States, working for Christian media outlets from 30 different countries. Entitled, “Between Jerusalem and the Golan: International Recognition,” the event featured addresses by Benjamin Netanyahu and President Reuven Rivlin. U.S. Ambassador David Friedman attended as well.
Speaking to the group, Deputy Chief of Foreign Affairs Reuven Azar said:
“The return of Jews to Judea and Samaria is not a curse, it’s a blessing for all the residents of the area…Calling for their expulsion is a recipe for destruction and for chaos… Look what happened when we went out of Gaza. Our presence in Judea and Samaria [the West Bank], and in Jerusalem brings stability… because we bring security by fighting the bad guys…We must partner in embracing our brothers and sisters who live in Judea and Samaria, and fight against those who claim their presence is illegal, or try to dehumanize them through different means. Help us to fight boycotts, they are not just, and they hurt us and they hurt our neighbors even more. ‘The revival of the Jewish people in the land of Israel is a divine promise being fulfilled…It is a blessing for our people, our region, for the world. A force for good, a force for peace, prosperity and happiness’.”
Following his remarks, the Front for the Protection of Democracy – an Israeli NGO – filed a complaint with the Civil Service Commission seeking disciplinary action against Azar. The Prime Minister’s Office quickly came to Azar’s defense, saying: “Political adviser Reuven Azar expressed government policy.”
Azar repeatedly referred to settlements as “communities” – a term that erases the illegality of those “communities” under international law. This pro-settlement framing was recently endorsed by outgoing U.S. advisor Jason Greenblatt. Azar also touted the now familiar but Orwellian claim that settlements are an economic gift to the Palestinians, claiming that “communities [settlements] in Judea and Samaria [the West Bank] provide opportunities, and jobs…” Azar invited the audience to visit the Barkan industrial zone, stating: “The best paying jobs for Palestinians are in Barkan.”
As FMEP has previously explained, for decades Israel has used industrial zones as another tool to expand and deepen control over West Bank land and natural resources. Industrial zones perpetuate Israel’s economic exploitation of occupied territory (including the local workforce, land, and other natural resources), and that it is Orwellian to label such initiatives as “coexistence” programs, or to suggest that they offer the Palestinians benefits they should welcome. Importantly, jobs in industrial zones – often the only jobs available for Palestinians living under an Israeli occupation that prevents the development of any normal Palestinian economy – are widely viewed by Palestinians as a double-edged sword.

Israel Advances Plans for 2,191 New Settlement Units – Including Establishing 2 New Settlements & Laying Groundwork for 2 New Settlement Industrial Zones
During its final meetings of 2018 (held on December 26th and 27th), the Israeli Civil Administration High Planning Council advanced plans for a total of 2,191 new settlement units. Peace Now reports that 87% of the settlement plans advanced are located deep inside of the West Bank, far beyond any of the negotiated parameters for a border between Israel and a future Palestinian state.
The flood of settlement approvals includes plans that will effectively create two new settlements (by legalizing the unauthorized outposts of Ibei Hanachal and Gva’ot, detailed below) and establish two new settlement industrial zones (one near the Beitar Illit settlement and one near the Avnei Hefetz settlement). Another plan, for an educational campus and a gas station, will serve to connect the unauthorized outpost of Mitzpeh Danny to a nearby settlement (Ma’aleh Mikhmash) – paving the way towards the eventual legalization of that outpost, creating yet another new settlement.
Of that total, plans for 1,159 units were given final approval for construction – meaning building permits can be issued immediately. These include
- 220 new units in the Givat Ze’ev settlement;
- 180 new units in the Neveh Daniel settlement;
- 135 new units in the Tene settlement;
- 120 new units in the Karmei Tzur settlement;
- 129 new units in the Avnei Hefetz settlement (where plans to build a new, noncontiguous industrial zone nearby were also advanced – see below);
- 61 new units in the Tzofim settlement;
- 42 new units in the Alfei Menashe settlement;
- 55 new units in the Tomer settlement;
- 18 new units in the Adora settlement;
- 16 new units in the Metzad settlement;
- 1 new units in the Shilo settlement; and,
- 62 new units in the Ma’aleh Mikhmash settlement;

A plan to build an educational campus and a gas station between the Malakeh Mikhmash settlement and the unauthorized outpost of Mitzpeh Danny. Peace Now writes, “Although this is not a residential program, these buildings also qualify as the establishment of a new settlement complex in the West Bank. The plan covers 140 dunams and will create a permanent presence of hundreds of Israeli students and teachers…During the discussion it was noted that the Mateh Binyamin Regional Council is preparing a plan to regulate the outpost.”
- A plan to build a cemetary on an area of “state land” south of the Palestinian city of Qalqilya. The area used to be a closed firing zone, but that military designation was rescinded years back, and the site has since been the subject of settlement planning. Peace Now writes, “The planned cemetery is likely to be the first component on the road to the establishment of an industrial zone, which is also a type of settlement.”

