Tenders Issued for New Neighborhood in Geva Benaymin Settlement

Peace Now reports that on November 4th the Israeli Housing Ministry published tenders for the construction of 342 new settlement units – establishing a new neighborhood in the Geva Benyamin (aka Adam) settlement. The new construction will expand the settlement northward towards the Jaba’ bedouin community, and connect the settlement to an outpost established by settlers in February 2025. Since the outpost was established, settlers have routinely and violently attacked the Jaba’ community.

Peace Now warned

Since the beginning of 2025, tenders have been published for a total of 5,667 housing units in settlements – an all-time record and about 50% more than the previous peak year, 2018, when tenders were published for 3,808 units. If the tenders published this year are built, these homes would add roughly 25,000 settlers to the West Bank.”

Israel Advances Plans for 1,985 New Settlement Units

Peace Now reports that on November 5th, the High Planning Council advanced plans for the construction of 1,985 new settlement units across the West Bank.

Since the beginning of 2025, including the plans slated for approval this week, Israel has advanced a total of 28,195 settlement units — setting a record for annual numbers. See Peace Now’s records here.

The plans that received final approval this week include:

  • 133 new units in the Kfar Tapuach settlement, located south of Nablus.
  • 80 units in the Etz Efraim settlement, located south of Qalqilya and on the Israel-annexed side of the Separation Barrier.
  • 178 units in the Ganei Modi’in settlement, located on the Israel-annexed side of the Separation Barrier in the northern West Bank.

The plans which were deposited for public review this week include:

  • 720 units in the Avnei Hefetz settlement, located just east of Tulkarem;
  • 568 units in the Einav settlement, located east of Tulkarem and east of the Avnei Hefetz settlement.
  • 48 units in the Etz Efraim settlement (in addition to the plans which received final approval).
  • 258 units in the Rosh Tzurim settlement, located south of Bethlehem in the Etzion settlement bloc.

Israel Delivers Demolition Notices to Entire Village of Umm Al Kheir in South Hebron Hills

On October 28th, the Israeli Civil Administration delivered demolition notices to 13 structures (including 11 homes) in the village of Umm al-Khair in the South Hebron Hills – a village that is almost entirely surrounded by Israeli settlements and violent outposts. The residents were given four days to appeal the demolition notices, which were issued due to lack of Israeli-issued building permits (the buildings are over a decade old).

These notices come only a few weeks after the Jerusalem District Court attempted to temporarily stop settlers from establishing another new outpost literally next to homes in the Umm Al-Khair.

Israel Allocates $12 Million to Deepen Control Over West Bank Archaeology Sites

Emek Shaveh reports that on October 26th the Israeli government allocated an additional $12million (NIS 33.6 million)to renovate and strengthen Israeli control over archaeological sites in the West Bank. The government had previously allocated $33 million (NIS 120 million) in 2023 to the same project as well as a special budget of NIS 32 million for the Sebastia site alone.

Israeli Heritage Minister Amichai Eliyahu said: ““will not wait for the formal imposition of sovereignty over the West Bank.” As a reminder, in July 2024 the Israeli government gave the Civil Administrative sweeping powers over archaeological sites in Area B of the West Bank.

Emek Shaveh said in a statement:

“The government decision to redirect funds from other offices to sites in the West Bank reflects the ministers’ true priorities. At a time when health, welfare, and education systems have been severely impacted by two years of war and soaring defence spending, the government is diverting critical resources to advance the settlers’ long-standing agenda: expanding control over territory through archaeology.

By declaring more areas as archaeological sites “off limits” to Palestinians and developing them as tourist attractions to draw mainstream Israeli visitors into the settlements, the government is instrumentalising antiquities both as a bureaucratic tool for displacement and annexation, and as a means of shaping a biblical-nationalist narrative that excludes other histories and denies Palestinian connection to the land.”

Settler Violence & The Olive Harvest

Settlers have continued to terrorize Palestinians harvesting olives during the 2025 harvest season, with virtually no recourse or accountability. Over the course of October, OCHA recorded the highest monthly number of Israeli settler attacks since OCHA began documenting such incidents in 2006, documented 260 attacks – an average of 8 per day. In addition Palestinians continue to suffer from increasingly restrictive Israeli policies that limit access to agricultural land located near settlements and/or the Separation Barrier. Adding to the heightened settler violence, the Israeli government has undertaken a deportation campaign against international solidarity activists who, for years, have accompanied Palestinians during harvest season as a protective presence.

Since October 21st, there have been at least 104 attacks, 20 of which were directly related to the olive harvest, including the following incidents of note over the past two weeks:

  • Mikhmas: On October 20th, settlers from a newly established outpost attacked a group of Palestinians and solidarity activists in the bedouin villages of Mikhmas and al-Ara’ara, located north of Jerusalem. The settlers threw stones at the Palestinians and set a house and olive trees on fire. Then, on October 23rd settlers cut the water pipelines which serviced Mikhmas. On October 25th, settlers violently attacked Mikhmas, burning six structures and injuring Palestinians and solidarity activists. Many residents of Mikhmas have left the village under the coercive displacement policies of the state and the escalating violence of the settlers – which goes unpunished. OCHA has documented 
  • Al-Mughayyir: On October 24th dozens attacked al-Mughayyir during the night, setting cars on fire. This is the 43rd time this year that settlers have attacked Al-Mughayyir, a town that is surrounded by seven outposts.
  • Samu, South Hebron Hills: Settlers were filmed ransacking a farm and torturing livestock – including baby lamb – in a small village in the South Hebron. Six lambs were killed and four were severely injured. 
  • Beit Ummar: Wafa News reports that on October 29th settlers cut down approximately 50 olive trees and stole construction equipment. Israeli settlers and soldiers have carried out more than 250 attacks on Palestinian olive farmers since the harvest began earlier this month, according to the Ramallah-based Colonization and Wall Resistance Commission
  • Qarawat Bani Hassan: On November 4th, settlers attacked Palestinians harvesting olives alongside a large group of volunteers (including American volunteers). As filmed by the harvesters, settlers flew a drone directly into the crowd of activists injuring one, and then proceeded to shoot live ammunition into the air, threatening to shoot the volunteers while they attempted to retrieve the drone. Haaretz reports the settlers were part of the security unit of the nearby Revava settlement.

The continued violence prompted the following statement by Tom Fletcher, Under-Secretary-General for Humanitarian Affairs and Emergency Relief Coordinator:

“Reports of attacks by Israeli settlers on Palestinians and their property across the West Bank continue. Many are related to Palestinians’ attempts to harvest their olive crops. Palestinians have been killed and injured. Their homes and property damaged. Their livestock attacked. More trees have been damaged and more communities affected this year than in the previous six years. The failure to prevent or punish such attacks is inconsistent with international law. Palestinians must be protected. Impunity cannot prevail. Perpetrators must be held accountable.”

Six Consecutive Weeks of Settlement Advancements

Israel has shifted to weekly planning approvals to end the 2024 year and start 2025.