A plan for 98 units in the unauthorized Ibei Hanachal outpost, which will turn the outpost as a “neighborhood” of the Maale Amos settlement. In reality, the outpost is not contiguous with the built-up area of the Maale Amos settlement, meaning that the implementation of this plan will, in effect, create a distinct new settlement.
- A plan for 61 new units in the unauthorized Gva’ot outpost, an outpost originally built in 1999 by the settlers as a “neighborhood” of the Alon Shvut settlement. The settlers built a yeshiva there, but abandoned it not long after. The new settlement plan is for a public building, likely an educational institute with housing.
- 82 new units in th Ofra settlement. FMEP reported on this plan in the Dec 14th edition of the Settlement Report, in conjunction with the litany of punitive settlement plans advanced by Israel in response to terror attacks. The area where the new units are slated to be built is land that was allegedly purchased by the settlers from its original Palestinian owners.
- Plans for two new settlement industrial zones, one near the Beitar Illit settlement and one near the Avnei Hefetz settlement. The latter industrial zone, called Bustani Hefetz, will cover a large area of land (some 730 dunams) and will not be not contiguous with any other settlement. Peace Now writes, “an industrial zone of this scope, which is cut off from any other settlement, in all actuality constitutes a new settlement.”
- 121 new units in the Yitzhar settlement, where the IDF has been trying to rein in the violence perpetrated by the “Hilltop Youth” settlers, who are based in Yitzhar.
- 152 new units in the Shavei Shomron settlement.
- 212 new units in the Har Bracha settlement.
- 94 new units in the Beit Haggai settlement.
- A plan to legalize 75 existing settlement units in the Shvut Rachel settlement, which Israel considers a “neighborhood” of the Shiloh settlement.
- 100 new units in the Halamish settlement.
Peace Now released a statement saying:
“In 2018, the government advanced thousands of housing units, including most which can be found in isolated settlements deep inside the West Bank that Israel will eventually have to evacuate. Those who build these places have no intention of achieving peace and a two-state solution. The latest announcement, which as an aside was cynically passed on Christmas while most Western governments are on holiday, shows that Netanyahu is willing to sacrifice Israeli interests in favor of an election gift to the settlers in an attempt to attract a few more votes from his right-wing flank.”
Top Palestinian negotiator, Saeb Erekat, released a statement saying:
“While the world is celebrating Christmas with its spirit of peace and joy, the Grinch ‘occupation’ decided to steal the Christmas spirit from the people of Palestine. As part of his early election campaign, the Israeli Prime Minister Benjamin Netanyahu has as well stolen more Palestinian land and resources for the benefit of Israel’s illegal colonial settlement expansion. Such illegal actions are a deliberate campaign to destroy the two-state solution and to prevent the establishment of an independent and sovereign State of Palestine with East Jerusalem as its capital.”
Tamar Zandberg, head of the Meretz Party, slammed the new announcements, and previous decisions taken by the government to retroactively legalize 60 outposts. Zandberg said:
“The Israeli government has become a settlement government. (MKs Bezalel) Smotrich, Moti Yogev, (Justice Minister) Shaked and (Education Minister) Bennett are its landlords. They exploit the (Palestinian) attacks to build more settlements. But the truth needs to be said. To achieve security we need to evacuate settlements, not build more and more…”The 60 new settlements are the real threat to Israel’s security and to IDF soldiers. The pogroms they are waging in Palestinian villages. The stone-throwing, the shooting and the uprooting of the trees. This is the danger to our moral image and our security! They eight seats of Habayit Hayehudi party dictate eight million lives.”
Based on New Legal Tools to Take Palestinian Land, Israel Announces Intention to Build A New Settlement (“Givat Eitam/E-2”) Near Bethlehem
On December 26th, the Israeli Civil Administration announced that it will draft plans to build as many as 2,500 new settlement units at the Givat Eitam outpost site, creating a new settlement on a strategic hilltop that will cut off Bethlehem from the southern West Bank, completing the near encirclement of Bethlehem by Israeli settlements.
For years, settlers have lobbied for construction at the site, but those efforts have been stymied by the lack of a legal access road to the outpost, which is surrounded by land that even Israel recognizes is privately owned by Palestinians. Until recently, Israel has balked at seizing private land from Palestinians for the exclusive benefit of the settlements. But now, several new legal opinions have allowed Israel to violate the private property rights of Palestinians for the sole purpose of legalizing settlements and settlement infrastructure. Those legal opinions include the “market regulation” principle, the opinion(s) regarding the Haresha outpost case, and the Regulation Law. It is unclear which legal argument will be applied to the Givat Eitam/E-2 case.
The Givat Eitam outpost has been nicknamed “E-2” by settlement watchers for for its resemblance, in terms of dire geopolitical implications, to the infamous E-1 settlement plan. Located east of the separation barrier on a strategic hilltop overlooking the Palestinian city of Bethlehem to its north, Givat Eitam/E-2 is located within the municipal borders of the Efrat settlement but is not contiguous with Efrat’s built-up area, making Givat Eitam/E-2 effectively a new settlement that, according to Peace Now, will:
“block Bethlehem from the south, and prevent any development in the only direction that has not yet been blocked by settlements (the city is already blocked from the North by the East Jerusalem settlements of Gilo and Har Homa, and from the West by the Gush Etzion Settlements) or bypass roads (that were paved principally for Israeli settlers). The planned building in area E2 would likely finalize the cutting off of Bethlehem city from the southern West Bank, delivering a crushing blow to the Two States solution.”