Starting in early December 2024, the High Planning Council (which is the body in the Israeli Defense Ministry which oversees construction in the West Bank) has met weekly to approve settlement construction, a significant escalation in its activity. In the first eight days of 2025, the HPC has already met twice to advance construction plans for 1,213 new settlement units – a rate which could result in the soaring pace of final approval and construction commencement.

Peace Now said in a statement

“The Higher Planning Council’s weekly meetings indicate an attempt to normalize settlement planning, aiming to maximize housing unit approvals while minimizing public and international criticism. These weekly sessions exemplify the Netanyahu-Smotrich government’s annexation policy, which is leading to either a political deadlock or, worse, a political and security crisis.”

The approvals/advancements are as follows:

On December 4, 2024 the HPC convened to advance the construction of 274 settlement units, including:

  • Elon Moreh – 83 units advanced
  • Mitzpe Yishai – 79 units advanced
  • Ma’ale Amos – 112 units advanced

On December 11, 2024 the HPC convened to advance the construction of 227 settlement units, including:

  • Telem – 196 units approved
  • Eli – 21 units advanced
  • Givat Ze’ev – 10 units approved

On December 18, 2024 the HPS convened to advance 286 settlement units, including:

  • Eli – 118 units advanced
  • Nofim – 168 units advanced

On December 25, 2024 the HPC convened to advance 198 settlement units, including:

  • Givat Ze’ev – 5 units advanced
  • Etz Efraim – 192 units advanced
  • Alei Zahav – 1 unit advanced

On January 1, 2025 the HPC convened to advanced 765 settlement units, including:

  • Beitar Illit – 765 units approved for construction

On January 8, 2025 the HPC convened to advance 448 settlement units, including:

  • Kochav Yaakov – 1 unit advanced
  • Geva Binyamin – 356 units approved
  • Karnei Shomron – 68 units approved
  • Beitar Illit – 23 units advanced

Israel Expands Jurisdiction of Adam Settlement to “Legalize” Nearby Outpost, Formalize Violent Dispossession of Palestinians

Peace Now reports the Israeli Civil Administration has published a notice of intent to expand the jurisdiction of the Adam settlement (aka Geva Binyamin) to include a nearby illegal outpost, Bnei Adam, as well as the land from which the Palestinian community of Briyat Hizma was violently expelled in October 2023 (one of the X communities coerced into abandoning the land and homes under the incessant, escalating, and uninhibited terrorism of settlers). This move will allow Israel to grant legal status to the outpost, claiming it as a neighborhood of the Adam settlement).

Peace Now said in a statement:

“This is an extreme example of the Israeli government’s method of dispossession and takeover: settlers establish an illegal outpost, then violently expel Palestinian neighbors, and finally the government steps in to permanently take over the land, include it within the settlement area, and allow for the legalization of the illegal outpost. Settler violence is not a bug; it’s a feature, and part of an illegal and immoral policy of dispossession and expulsion operated by Netanyahu’s government.”

Israel Renews Plan for Yeshiva in Sheikh Jarrah, East Jerusalem

Ir Amim reports that Israel is planning to revive a highly controversial and potentially destabilizing plan to build a massive yeshiva at the entrance to the Palestinian East Jerusalem neighborhood of Sheikh Jarrah. The Jerusalem District Planning Committee was scheduled to hold a private discussion on the plan January 7th; the plan – referred to as the Glassman Yeshiva – calls for the construction of an 11-story building (3 stories below ground) which will include a religious school and dormitories for students and faculty. There are several settler enclaves in Sheikh Jarrah currently, while Palestinians are facing concerted eviction efforts by settlers and the government. The situation in Sheikh Jarrah has long been volatile and violent, and the focus of international solidarity protests.

The yeshiva is slated to be built on a patch of land that was expropriated from Palestinian owners for “public needs”; in 2007 the land was transferred by the Israeli government to the Ohr Somayach Institutions, an international organization which is promoting the yeshiva plan. Ir Amim reports that in 2023, the Ohr Somayach Institutions received over 6 million NIS from its U.S. branch and its donors.

Ir Amim has filed a formal letter to the District Planning Committee arguing that erroneous and incomplete information was provided to planning authorities regarding the plan, and that there is a severe shortage of available land for Palestinian use – including public buildings and schools. These same issues were formally raised by Ir Amim in 2021, and there has been no public reports that the issues with the planning of the yeshiva have been resolved or justified.

Smotrich Increases Subsidy Program for Illegal Farming Outposts 

In late December 2024, Finance Minister Bezalel Smotrich announced a increased funding for a grant program that provides subsidies to settlement agricultural farms, including illegal farming outposts. These types of illegal outposts are increasingly popular tools for settlers to assert control over a large amount of territory with only a few settlers and a herd of livestock. Smotrich celebrated the  has increased the budget for supporting West Bank agricultural farms and expedited the grant process for those seeking government subsidies.

While visiting the Mishkenot Harel farming outpost, Smotrich told press:

“Our policy is aimed at preserving national land reserves, creating secure and strategic territorial contiguity, and curbing Palestinian efforts to expand their illegal control over lands in the region,” declares Smotrich, who also serves as a minister in the Defense Ministry with control over the recently established Settlements Administration.”

Court Tells IDF To Publish More Land Allocations in Advance

Peace Now reports that a new ruling by the Israeli High Court of Justice has limited the exceptions under which the state can ignore its obligation to publish in advance notice of its intention to allocate lands in the West Bank that are outside of the boundaries of settlements. Since a previous Court ruling in 2015, the State has published only a small percentage of land allocations, not always including allocation renewals or allocations related to absentee properties. The ruling is the direct result of Peace Now’s petition challenging the secretive land allocation process which denied Palestinians any opportunity to prove land ownership claims.

Peace Now said in a statement

 “The court issued a red card to the government today and ruled that the time has come to stop the lawlessness and the distribution of land in the dark. For 57 years, the State of Israel has done whatever it wants with land in the Occupied Territories, with no transparency and outside the rules of proper administration. As a result, 99.76% of the land allocated by Israeli authorities in the Territories has been allocated only to Israelis, while almost nothing has been allocated to Palestinians. This statistic is one of the reasons Israel is accused of maintaining an apartheid regime in the territories. If there had been minimal transparency in the government’s actions in the Territories, it is possible they would not have dared to act in such a discriminatory and blatant manner.”

Rapid Outpost Growth Caps 2024 

Peace Now reports that settlers have established at least seven new outposts in the last two months of 2024, all of which are located on land classified as Area B under the Oslo Accords. Five of the new outposts are located in the so-called “Agreed Upon Reserve” – a large area of land to the south and east of Bethlehem that has come under the intense targeting by Bezalel Smotrich and his settler allies who have moved to formalize unilateral Israeli sovereignty there. The other two new outposts are in the Ramallah area.

Peace Now documented over a dozen Palestinian homes that have been abandoned as a result of these new outposts, likely in fear of the violence settlers routinely inflict on Palestinians in their vicinity. Palestinians have already reported several violent encounters with one of the new outposts (called “Mikne Avraham” by settlers) located in the Agreed Upon Reserve. Haaretz reports that several young adults and teenagers are living at the Mikne Avraham outpost and they are terrorizing Palestinian herding communities who live nearby. In one case, the settlers have beaten a young Palestinian twice, conducted a home invasion posing as IDF, and set first to the same families’ granary. That Palestinian family has fled under the threat of escalating violence and non-responses from the Israeli military police.