In September 2018 FMEP reported that the local council of the Efrat settlement encouraged the start of (unauthorized) construction of an outpost at the Givat Eitam/E-2 site (presuming that any such illegal construction would be retroactively legalized by the government) in response to a Palestinian terror attack in the Efrat settlement. Since then, the Civil Administration has allowed the settlers to build and maintain an agricultural farm there.

Following High Profile Political Support, Settlers Violently Resist Evacuation from Amona Outpost Site
On January 3rd, 23 Israeli police officers were injured by Israeli settlers and their supporters who violently resisted the court-ordered evacuation from illegal encampments erected on privately owned Palestinian land as part of an effort to re-establish the Amona outpost. Approximately 300 settlers showed up at the Amona site (which is currently a closed military zone) overnight to resist the removal of settlers and two caravans from the hilltop, which was ordered by the Jerusalem District Court. The settlers and their supporters burned approximately 300 tires at the entrance to the outpost, poured oil on the access roads, and threw rocks and boulders at the Israeli police. Seven suspects were arrested and quickly released.
The evacuation of the outpost was reportedly carried out in defiance of a direct order from Prime Minister Netanyahu. According to the Haaretz report, Netanyahu gave orders to the Israeli military secretary, Col. Avi Bluth, to stop the evacuation. Col. Bluth did not relay the message in time, and the evacuation was carried out. Now, Netanyahu has ordered a disciplinary hearing to investigate the actions of Col. Bluth, which is scheduled for January 4th.
The violent evacuation of settlers from the Amona hilltop follows a week of high profile support for their efforts. Israeli Cultural Minister Miri Regev attended a ceremony near the recently re-established (yet unauthorized) Amona outpost to express her support for authorizing construction on the hilltop – which, according to the Israeli High Court of Justice, is privately owned Palestinian land. Regev could not go to the actual Amona site, because the area is a closed military zone where no one (settlers, politicians, and even the Palestinians who own the land) is permitted to enter. Regev and the settlers claim that the hilltop land has been legally purchased by the settlers, but that claim has not been investigated, much less verified. Casting doubt on the settlers’ claims, Haaretz notes:
“The lot in question is jointly owned by several different Palestinians, which means every single one of them would have to consent to the purchase for it to be legal. It’s not clear which, if any, of these Palestinians signed the sale document. In the end, the land was designated military land, is zoned for agriculture and has no building permits.The Binyamin Regional Council didn’t await the administration’s decision before moving two prefab homes into Amona and providing basic infrastructure such as water tankers.”
Israeli Attorney General Avichai Mandleblit slammed the settlers for trespassing and illegally moving caravans onto the site. Mandelblit criticized MK Bezalel Smotrich and the heads of regional settlement councils who went to the site to express support, saying:
“Breaking the law with the support of public figures, like placing caravans on privately-owned lands, can’t be a source of pride.”
A Haaretz report recently revealed Bezalel Smotrich was a founding member of a non-governmental group called Ofek Lehityashvut, which directly financed the illegal reestablishment of the Amona outpost last month by purchasing the two caravans that settlers moved onto the hilltop. The Haaretz report goes on to reveal that the Benyamin Regional Council has purposefully tailored various calls for proposals so that Ofek Kehityashvut would be the only group qualified to receive financing for that project. As a result of that manipulation, Ofek Kehityashvut has received substantial amounts of funding from the Benyamin REgional Council, which is an Israeli-taxpayer funded entity.
Knesset Speaker & Leaders Call for Annexation of Hebron
The speaker of the Israeli Knesset, Yuli Edelstein (Likud), called for Israel to apply its sovereignty over the city of Hebron – which would constitute an act of de facto annexation. Edelstein released a statement announcing his intention to go on a tour of Hebron – where some 500-800 settlers live under Israeli military protection amongst 200,000+ Palestinians – with the far-right, pro-annexationist group Im Tirzu. In the statement he wrote:
“In my view, it’s delusional that some Knesset members dare to undermine the Jewish people’s right to dwell in the city of our forefathers,” Edelstein said in a press statement issued prior to the conference. “We’re developing Hebron, investing in it and inculcating its importance in future generations. We are saying clearly – sovereignty in Hebron first.”
Speaker Edelstein also participated in a conference highlighting Israel’s historic connection to the city of Hebron. Organized by the Knesset Land of Israel Lobby, the event culminated in the signing of a document that reads:
“We, the undersigned, hereby express deep solidarity with the roots of the Jewish people in Hebron and the support of the Jewish community in Hebron that has clung to the city despite all the difficulties. We declare an unambiguous commitment to the continued existence, security and prosperity of Hebron as the city of both our forefathers and children.”