Peace Now notes that, over the past decades, the Israeli government has not enabled or permitted settlement building in Area B, while allowing rampant illegal settlement construction across Area C. That seems to have changed now, with settlers seeing a green light to illegally establish Israeli presence in Area B. Of the five new settlements established in Area B in recent months, only one (which was built on lands north of Turmus Ayya) has been removed by the IDF, though settlers have already re-established the outposts.

In total, settlers established 52 new outposts in 2024, of which 13.5% are located in Area B. Commenting on the maximalist ambitions of Israeli settlers, Peace Now said in a statement:

“After seizing control of Area C and systematically displacing Palestinians through house demolitions and settler violence, settlers have now set their sights on Area B,” Peace Now said upon publishing its new report. The Israeli government’s annexation plans are not limited to Area C. By enabling settlers to establish outposts deep in Area B, the government blatantly violates another critical element of the Oslo Accords. If we do not act today, we will find ourselves returning to full military rule across the entire West Bank.”

The Haaretz Editorial Board writes:

“Supporters of annexation are no longer making do with Area C of the West Bank – that is, the part assigned to full Israeli control by the Oslo Accords. The success of the theft enterprise in Area C has increased their appetite, and they are constantly seeking to expand to other areas.For some time now, the movement to steal Palestinian lands has also been setting its sights on Area B, the part of the West Bank under Palestinian civilian control but Israeli security control….The demolition of Palestinian buildings in an area that Israel has until now refrained from interfering with, coupled with the establishment of new outposts, shows that annexation has begun creeping into Area B as well. This is a dangerous development. It threatens the Palestinians living there and accelerates Israel’s descent into a thuggish apartheid state that has removed itself from the family of nations.”

Cashing In Before Trump Cashes Out, PART 1: Israel Awards Tender for the Construction of Givat Hamatos

On January 19th, the Israel Land Authority issued the tender for the construction of the Givat Hamatos settlement in East Jerusalem (the tender is for a total of 1,257 settlement units). The issuance of the tender came a mere 6 hours before Joe Biden was sworn in as the President of the United States.

Prior to the issuance of the tender, the Jerusalem District Court rescinded its injunction against the tender, which the Court had issued last week in response to a petition filed by Palestinian residents of East Jerusalem and the Israeli NGO Ir Amim. That petition – which alleges that the planned construction of government-subsidized housing has discriminatory eligibility guidelines – is still pending, and the Court scheduled a discussion of the petition for May 27th.

According to Jerusalem expert Daniel Seidemann (of the Israeli NGO Terrestrial Jerusalem), now that the tender has been issued and awarded, construction of Givat Hamatos is now “virtually inevitable.” Givat Hamatos has long been regarded as a doomsday settlement by parties interested in preserving the possibility of a two-state solution, in that it will prevent the division of Jerusalem into an Israeli capitol and a Palestinian capitol (if the Givat Hamatos settlement is built, the Palestinian neighborhood of Beit Safafa in East Jerusalem will be completely surrounded by Israeli construction, severing its connection to the West Bank). Regardless of the implications of Givat Hamatos on a two state solution, the impact of the new settlement on the Beit Safafa neighborhood are nonetheless significant.

Explaining how Netanyahu bears direct responsibility for the highly consequential decision to move ahead with Givat Hamatos, Terrestrial Jerusalem writes:

“Netanyahu could have made this ‘go way’ at ZERO political cost to himself. He could have said truthfully: I tried, but the Court didn’t let me. Instead, he pulled out all plugs and instructed the State Attorney to aggressively pursue the rescission of the injunction. He went out of his way to make this happen. The tender process may now be completed, after which construction is virtually inevitable.This is happening because Netanyahu wants it to happen. This is happening now, because Netanyahu wants it to happen now.”

Ir Amim punctuates its analysis of the move by writing:

“The fact that the ILA hastened to announce the winners of the tender only 6 hours before Joe Biden’s inauguration serves to underline how determined the Israeli government is to create as many facts on the ground as possible before Biden takes office.”

Regarding the prospects of its petition against the Givat Hamatos tender, Ir Amim writes:

“The petition targets the conditions of eligibility for subsidized housing within the tender which discriminate against Palestinians. The petition does not call for cancellation of the tender but it remains to be seen how the petition will be viewed by the court and whether or not this will affect more than the specific discrimination present. One possible result of the petition – although we do not think its likelihood is high – can be that subsidized housing be completely removed from the tender in which case it is very possible that the tender will have to be reissued.”

Cashing In Before Trump Cashes Out, PART 2: Israel Issues Tenders for 2,572 Settlement Units

On January 20, 2021 – inauguration day in the U.S., the Israeli government issued tenders for the construction of 2,572 units (total) in settlements across the West Bank, as well in East Jerusalem. Now that the tenders are issued, construction companies are invited to bid to win the contract. Peace Now estimates that building is likely to happen within two years from now.

The issuance of these tenders comes in addition to the Givat Hamatos tender (see section above) and the advancement of plans for 780 more settlement units (see section below). 

Commenting on the tenders, Peace Now said in a statement

“Our out-of-touch government leadership continues to press on with its mad scramble to promote as much settlement activity as possible until the last minutes before the change of the administration in Washington. By doing so, Netanyahu is signaling to the incoming President that he has no intention of giving the new chapter in US-Israel relations even one day of grace, nor serious thought to how to plausibly resolve our conflict with the Palestinians.”

The 2,572 tenders issued on January 20 provide for:

  • 941 units in the Emanuel settlement, located in the northern West Bank east of the Palestinian village of Qalqilya. Israel has openly declared its intention to continue expanding settlements in this area – which includes the settlements of Karnei Shomron and Alfei Menashe – with the stated goal of bringing 1 million settlers to live in the area.
  • 460 units in the Pisgat Zeev settlement, the largest settlement in East Jerusalem. This involves  the issuance of two tenders, one for 210 units and a second for 250 units. 
  • 377 units in the Adam (aka Geva Binyamin) settlement, through the issuance of three tenders, one for 94 units,  a second for 263 units, and a third for 20 units.  The Adam settlement is  located northeast of Jerusalem, just beyond the separation barrier. Israel has for some years been steadily building the Adam settlement in a manner meant to connect the settlement seamlessly with East Jerusalem settlements and infrastructure, erasing the Green Line.
  • 359 units in the Beit Aryeh settlement, located northwest of Ramallah, through the issuance of two tenders, one for 159 units and a second for 200 units.
  • 220 units in the Maaleh Efraim settlement, located in the northern West Bank in the area between the central ridge and the Jordan Valley, through the issuance of three tenders, one for 24 units, a second for 178 units, and a third for 18. 
  • 150 units in the Alfei Menashe settlement, located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding this area – which includes Karnei Shomron and Emmanuel – with the stated goal of bringing 1 million settlers to live in the area.
  • 49 units in the Karnei Shomron settlement, through the issuance of two tenders, one for 48 units and a second for 1 unit). Israel also advanced plans for construction of 24 more units in the Karnei Shomron settlement through an earlier stage of the planning process (see the section below). Karnei Shomron is located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron with the stated goal of bringing 1 million settlers to live in the area.
  • 16 units in the Beitar Illit settlement. through the issuance of two tenders, one for 14 units and a second for 2 units). Beitar Illit is located west of Bethlehem, near the Green Line.