The event was co-organized by MK Bezalel Smotrich (Jewish Home) who said:
“Hebron is a litmus test. What is happening in Hebron shows our Jewish pulse….[those who call for settlers to leave Hebron] understand very well that if Hebron grows and develops, the entire settlement enterprise will grow and develop, so they invest in harming Hebron. But they will continue to shout and complain while we will continue to build, reach the people and connect with our roots.”
Regavim Petitions Jerusalem District Court to Stop the EU-Backed “Arab Takeover” of Area C
Following the Knesset’s passage of a bill in July 2018 that brought many West Bank legal matters under Israel’s domestic jurisdiction (an act of de facto annexation), the Jerusalem District Court is set to hear its first case concerning land disputes in the occupied territory. The bill was sponsored by Israeli Justice Minister Ayelet Shaked, whose three-fold rationale for the bill explicitly states that its purpose is to help settlers take more Palestinian land and shut-down Palestinian challenges to such thefts — by bringing matters to the Jerusalem Court instead of the High Court of Justice, which Shaked believes is too concerned with Palestinian rights and international law. The bill is part of the legislative body’s broader effort to erase all remaining distinctions (legal, judicial, economic, and otherwise) between sovereign Israel and the occupied territories, distinctions which allowed Israel to preserve the guise of respect for rule of law, and good intentions, for the last 50 years.
Looking to cash in the bill’s explicit purpose, the radical settler group Regavim initiated the petition asking the court to intervene to stop the “illegal Arab takeover” of land in the West Bank. Regavim’s petition claims that Palestinians are cultivating “state land” near the Mezad settlement. The petition also blames the European Union for its financial backing for the agricultural projects on the land. (Note: Regavim, like most settler media outlets, uses the word “Arab” to describe Palestinians, a vocabulary choice meant to erase any recognition of Palestinian identity).
A coordinator for Regavim told the Arutz Sheva outlet:
“The intervention of the European Union in what is happening in Area C is a brazen and aggressive intervention. We see extensive involvement on their part in lawbreaking and invading state land throughout Judea and Samaria. Their symbols are everywhere, and the State of Israel must respond to this blatant intervention on the diplomatic level as well.”
Shlomo Ne’eman, head of the Gush Etzion Regional Council said:
“The direct involvement of the European Union in financing Arab squatters in the territories and state lands has already become a plague on the state. We congratulate Justice Minister Ayelet Shaked on the obvious step that has led to great logic and justice in reducing the burden on the Supreme Court and in uniform enforcement against the land grabs by hostile elements…the Arabs understand that the real battle is on the ground. Foreign countries with their money are trying to shape a false consciousness and finally change the map of the state, but nothing can change history and our natural belonging on our national land.”

Knesset Lawyer Criticizes Bill to Give Palestinian Land to the World Zionist Organization
The legal advisors to the Knesset Constitution, Law and Justice Committee criticized a bill that would transfer vast tracts of land in Area C of the West Bank to the Settlement Division of the World Zionist Organization (WZO), a quasi-private state-funded entity that works to establish and expand settlements in the West Bank. Despite pressure to pass the bill, the legal advisors called on the committee to reexamine the text over concerns that it would also give the WZO authority over Palestinian communities in Area C. The experts wrote in a legal opinion for the committee:
“The proposed definitions of ‘rural settlement’ and ‘land’ do not include references to the character and nature of the settlement, and it seems that land that is government or abandoned property intended for Palestinian rural settlement will also be included in the boundaries of the proposed arrangement, and will be transferred to the management of the Settlement Division. Is the intention of the bill that the Settlement Division will also manage the Palestinian rural settlement in the area?”
As FMEP has previously reported, the bill was proposed by MK Bezalel Smotrich (Habayit Hayehudi) to accelerate the transfer of almost all of the land in Area C to the control of the World Zionist Organization. The land transfer is, in fact, taking place at the bureaucratic level, but Smotrich and the Israeli Cabinet (which endorsed the bill) are increasingly frustrated by the slow pace of the transfer (and perhaps also the limited scope of land slated to be handed over). Israeli Attorney General Avichai Mandelblit expressed his opposition to the bill, saying it is unnecessary given that ministry staffs are already working to transfer more land to the WZO through an administrative process.
In June 2018, when the Knesset gave preliminary approval to the bill, Peace Now responded:
“the government is scandalously planning to give the biggest land thieves responsibility for managing the land distribution, which will continue to be done under the cover of darkness if the bill passes into law.”

Sheldon Adelson’s Medical School in Ariel Settlement May Not Open
The state-of-the-art medical school planned to be built in the Ariel settlement is now in danger of not opening, after a letter from the Israeli Justice Ministry warned that the school’s approval is in jeopardy. The Justice Ministry discovered an undisclosed conflict of interest that voids an important vote in favor of approving the school by the planning and budgeting subcommittee of the Higher Education Council. A member of the subcommittee, Dr. Rivka Wadmany-Shauman, allegedly met with the heads of Ariel University ahead of the vote, and made her approval of the new medical school conditional on being promoted to the rank of professor. Israel Hayom reports the Ariel University has already shelved plans to inaugurate the new school for its first semester in the Fall of 2019.