Cashing In Before Trump Cashes Out, PART 3: In Final Hours of Trump Era, Israel Advances Plans for 780 Settlement Units Across the West Bank

At its final meeting of the Trump era — which took place the day before Joe Biden’s inauguration — Israel’s High Planning Council advanced plans for 780 new settlement units. This includes final approval for plans for a total of 365 units plus the expansion of an industrial zone and approval for deposit for public review (one of last steps before final approval) for a total of 415 units, including retroactive legalization to two illegal outposts.

Commenting on the Council’s actions, Peace Now said in a statement

“By promoting hundreds of settlement units, Prime Minister Netanyahu is once again putting his personal political interests over those of the country. Not only will this settlement activity erode the possibility for a conflict-ending resolution with the Palestinians in the long-term, but in the short-term it needlessly sets Israel on a collision course with the incoming Biden administration.”

Specifically, plans granted final approval by the Council include:

  • 152 new units in the Shavei Shomron settlement, located in the northern West Bank, northwest of Nablus.
  • 123 new units in the Itamar settlement, located southeast of Nablus in a cluster of notoriously violent settlements and outposts.
  • 66 new units in the Oranit settlement, located in the northern West Bank, in the “seam zone” between the 1967 Green Line and the Israel separation barrier (a barrier constructed along a route designed to keep as many settlements and as much adjacent land as possible on the Israeli side of the wall/fence).
  • 24 new units in the Karnei Shomron settlement, located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron with the stated goal of bringing 1 million settlers to live in the area.
  • Expansion of the Barkan Settlement Industrial Zone, located in the northern West Bank and a part of a strand of settlements connecting Israel proper and the Ariel settlement. Ariel is located in the very heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel and the settlements between Ariel and Israel proper have long been one of the greatest challenges to any possible peace agreement, since any plan to connect Ariel to Israel will cut the northern West Bank into pieces. Plans the Council approved for deposit for public review include:

  • The retroactive legalization of 118 existing units in the Nofei Nehemia outpost. If implemented, this plan would have the effect of retroactively legalizing the outpost as a “neighborhood” of the Rehelim settlement, notwithstanding the fact that the Nofei Nehemia outpost is a fair distance from the Rehelim settlement and is not contiguous with the built-up area of Rehelim. In reality, Nofei Nehemia – if authorized – should be understood as a brand new settlement in its own right, rather than an expansion of an existing one (as the Israeli government wants the world to believe). The Nofei Nehemia outpost is located east of the Ariel settlement in the very heart of the northern West Bank. The Nofei Nehemia outpost made news this week with launch of a public bus route through the outpost – an overt act of entrenching and normalizing its presence by Israeli authorities.
  • 107 new units in the Tal Menashe settlement, located on the tip of the northern West Bank, inside the “seam zone” between the 1967 Green Line and the Israel separation barrier, which was constructed along a route designed to keep as many settlements and as much adjacent land as possible on the Israeli side of the wall/fence. Tal Menashe is technically a neighborhood of the Hinanit settlement, though the built-up areas do not connect. The plans for 107 units would, if implemented, “dramatically increase” the size of the Tal Menashe settlement, which is the settlement where Esther Horgan – who was murdered by a Palestinian in late December 2020 – lived. Israeli government officials have made it a clear policy to advance settlement construction in response to deadly attacks on settlers by Palestinians, an approach publicly endorsed by U.S. Ambassador to Israel David Friedman. 
  • The retroactive legalization of 96 units in the Havot Yair outpost, with the intention of granting retroactive legalization (under Israeli law) to the entire outpost. The Havat Yair outpost is located near the Karnei Shomron settlement in the northern West Bank, east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron area with the stated goal of bringing 1 million settlers to live in the area.

Netanyahu’s Bid for Mass Legalization of Outposts Fails (For Now)

Despite an intensive last ditch effort, Netanyahu did not succeed in pushing through a government decision to grant retroactive legalization to dozens of outposts in the waning hours of the Trump era.

According to reports, Netanyahu made a last minute effort to gain Gantz’s support for a more narrow authorization – for 6 outposts instead of the 43 outposts as included in an earlier draft government decision. Gantz reportedly blocked Netanyahu’s proposal from coming up for a vote at the Israeli government cabinet meeting on January 19th, saying that no diplomatically irresponsible proposal will be raised at such a sensitive time.” Other reports suggest European leaders intervened to make their objections to outpost authorization clear.

According to Haaretz, Netanyahu made several attempts to get the decision passed, including convening a call with Israel’s Attorney General to make progress. During that call Netanyahu complained that “jurists” were getting in his way. Netanyahu then surprised Gantz by adding the outpost issue to the Cabinet’s meeting planned for January 19th (a meeting devoted solely to the COVID-19 crisis).

The 6 outposts Netanyahu’s proposal reportedly listed for legalization are: Tel Zion, Ovnat, Metzoke Deragot, Kedem Arava, Avigail, and Asa’el. For more information on those outposts, see Peace Now’s reporting. Of those outposts, three would have been legalized as neighborhoods of existing settlements (Tel Zion, Ovnat, Metzoke Deragot), and three would have been authorized as full-fledged independent settlements (Kedem Arava, Avigail, Asa’el). Netanuyahu’s new proposal also called for the government to allocate over $6.2 million (NIS 20 million) to hire 13 new staff members at the Civil Administration tasked with continuing outpost legalization legal efforts.

FMEP has traced this saga for weeks – from the time when Likud and Blue & White officials were collaborating to draft such a decision, to last week’s news that Gantz decided to continue blocking the move despite a private meeting with settlers asking him to give his OK. It’s worth reiterating that Gantz has made clear he is not opposed to granting retroactive legalization to outposts, but is opposed to this manner of doing so. Gantz prefers for each outpost to be considered on an individual basis.

No Annexation, No Problem – Israel Advances Nearly 5,000 New Settlement Plans, Including New Settlement South of Jerusalem 

Overview

During meetings held October 14th and 15th, the Israeli High Planning Council advanced plans for a total of 4,948 new settlement units. Of that total, plans for 2,688 units were granted final approval and plans for 2,260 units were approved to be deposited for public review (a late stage in the planning process). The latter approvals include a plan to build a new settlement, “Har Gilo West,”  just beyond Jerusalem’s southern border. In addition, the Council granted retroactive approval to 340 existing illegally-built settlement units in the unauthorized outposts of Peni Kedem and Tapuach West, paving  the establishment of two new official West Bank settlements (through post-facto legalization of the illegal outposts).