As FMEP has previously reported, Ariel University became an accredited Israeli university in 2012, following significant controversy and opposition, including from Israeli academics. It has since been the focus of additional controversy, linked to what is a clear Israeli government-backed agenda of exploiting academia to normalize and annex settlements. In 2018, the settlement broke ground on the new medical school, with significant financial backing from U.S. casino magnate and settlement financier, Sheldon Adelson. In February 2018, in an act of deliberate de facto annexation, the Israeli Knesset passed a law that extends the jurisdiction of the Israeli Council on Higher Education over universities in the settlements (beyond Israel’s self-declared borders), ensuring that the Ariel settlement medical school (and its graduates) are entitled to all the same rights, privileges, and certifications as schools and students in sovereign Israel.
As a reminder, Ariel is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to attach Ariel to Israel will cut the northern West Bank into pieces.

Settlement Wave, Part 1: High Planning Council Advances Plans for 1,004 Settlement Units (96% Located Deep in the West Bank)
On August 22nd, the Israeli Defense Ministry’s High Planning Council (the body in the Israeli Defense Ministry responsible for regulating all construction in the West Bank) advanced plans for 1,004 new settlement units, 96% of which are located deep inside of the West Bank. Of the total, 620 units were approved for deposit for public review and 382 units were given final approval for construction.
As reported by Israeli settlement watchdog Peace Now, the plans approved for deposit for public review (totalling 620 units) are:
- 370 units in the Adam settlement (aka Geva Benyamin). This project was urged on by Defense Minister Liberman following a stabbing attack in the settlement, which resulted in one death and injuries to three others. The 370 units are part of a larger plan for 1,000+ units that will, if built, connect the Adam settlement to two large settlements in East Jerusalem (Neve Ya’akov and Pisgat Ze’ev) that are on the Israeli side of the separation barrier (the route of the barrier juts far beyond the 1967 Green Line to include Pisgat Ze’ev and Neve Ya’akov on the Israeli side while the Adam settlement is on the West Bank side). If the larger plan is implemented, the Adam settlement will have built up areas on both sides of the separation barrier, which could (in all likelihood) present Israel an opportunity to re-route the barrier around Adam — which would de facto annex even more West Bank land to Israel and further choke off Palestinian East Jerusalem from the West Bank to its north. [Note: FMEP’s Lara Friedman and Peace Now’s Hagit Ofran published an op-ed in Haaretz in 2008 warning of this plan – you can read that background here].
- 85 units in Karnei Shomron settlement. Israel has repeatedly confiscated as “state land” located between Karnei Shomron and the Palestinian village of Qalqilya (which is literally surrounded on three sides by the separation barrier). In November 2017, Israel began clearing landmines from that “state land” in order to prepare for settlement construction. At the time, Deputy Defense Minister Eli Ben-Dahan said that the new construction in the Karnei Shomron area will bring “a million Jews [to] live in Judea and Samaria in the future.”
- 84 units in the Kiryat Netafim settlement, located about half way between the Ariel settlement and the cluster of settlements close to the 1967 Green Line that are slated to be united into a “super settlement” area (Oranit, Elkana, Shiva Tikva, and others). The expansion of Kiryat Netafim will go towards creating a contiguous corridor of Israeli settlements stretching from sovereign Israeli territory, though the super settlement, to Ariel. As FMEP has repeatedly said, the Ariel settlement is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to attach Ariel to Israel (with a finger of land running through settlements like Kiryat Netafim) will cut the northern West Bank into pieces.
- 52 units in the Beit El settlement. This is the second major approval for new units in Beit El in 2018, with a third plan for 300 more units coming soon, according to Israel Hayom. The construction boom is being hailed by the settler-aligned Arutz Sheva outlet, which wrote that the plans will increase the size of Beit El by 65%. If any of the units are constructed it will be first new, government-sanctioned construction in Beit El in over 10 years. U.S. Ambassador to Israel David Friedman is closely associated with the Beit El settlement, having donated to and fundraised for it prior to his appointment as ambassador (including in his capacity as the President of the American Friends of Beit El, reportedly from 2011 until he became ambassador).
- 29 units in the Otinel settlement, located south of Hebron. MK Yehuda Glick (Likud) lives in Otinel.
Plans that gained final approval, meaning no additional formal approvals are required to move ahead with construction (totalling 382 units) are:
- 168 units in the Tzofim settlement, located on the Israeli side of the separation barrier, but jutting towards the Karnei Shomron settlement, which also received advancements this week. See the section on Karnei Shomron, above, for context and news regarding this area of settlements.
- 108 units in the Nofim settlement, located on the Israeli side of the separation barrier but jutting towards the Karnei Shomron settlement, which also received advancements this week. See the section on Karnei Shomron, above, for context and news regarding this area of settlements.
- 56 units in the Barkan settlement, located near the Kiryat Netafim settlement. Both Barkan and Netafim are located about half way between the Ariel settlement and the cluster of settlements slated to be united into a “super settlement” area (Oranit, Elkana, Shiva Tikva, and others). See the section on Kiryat Netafim, above. for context and news regarding this area of settlements.