These were the first meetings of the High Planning Council since February 2020, at which time settlement planning was put on pause in favor of attempting to implement annexation plans as designed by Trump’s “Deal of the Century.” Under annexation, authority over the settlement planning/approval process could have been shifted from the Israeli Civil Administration (the branch of the Israeli Defense Ministry, in charge of the administration of affairs in the West Bank, – i.e., Israel’s occupation) into Israel domestic planning mechanism. Such a shift has long been a goal of settlers and their political allies.

In addition to advancing construction of new residential settlement units, the High Planning Council also advanced plans for the construction of new settlement projects that support tourism, further entrench the permanency of settlements, and that continue the exploitation of West Bank land and resources.

Record-Setting Settlement Activity in 2020

With the huge advancement of settlement plans this week, the Israeli government has advanced plans for 12,159 settlement units so far in 2020. With over two months to go, the settlement watchdog group Peace Now reports that this is already the highest total number settlement advancements in any year since Peace Now began tracking totals in 2012. Peace Now also reports that it is possible that the High Planning Council will convene one more time before the year ends.

Har Gilo West Approved for Deposit w/ Plan to Seal Off Al-Walajah

The High Planning Council approved for public deposit a plan to build 560 units at the Har Gilo West settlement site, located just south of Jerusalem. The Council is treating this plan as merely an expansion of the existing Har Gilo settlement, but in actuality it represents the construction of a new settlement on Jerusalem’s southern border, as the two areas of construction (Har Gilo and Har Gilo West) would not be contiguous. The plan for 560 units in Har Gilo West is part of a larger plan to construct around 952 units in the new settlement, extending the its borders right up to the Jerusalem municipal boundary, with dire consequences for the long-beleaguered Palestinian village of Al-Walajah. 

The discussion on October 14th further revealed  that, in order to build Har Gilo West, Israel plans to extend the separation barrier in that area to completely encircle al-Walajah, which is surrounded on three sides by the separation wall already. The new section of the barrier would be a 7-meters high concrete slab along the western edge of the built-up area of Al-Walajah. That would leave Al-Walajah completely encircled by the separation barrier and Israeli construction beyond it.

Ir Amim explains:

In the past decade a series of Israeli moves have taken over more and more of Al-Walaja land and gradually isolating it. These are now culminating with the intention to construct the new settlement on the land reserves on the western side of Al-Walaja and to extend the separation barrier so as to complete the encircling of the village. As Al-Walaja will turn into an isolated enclave which lacks an outline plan its residents will be especially vulnerable to increasing home demolitions and other Israeli sanctions. Since the village will separate the new settlement from the existing Har Gilo we are likely to see increasing Israeli actions against Al-Walaja and its residents which will put their future existence at risk.”

Peace Now writes:

“The current plan of 952 housing units to be advanced will create a brand new neighborhood that will be larger than the existing settlement, and will exploit the land cut off by the West Bank barrier to further break up the western Bethlehem metropolitan area, including the land connecting al-Walaja and the town of Battir, as well as Battir and Bethlehem. This land also constitutes some of the only uninhabited fertile land reserves for Bethlehem, which currently is cut off by the West Bank barrier to its immediate north and west.

FMEP has repeatedly documented various Israeli efforts to seal off al-Walajah from Jerusalem. Residents of al-Walajah have fought the growing encroachment by the nearby Etzion settlement bloc and the Israeli government’s attempt to de facto annex the bloc as part of “Greater Jerusalem.” Ir Amim explains several prongs of this effort, including a particularly unbelievable section of Israel’s separation barrier planned to almost completely encircle the village, to turn its valuable agricultural land into an urban park for Jerusalem, and construction of a highway that will connect the Etzion settlement bloc to Jerusalem with Israeli-only bypass roads.

Two Outposts Advance Towards Retroactive Legalization

The High Planning Council approved for deposit two plans that would, if implemented, have the effect of retroactively legalizing two outposts – bestowing upon those outposts legitimacy in the eyes of Israeli law and, in effect, establishing two new, official settlements. Those plans are:

  1. Pnei Kedem: A plan to grant retroactive legalization to 120 units in the Pnei Kedem farm outpost by recognizing the outpost as a “neighborhood” of the Metzad/Asfar settlement. This is despite the fact that the two areas of construction are non-contiguous. Pnei Kedem is located halfway between Bethlehem and Hebron in the southern West Bank. Settlers were particularly gleeful about this plan being advanced
  2. Tapuach West: A plan to grant retroactive legalization to 133 units in the Tapuach West outpost, located south of Bethlehem. 

Not Just Residential Units – Council Advances Settler Tourism & Infrastructure Projects

The High Planning Council also advanced plans for the construction of new settlement projects that support tourism, further entrench the permanency of settlements, and that continue the exploitation of West Bank land and resources.

The Council granted final approval to:

  1. A plan for new shops and an educational site (to include an agricultural farm) in the Kochav Yaakov settlement – located between Jerusalem and Ramallah; and,
  2. A plan to grant retroactive authorization to a motor park and 120 hotel rooms in the Petza’el settlement, located in the Jordan Valley. As FMEP has covered in the past, this state-of-the-at racetrack and hotel complex is being built partially on land that the Israeli army previously declared a closed firing zone, a designation which resulted in the forcible displacement of Palestinians who lived there. The land remains under this designation today. Rather than halting the construction of this complex, the Israeli authorities instead created a Master Plan for the area in order to enable even more construction in the area.

Plans the Council granted final approval for public deposit include:

  1. A plan for an industrial zone near the Mishor Adumim settlement; and,
  2. A plan to build a new commercial area and 50 hotel rooms in the Maale Adumim settlement;

Location of Approvals

Included in the total number of units receiving final approval and/or retroactive legalization (3,028 units) are  (in descending order of number of units): [map]

  1. 382 units in the Beit El settlement, located in the heart of the northern West Bank. This includes retroactive legalization for 36 units which had been previously built without authorization and the construction of 346 units in highrise buildings with 9 or 10 floors (building up, not out in Beit El) [as a reminder, US Ambassador to Israel David Friedman has deep ties to the Beit El settlement];
  2. 357 units in the Geva Benyamin (Adam) settlement, located just north east of Jerusalem, just beyond the separation barrier. Israel has been steadily building the Adam settlement in a manner meant to unite the settlement more seamlessly with East Jerusalem settlements and infrastructure, erasing the Green Line;
  3. 354 units in the Nili settlement, located in the northern West Bank;
  4. 213 units in the Shiloh settlement, including the retroactive legalization of 21 units built without required approvals. The Shiloh settlement is located in the central West Bank;
  5. 211 units in the radical and violent Yitzhar settlement, including some retroactive authorizations (exact number not specified) as well as approval for public buildings. Yitzhar, located just south of Nablus, is associated with the Hilltop Youth movement – and a string of illegal outposts in the area associated with repeated attacks on Palestinians and their property;
  6. 205 units in the Nokdim settlement (actually approved for the Kfar Eldad settlement, which is officially within the jurisdiction of Nokdim), located south of Bethlehem;
  7. 200 units in the Metzad settlement (also known as Asfar), including the retroactive legalization of an unspecified number of existing units built without necessary approvals;
  8. 160 units in the Kochav Yaacov settlement, located east of Ramallah;
  9. 140 units in Kerem Reim settlement located north west of Ramallah. Peace Now has repeatedly challenged the illegal construction of the Kerem Reim outpost, which the Israeli government retroactively legalized by declaring it a neighborhood of the Talmon settlement even though the areas are non-contiguous. Though a court rejected one Peace Now petition, there is an ongoing case against the Amana settler organization which Peace Now alleges engaged in illegal activities to build the outpost;
  10. 132 units in Kfar Adumim settlement –  located east of Jerusalem and less than one mile from the Khan al-Ahmar bedouin community which the state of Israel is seeking to demolish;
  11. 106 units in the Ma’ale Shomron settlement,  located east of the Palestinian village of Qalqilya;
  12. 84 new units in the Shima settlement, including retroactive legalization of 14 existing units;
  13. 74 units in the Yakir settlement –  located in the northern West Bank and part of a string of settlements and unauthorized outposts – most notably Ariel – extending from the Green Line deep into the West Bank;
  14. 64 units in the Telem settlement – located west of Hebron;
  15. Retroactive legalization of 18 units in the Psagot settlement – located east of Ramallah, and home to the Psagot Winery;
  16. Retroactive legalization of 2 units in the “Givon Hadasha” settlement;

Plans which were approved for deposit for public review include (in descending order of number of units):

  1. 629 units in the Eli settlement, including the retroactive legalization of 61 units – located  south of Nablus and southeast of the Ariel settlement in the central West Bank. Though the Eli settlement previously received Israeli government approval, a “Master Plan” – which officially zones land for distinct purposes (residential, commercial, public) –  has never been issued for Eli, meaning all construction there is illegal under Israeli law;
  2. 560 units in the Har Gilo settlement located just south of Jerusalem (covered in detail above);
  3. 286 units in the Har Bracha settlementlocated just south of Nablus. If implemented, these new units will double the size of Har Bracha;
  4. 179 units in the Einav settlement – located northwest of Nablus;
  5. 148 units in the Rimonim settlement – located between Ramallah and Jericho in the Jordan Valley;
  6. A plan to grant retroactive legalization to 133 units in the Tapuach West outpost, thereby granting approval to the outpost itself (discussed above);
  7. A plan to grant retroactive legalization to 120 units in the Pnei Kedem outpost by recognizing the outpost as a “neighborhood” of the Metzad/Asfar settlement although the two areas of construction are non-contiguous. Pnei Kedem is located between Bethlehem and Hebron in the southern West Bank;
  8. 82 units in the Karnei Shomron settlement located in the northern West Bank east of the Palestinian village of Qalqilya. Israel is planning to continue expanding Karnei Shomron with the stated goal of bringing 1 million settlers to live in the area surrounding the settlement.;
  9. 75 units in the Shimaa settlement, including the legalization of 14 units previously built without authorization;
  10. 52 units received retroactive legalization in the Kfar Adumim settlement
  11. 35 units in the Efrat settlement located south of Bethlehem. As a reminder, Efrat is located inside a settlement block that cuts deep into the West Bank. Efrat’s location and the route of the barrier wall around it, have literally severed the route of Highway 60 south of Bethlehem, cutting off Bethlehem and Jerusalem from the southern West Bank. The economic, political, and social impacts of the closure of Highway 60 at the Efrat settlement (there is literally a wall built across the highway) have been severe for the Palestinian population;
  12. 14 units (in one building) in the Maale Mikmash settlement – located east of Ramallah;
  13. 10 units in the Barkan settlementlocated about half way between the Ariel settlement and the cluster of settlements slated to be united into a “super settlement” area (Oranit, Elkana, Shiva Tikva, and others).
  14. 7 units in the Peduel settlement located in the northern West Bank and part of a string of settlements and unauthorized outposts – most notably Ariel – extending from the Green Line into the very heart of the West Bank and on towards the Jordan Valley; and,

Reactions

The High Planning Council met only after settlers, who represent a key ally of the embattled Prime Minister, pressured Netanyahu to allow it. Settlers have spent months decrying what they understood to be a freeze on settlement constructed inflicted upon them by Netanyahu. Gush Etzion Regional Council Head Shlomo Ne’eman said:

“Sometimes we take our prime minister to task, which we feel is justified as a result of our disappointment in postponing the application of sovereignty over our country. But now something tangible is happening – we are building and developing our communities, and of course, the highlight of today is the full registration in the Land Authority of the young community of Pnei Kedem, 20 years since it was established.”

Samaria Regional Council head Yossi Dagan said:

“This is a happy day for Samaria. [New construction] in Har Bracha, Yitzhar, Einav and Tapuach is another step on the way to a million residents in this beautiful region of the country…While we’re very content with today’s developments, I call on the Prime Minister not to stop here. We’re overfilled with joy, but it is a drop in the ocean with sovereignty falling off the agenda. The expectation now is that construction and strengthening of the settlement movement will increase tenfold.”

Peace Now responded to the approvals in a statement saying:

“While Israel reels from its second lockdown and economic distress, Netanyahu is promoting construction in isolated settlements that Israel will have to evacuate. Instead of taking advantage of the agreements with the Gulf states and promoting peace with the Palestinians, he is distorting Israel’s priorities and catering to a fringe minority for these settlement unit approvals that will continue to harm future prospects for peace. We call on the Defense Minister and the Alternative Prime Minister Benny Gantz to veto these plans. Far from a ‘settlement freeze,’ the right has been complaining about, the expected settlement approvals announcement next week prove that the settlement enterprise under Netanyahu is moving ahead at full steam toward solidifying the de facto annexation of the West Bank. The move also will be the first major demonstration of Defense Minister Benny Gantz’s bowing to the ‘Greater Israel’ settlement agenda that would in reality bring about a permanent undemocratic one-state reality. By doing so, Israel will be signaling to the world its bi-partisan support for the end to the concept of a two-state solution and a Palestinian state – the paradigm that until now has largely shielded Israel from formal pressure over its 53-year occupation. The settlement enterprise is not in Israel’s national or security interest, and is a strategic mistake at the international level.”

Palestinian Prime Minister Mohammed Shtayyeh denounced the approvals, saying:

“Every settler unit constitutes a plan to annex our land.”

Palestinian Authority spokesman Nabil Abu Rudeineh said in a statement

“We warn against this Israeli policy that will lead the region to the brink of the abyss, and we call on the international community to intervene immediately and urgently to pressure the Netanyahu government to stop this settlement madness that totally eliminates any real opportunity to achieve a just and comprehensive peace to end the occupation and establish the independent Palestinian state with East Jerusalem as its capital on the 1967 borders.”