- 44 units in Ma’ale Adumim, the mega settlement just east of Jerusalem.
- 6 units in the Avnei Hefetz settlement, located southeast of the Palestinian city of Tulkarem.
Notably, Netanyahu intervened to remove two items from the High Planning Council’s agenda, both of which would have led to the retroactive legalization of illegal outposts. Those plans are:
- A plan to retroactively legalize the Ibei Hanahel outpost, which is a non-contiguous “neighborhood” of the Ma’ale Amos settlement, located deep in the southern West Bank. The plan would have allowed the outpost to be demolished and then rebuilt legally with residential units, transforming the outpost into a new, fully authorized settlement.
- A plan to build an education center in the Nofei Prat South outpost, which is a non-contiguous“neighborhood” of the Kfar Adumim settlement, located northeast of Jerusalem. The land on which the project would be built is located just 1.5 km away from the Khan Al-Ahmar Bedouin community – the same one that the Israeli government plans to forcibly evacuate in order to cleanse the area of Palestinians and expand settlements. The outpost was established by the Haroeh Ha’ivri (“the Hebrew Shepherd”) nonprofit association, which is funded by the Israeli Education Ministry.
In response to Netanyahu’s directive to remove these two items from the agenda, the heads of the Knesset’s “Land of Israel Lobby,” Bezalel Smotrich (Jewish Home) and Yoav Kisch (Likud), said that the Prime Minister should “ act with greater rigor to promote settlement, rather than doing the opposite.”
Settler leaders were also unsatisfied with the High Planning Council’s overall numbers. Yossi Dagan, head of the Samaria Regional Council (a municipal body for settlements in the northern West Bank), said:
“We are happy about every new house in Samaria, but we have to tell the truth. Hundreds of housing units are not enough for an area that constitutes 12% of the State of Israel…We expect the government to step in the gas, stop worrying about what they will say overseas, and develop this beautiful region.”
Settlement Wave, Part 2: Housing Ministry Published Tenders for 420 Settlement Units
On August 23rd, one day after the Defense Ministry’s High Planning Council advanced a huge tranche of settlement plans (detailed above), the Israeli Housing Ministry published tenders for a total of 425 settlement units (under plans previously approved by the High Planning Council).
Those tenders include:
- 211 units in the Ma’ale Efraim settlement, located in the Jordan Valley.
- 54 units in the Givat Ze’ev settlement, located north of Jerusalem.
- 52 units in the Beit Aryeh settlement, which comes in addition to the the publication of tenders for 511 units in the settlement last week.
- 42 units in the Ariel settlement. See reporting below for extensive coverage of the many reasons settlers in Ariel are celebrating this week.
Settlement Wave, Part 3: Jerusalem District Committee Advances Plans for 603 Settlement Units in East Jerusalem
In addition to the tranche of settlement plans advanced by the Defense Ministry’s High Planning Council and the tenders published by the Housing Ministry (detailed above), the Jerusalem District Committee deposited for public review (one of the final steps before approval) plans for a total of 608 new settlement units in East Jerusalem, with 345 units slated for the Gilo settlement and 263 units in the Ramot settlement.
On the plan for the Gilo settlement, Ir Amim explains:
“The Gilo plan is being promoted in tandem with development of the new Green Line branch of the Light Rail (construction of which was launched in May), which will be built adjacent to the settlement expansion. This sequencing of events once again exemplifies a pattern of the state investing billions of shekels in transportation infrastructures to allow for extensive construction beyond the Green Line.”
As Ir Amim notes, this week’s advancements come on the heels of Israel’s August 15th decision to publish tenders for 603 units in Ramat Shlomo, and its June 2018 advancement of plans for 1,064 settlement units in the Pisgat Ze’ev settlement — bringing Israel’s two-month total of settlement advancements in East Jerusalem to 2,275 units.
As a reminder, approvals/advancement of settlement plans is not the only ongoing threat to Palestinians in East Jerusalem. Settlers and settler-run organizations continue their campaign to take over sensitive areas in East Jerusalem neighborhoods neighborhood – like Silwan and Sheikh Jarrah – and to create more settler run tourist sites – like the Jerusalem cable car, the Kedem Center, the Abu-Tor footbridge, the Yemenite “heritage center,” and more – to erase the visibility of Palestinians in Jerusalem. Meanwhile, pending legislation in the Knesset seeks to gerrymander the borders of Jerusalem to create a Jewish majority by annexing settlements and cutting out Palestinian neighborhoods from the borders of the city. Sounding the alarm on all of these trends, Ir Amim writes:
“It is vital that the traditional calculus of settlement building be readjusted to a) treat these coordinated efforts to consolidate control of the Old City and surrounding Palestinian neighborhoods with the same urgency afforded to settlement building throughout the whole of East Jerusalem; b) ensure a holistic response that regards private settlement inside the Old City Basin and touristic settlement not as individual phenomena but as multiple elements of a unified and politically lethal strategy.”
Settlement Wave, Part 4: More Settlement Construction Coming Soon
In addition to the plans for 1,004 units that were advanced this week by the High Planning Council, the 425 tenders published by the Housing Ministry, and the 608 units advanced in East Jerusalem (all detailed above), this week saw reports that additional plans are expected to advance soon. Those are:
- Ir Amim reports that on September 2nd, the Jerusalem District Committee is expected to discuss a plan to build a six-story building in Sheikh Jarrah, a neighborhood in which at least 75 families face eviction by radical settlers, with the backing of the Israeli government and courts. For detailed reporting on the building, plans for which were deposited for public review in May 2018, see FMEP reporting here.
- Peace Now reports that tenders are expected to be issued (having already been marketed) for more units in the Adam (Geva Binyamin) settlement. If true, this will be another step towards uniting Adam to the East Jerusalem settlements – the details of which are covered above.
- Peace Now also notes that a plan for 300 units in Beit El is expected to be advanced. This comes in addition to the 52 tenders issued for Beit El this week.
- The Times of Israel reports that plans for hundreds of additional settlement units will soon be marketed for construction by the Defense Ministry. These plans received final approval before this week’s High Planning Council meeting. A Civil Administration official hinted that the plans will be marketed for the Alfei Menashe and Ma’ale Efraim settlements. [NOTE: This reporting was before the subsequent publication of tenders for 211 units in Ma’ale Efraim, covered above.]
U.S. Stands By Israeli “Intentions” on Settlements

When asked for comment on the various major settlement announcements, the U.S. State Department said that the Trump Administration believes the Israeli government has clearly demonstrated an intent to “adopt a policy regarding settlement activity that takes the president’s concerns into consideration” – a statement that suggests unequivocally that the Trump Administration has given a green light for massive settlement expansion across the length and breadth of the West Bank and East Jerusalem.
Notably, on the same day that the bulk of the settlement announcements were made, President Trump’s National Security Advisor, Ambassador John Bolton, was on the ground in Jerusalem. Not only did he offer no comment or criticism of the settlement announcements, he very publicly joined Israeli politicians and settlers leaders for dinner in East Jerusalem, dining in the “City of David National Park,” the archeological/touristic/residential site in the Palestinian neighborhood of Silwan that is run by the radical Elad settler organization. As FMEP has repeatedly covered, the Elad settler organization is spearheading a government-aided campaign to evict Palestinians from their homes in Silwan, replace them with Jewish Israeli settlers, and transform the neighborhood into a Biblical tourist site emphasizing exclusively the area’s Jewish history.
The head of the Peace Now Settlement Watch program, Shabtay Bendet, told Al-Monitor:
“The situation on the ground is changing rapidly…Restraints on construction in the settlements have been lifted. The Americans don’t care…”
State Tells High Court: We Can Annex the West Bank, International Law Be Damned
On August 7th, the state’s private attorney Harel Arnon submitted a second brief [Hebrew] to the High Court of Justice in defense of the settlement “Regulation Law.” In it he argues that the Knesset is not bound by international law and has the right to apply its own laws outside of its borders and annex land, if it wishes.
Arnon argues:
“The mere application of a certain Israeli norm [law] to an anonymous place outside the state does not necessarily make that anonymous place part of Israel. The Knesset is not restricted from legislating extra-territorially anywhere in the world, including in the region, the Knesset can legislate in Judea and Samaria.”
The brief also argues:
“The Knesset is permitted to impose the powers of the military commander of the West Bank region as it sees fit. The Knesset is permitted to define the authorities of the military commander as it sees fit. The authority of the government of Israel to annex any territory or to enter into international conventions derives from its authority as determined by the Knesset…[and] the Knesset is allowed to ignore the directives of international law in any field it desires.”
Lawyers representing Adalah responded:
“the Israeli government’s extremist response has no parallel anywhere in the world. It stands in gross violation of international law and of the United Nations Charter which obligates member states to refrain from threatening or using force against the territorial integrity of other states – including occupied territories. The Israeli government’s extremist position is, in fact, a declaration of its intention to proceed with its annexation of the West Bank.”
Harel was ordered to submit a second defense of the bill in response to a petition filed by Adalah and Al-Mezan on behalf of seventeen local Palestinian authorities. The petition argues that the Regulation Law violates international law and that the Knesset cannot enact laws over the West Bank where the majority of the population is Palestinians (who are not Israeli citizens and cannot vote).
The High Court of Justice is widely expected to strike down the “Regulation Law,” but has yet to make a ruling. Just last week, Arnon made the case that the recently passed Nation-State Law, which makes “Jewish settlement,” a “constitutional value,” can help him defend the settlement law before the High Court.

This Week in Ariel: Settlers Celebrate 40 Years, A Construction Boom, A Medical School, & An Evangelical “Leadership Camp”
Haaretz published a lengthy report this week on the history of the the Ariel settlement – which is celebrating its 40th anniversary this month – and the dramatic spike in construction in the settlement in 2018. Even before tenders were issued for 42 new units this week (see above), plans for 839 units had already been approved during the first eight months of 2018, compared to tenders for fewer than 5 units each of the past three years. One of the original settlers of Ariel said:
“During the Obama years, everything here was frozen. But thanks to Donald Trump, we’re starting to see the light at the end of the tunnel.”