UN High Representative Josep Borrell said in a statement:

“In recent days, Israel has announced a significant expansion of settlements in the occupied West Bank, in areas in and around Jerusalem. These plans, which foresee the construction of close to 5.000 housing units, jeopardise the viability and territorial contiguity of a future Palestinian State as the outcome of a negotiated two-state solution, in line with the internationally agreed parameters. Settlements are illegal under international law. As stated consistently, the EU will not recognise any changes to the pre-1967 borders, including with regard to Jerusalem, other than those agreed by the parties. Settlement activity threatens current efforts to rebuild trust, to resume civil and security cooperation between Palestinians and Israelis and to prepare the ground for an eventual resumption of meaningful and direct negotiations. The Government of Israel should reverse these decisions and halt all continued settlement expansion, including in East Jerusalem and sensitive areas such as Har Homa, Givat Hamatos and E1. The period from March to August 2020 also saw a spike in demolitions or confiscations of Palestinian-owned structures in the West Bank in spite of the COVID-19 pandemic. The EU reiterates its call on Israel to halt all such demolitions, including of EU-funded structures, in particular in light of the humanitarian impact of the current pandemic. Against the background of normalization of relations between Israel, UAE and Bahrain, Israelis and Palestinians should seize this opportunity and take urgent steps to build confidence and restore cooperation along the line of previous agreements and in full respect of international law.”

A spokesperson for UN Secretary-General Antonio Guterres issued a statement flagging concern over the advancements, saying:

“We are concerned about the reports of Israel’s settlement advancements in the occupied West Bank and will continue to follow developments closely, as the Israeli High Planning Committee finalizes its meetings tomorrow. The Secretary-General has consistently reiterated that all settlements are illegal under international law and remain a substantial obstacle to peace. We urge the Israeli authorities to refrain from such unilateral actions that fuel instability and further erode the prospects for resuming Palestinian-Israeli negotiations on the basis of relevant UN resolutions, international law and bilateral agreements.”

Plan for 570 Units in East Jerusalem Settlement Approved for Deposit

Ir Amim reports that on September 22nd, the Jerusalem District Committee approved for deposit for public review a detailed plan providing for the construction of 570 units in the Har Homa E settlement, located in East Jerusalem. Taken together with the pending construction of the nearby Har Gilo West settlement (discussed in the section above), the Palestinian village of al-Walajah stands to be completely encircled by Israeli settlements. 

If implemented, this plan will extend the Har Homa settlement westward, in the direction of the site of the as-of-yet-unbuilt Givat Hamatos settlement. Ir Amim explains:

If realized, Har Homa E together with construction in Givat Hamatos will connect Har Homa to Gilo creating a contiguous Israeli settlement area that will disconnect East Jerusalem from Bethlehem and the south of the West Bank.”

Ir Amim also reminds us that the Jerusalem District Committee previously approved a Master Plan for a total of 2,200 units in Har Homa E. The plan for 570 units approved for deposit in late September represents the first detailed plan under this Master Plan allows for. Plans to build the remaining units permitted under the Master Plan are not yet being advanced.

Israel Approves Construction of Elevator at Tomb of the Patriarchs

Emek Shaveh reports that on September 29th the Civil Administration granted final approval to a plan to build accessible infrastructure, including an elevator, at the Ibrahimi Mosque/Tomb of the Patriarch in Hebron — a plan which requires Israel to seize land from the Islamic Waqf.  As of this writing, Emek Shaveh is considering whether to challenge that approval.

Regarding the significance of the plan, Emek Shaveh said:

“One need not be an archaeologist or architect to review the council’s plan and understand that it is destructive in a manner which is unprecedented. We are convinced that the plan, as approved, would never have been promoted had it not been driven by political motives.”

Emek Shaveh has previously provided critical context as to why this plan is not really, or not fully, being advanced out of humanitarian concerns, explaining:

“Israel’s decision to seize responsibility for the site from the Hebron municipality and the Palestinians sends a clear political message that Israel is reneging on agreements that were signed with the Palestinians in Hebron.  Beyond the precedent that will enable the settlers in the future to demand additional changes at the Tomb of the Patriarchs/Ibrahimi Mosque, this is also a precedent that could play out at other sites under the responsibility of the Islamic Waqf. Experience has shown us that what begins in Hebron percolates into other places including Jerusalem.  It begins with a seemingly rational demand to benefit the disabled or the general public and evolves into a new status quo.  The expected change in Hebron has not escaped the attention of members of the Temple movement and they will know how to present their demands to the government.  If Israel can repudiate agreements with the Palestinians in Hebron and expropriate land from the Waqf, it would seem that accepting what appears to be the far more modest demands by the Temple movement to pray or to walk about the Temple Mount complex freely is not so far-fetched. In the reality of Hebron and East Jerusalem, a change involving only several meters at a historic or holy place is not free of political considerations and often it is part of long-term strategy.  While it is necessary to tend to the needs and interests of persons with disabilities, the extremists who presume to speak on their behalf must be prevented from forging Israeli policy, even if it is only a matter of a lift and an access path.”

Israel Delivers Confiscation Notices to Palestinians Living in the Heart of Hebron

The Palestinian media outlet WAFA news reports that several Palestinians living in the Tel Rumeida section of downtown Hebron were handed confiscation notices from the Israeli authorities, informing them that the State of Israel had confiscated 17 plots of land, including land privately owned by Palestinians. 

Tel Rumeida is a part of Hebron located directly in the city center, considered H2 by the Hebron Accords giving Israel full control of security in that area. B’Tselem estimates that there are around 700 settlers living in enclaves amongst approximately 34,000 Palestinians in H2. The Israeli army heavily protects those settlers, and has implemented an apartheid system of segregated movement and checkpoints, most notably in the area of Shuhada Street.

Palestinians Report Newly Established Outposts & Land Confiscations

The Palestinian news outlet WAFA reports that settlers have installed three new outposts over the past month – one near Nablus and a second near Hebron, and a third in the Jordan Valley.

Near Nablus, Palestinians report that the settlers installed mobile homes and a small farm in an attempt to establish a permanent presence on a new plot of land. The settlers are reportedly in the process of connecting the new outpost to the Elon Moreh settlement via roads and water supply.  Ghassan Daghlas, who monitors Israeli settlements on behalf of the PLO, told WAFA that the specific area has seen even wider road construction recently, which he sees as an effort to create more seamless contiguity between settlements in the Nablus area and the Jordan Valley. The construction comes at the direct expense of the Palestinian village of Beit Dajani, which has historically owned the land where the outpost and roads are being built.

Near Hebron, WAFA reports that an Israeli settler erected a tent with and Israeli flag on privately owned Palestinian land near the Birin village.

In the Jordan Valley, WAFA reports that settlers set up a caravan on land on which they began planting trees about three months ago. The settlers also reportedly dug a well at the site. 

On October 15th, Israel reportedly announced its intention to confiscate large tracts of land (11,000 dunums) adjacent to the Jordan Valley settlements of Rotem, Maskiyot, and Mesovah. This confiscation, according to Palestinian settlement watcher Qasem Awwad, was presented by the Israeli authorities as a move to add land to natural reserve areas, but seems clearly to be linked to efforts to expand settlements and their control over land in the area.