Not only has Ariel seen a massive surge in construction advancements this year, but the settlement broke ground on a new medical school heavily financed by U.S. casino magnate, and Trump backer, Sheldon Adelson (who this week gave $25 million to the GOP to help it keep the Senate, and in May gave the GOP $30 million to help it keep the House). Many settler leaders and Israeli officials, as well as Adelson and his wife Miriam, were in Ariel this weekend to attend a dedication ceremony for the medical school, despite ongoing controversy around its accreditation under domestic Israeli law. Prime Minister Netanyahu was notably absent from (and reportedly was not invited to) the ceremony, fueling rumors regarding the growing disaffection between him and Adelson.
According to another recent report in Haaretz, Ariel university is illegally dumping construction debris on land that Israel acknowledges is not “state land.” The dump site is outside of the so-called “Blue Line” which the Israeli government uses to demarcate the land that it considers “state land.” Since the dump site is not within the Blue Line, it is likely on land that even the government of Israel recognizes as being privately owned by Palestinians. Anti-settlement watchdog and founder of Kerem Navot, Dror Etkes, commented:
“It’s not surprising that Ariel University, which is the only university in the world built and existing by military order, has adopted the standards accepted in the West Bank involving the takeover of private Palestinian land.”
According to a third Haaretz report, the Israeli Education Ministry has signed a contract to sponsor 3,000-4,000 Israeli high school students of Ethiopian descent to take part in a leadership training program located in Ariel. The program, called “JH Israel,” was founded by American evangelical mega-church pastors Bruce and Heather Johnston, the latter of whom also runs the U.S. Israel Education Association, a pro-Israel, pro-settlement, non-profit group which works with the Family Research Council to lead Congressional delegations to Israel. The JH Israel website says its mission is to help Jewish Israeli students who are “disconnected from the roots of their faith” to establish “a deeper connection to God by embracing their biblical and cultural heritage.” The website also says that Ariel is “at the forefront of biblical prophecy unfolding in modern Israel.”
As FMEP has repeatedly documented, Ariel is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to connect Ariel to Israel will cut the northern West Bank into pieces.
Peace Now Settlement Watch Director Shabtay Bendet spoke to Haaretz about the future of the Ariel settlement and the (other) significant repercussions of opening the new medical school. Bendet said:
“Most places in Israel don’t get recognized as cities unless they have 20,000 to 30,000 residents. Ariel became a city when it had just 11,000 residents. Why was this so significant? Because maybe you can uproot a settlement, but you don’t uproot a city. The same holds true for the university. Why was it so important for him to get it accredited? Because when a place has a university, that means it’s established — no pulling it out of the ground….By creating a buffer between the northern and southern parts of the West Bank it makes any future Palestinian state unviable. But besides that, it is also causing damage in the present because its continued expansion impinges on the ability of the surrounding Palestinian villages to develop and grow.”
Amana (the Official Settler Movement) Moves Its HQ to Sheikh Jarrah
The Ynet news outlet reports that the Amana settler organization – the official body of the settlement movement, operating since the 1970s – has moved into its new headquarters in the heart of the Sheikh Jarrah neighborhood of East Jerusalem, where settlers are continuing to wage a displacement campaign against Palestinian residents. Though Amana has owned the plot of land since 1992, various legal challenges and incredibly sensitive geopolitical considerations have slowed construction of the building, called the “Amana House” (see a detailed history here).
Regarding the strategic implications of the location, Ynet reports:
“Amana says the new headquarters will help bolster the territorial contiguity of Jewish settlements in east Jerusalem.”
Agriculture and Rural Development Minister Uri Ariel (Bayit Yehudi) who previously served as the CEO of Amana, commented that the organization’s relocation:
“constitutes a significant reinforcement to the (Jewish) settlement in east Jerusalem and the bolstering of the Jewish territorial contiguity in the area.”
Several settlement plans are currently proceeding in Sheikh Jarrah, underscoring the strategic location and goals of settler activity in Sheikh Jarrah. As covered previously in this report, Israel is expected to advance a plan for a 6-story office building for settlers, located at the entrance to the neighborhood. Across the street from that building, a highly consequential plan for a new religious school (the Glassman yeshiva) was approved for deposit for public review in July 2017. The goal is clear: to unite the enclaves of settlers living inside of the Palestinian neighborhood by creating a contiguous area of settlement that connects to West Jerusalem, thereby cementing an immovable Jewish Israeli presence in a key Palestinian neighborhood – closing off the possibility of evacuation under a future peace deal.
Settlement Gains in East Jerusalem Result in Palestinians Self-Demolishing Their Homes
OCHA reports that two Palestinian homes in the East Jerusalem neighborhood of Beit Hanina were self-demolished after the Israeli Supreme Court ruled in favor of settlers’ ownership claims. OCHA writes:
“In recent decades, Israeli settler organizations, with the support of the Israeli authorities, have taken control of properties within Palestinian neighbourhoods in East Jerusalem, and some 180 Palestinian families are currently facing eviction cases, filed mainly by settler organizations.”