Targeting Palestinians Construction in Area C: State Devotes $6 million to Mapping Program

Despite COVID and the suspension of Israeli’s unilateral annexation of vast tracts of land in the West Bank, the Israeli government — at the urging of settlers and their allies — is continuing its push to consolidate its control over all aspects of life in Area C (the over 60% of the West Bank that is under full Israeli control). 

OCHA has documented an acceleration in the Civil Administration’s demolition of Palestinian structures in the West Bank over the summer, documenting the demolition of 389 Palestinian-owned structures in Area C of the West Bank.  As a result of those demolitions, 442 Palestinians were made homeless. OCHA further reported that In just the month of August, 205 Palestinians lost their homes, the highest single month total since January 2017. In addition, Israel continues to issue more demolition notices, including against Palestinians living in a cave near Jenin, and against a newly constructed school for bedouin children located east of Ramallah.

To further this effort, on September 10th the Israeli government allocated $6 million USD (20 million NIS) for the newly created Settlement Affairs Ministry to survey and map unauthorized Palestinian construction in Area C of the West Bank, which Israel and its settlers have been aggressively demolishing in an effort to rid the area of Palestinians. Haaretz reports that this is the first time that the state budget has included funds specifically for a land survey in the West Bank. The state also allocated an additional $2.8 million (9.5 million NIS) to an existing grant program specifically for settlement municipalities to cash in on. As a reminder, virtually all Palestinian construction in Area C of the West Bank is unauthorized, because Israel almost universally refuses to give Palestinians permission to build in Area C even on land that Israel recognizes as owned by Palestinians. 

The Settlement Affairs Ministry is a new creation of the current coalition government, and is headed by Tzachi Hanegbi (Likud). The funding for the Settlement Affairs Ministry to conduct a survey of unauthorized Palestinian construction in Area C further empowers a domestic Israeli body to exert extraterritorial sovereignty over Area C – in effect, treating the area as land already de facto annexed by Israel. While technically the occupied territories are administered by the Israeli Civil Administration (a body within the Defense Ministry), Israel has spent decades bringing the administration of the territories (specifically the settlements and Area C) ever more directly under direct Israeli sovereignty (de facto annexation). 

In the lead up to the allocation of funds for this new survey of Palestinians life in Area C, the Knesset hosted two committee discussions the political outlook of which was clearly indicated in the stated subject of the meetings: “the Palestinian takeover of Area C.” Consistent with this framing (which is predicated on the idea that Area C belongs to Israel), and pushed by outside groups, many members of the Knesset have criticized the Israeli government’s allegedly lackadaisical approach to preserving State interests in Area C (i.e., clearing out Palestinians, expanding settlements, consolidating state infrastructure). Reportedly, Foreign Affairs Minister Gabi Ashkenazi (Blue & White) sent a letter to the committee specifically addressing the Knesset’s outrage over European humanitarian assistance projects for Palestinians in Area C. In the letter, Ashkenazi not only celebrated the reduction of European projects over the past year, but validated settlers’ insinuations regarding the nefarious nature of European assistance for Palestinians, saying that any European activity in the West Bank lacking Israeli permission is “an attempt to define a border.” Ashkenazi also said that Israel will not compensate European donors for confiscated equipment or the demolition of European-funded projects that lack Israeli permission (like in the case of schools built with European funding, and solar panels donated to bedouin communities lacking power). 

At one Knesset hearing, MK Bezalel Smotrich (Yamina) suggested that a solution could be to empower the settlements with the ability to demolish Palestinian construction they believe to be unauthorized. Smotrich’s partymate Ayelet Shaked (former Justice Minister) suggested that the government should appoint a project manager tasked with preventing a Palestinian takeover of Area C.

As noted above, Israel has long denied Palestinians the ability to build in Area C. To fully understand what is happening, it is worth reviewing B’Tselem’s excellent explainer:

“Israel’s planning and building policy in the West Bank is aimed at preventing Palestinian development and dispossessing Palestinians of their land. This is masked by use of the same professional and legal terms applied to development in settlements and in Israel proper, such as “planning and building laws”, “urban building plans (UBPs)”, “planning proceedings” and “illegal construction”. However, while the planning and building laws benefit Jewish communities by regulating development and balancing different needs, they serve the exact opposite purpose when applied to Palestinian communities in the West Bank. There, Israel exploits the law to prevent development, thwart planning and carry out demolitions. This is part of a broader political agenda to maximize the use of West Bank resources for Israeli needs, while minimizing the land reserves available to Palestinians….

In the West Bank, the potential for urban, agricultural and economic development remains in Area C. Israel uses its control over the area to quash Palestinian planning and building. In about 60% of Area C – 36% of the West Bank – Israel has blocked Palestinian development by designating large swathes of land as state land, survey land, firing zones, nature reserves and national parks; by allocating land to settlements and their regional councils; or by introducing prohibitions to the area now trapped between the Separation Barrier and the Green Line (the boundary between Israel’s sovereign territory and the West Bank).

Even in the remaining 40% of Area C, Israel restricts Palestinian construction by seldom approving requests for building permits, whether for housing, for agricultural or public uses, or for laying infrastructure. The Civil Administration (CA) – the branch of the Israeli military designated to handle civil matters in Area C – refuses to prepare outline plans for the vast majority of Palestinian communities there. As of November 2017, the Civil Administration had drafted and approved plans for only 16 of the 180 communities which lie in their entirety in Area C. The plans cover a total of 17,673 dunams (1 dunam = 1,000 square meters), less than 1% of Area C, most of which are already built-up. The plans were drawn up without consulting the communities and do not meet international planning standards. Their boundaries run close to the built-up areas of the villages, leaving out land for farming, grazing flocks and future development. Since 2011, seeing that the Civil Administration did not draft plans as it is obliged to do, dozens of Palestinian communities – with the help of Palestinian and international organizations and in coordination with the PA – drafted their own plans. Some of the plans covered communities or villages located in full in Area C and others covered places only partly in Area C. As of September 2018, 102 plans had been submitted to the Civil Administration’s planning bodies, but by the end of 2018, a mere five plans – covering an area of about 1,00 dunams (or about 0.03% of Area C) – had received approval.

The odds of a Palestinian receiving a building permit in Area C – even on privately owned land – are slim to none. Given the futility of the effort, many Palestinians forgo requesting a permit altogether. Without any possibility of receiving a permit and building legally, the needs of a growing population leave Palestinians no choice but to develop their communities and build homes without permits. This, in turn, forces them to live under the constant threat of seeing their homes and businesses demolished.

The impact of this Israeli policy extends beyond Area C, to the hundreds of Palestinians communities located entirely or partially in Areas A and B, as the land reserves for many of these communities lie in Area C and are subject to Israeli restrictions there.

The demand for land for development has grown considerably since the 1995 division of the West Bank: The Palestinian population has nearly doubled, and the land reserves in Areas A and B have been nearly exhausted. Due to the housing shortage, much land still available in these areas is used for residential construction, even if it is more suited for other uses, such as agriculture.

Without land for construction, local Palestinian authorities cannot supply public services that require new structures, such as medical clinics and schools, nor can they plan open spaces for recreation within communities. Realizing the economic potential of Area C – in branches such as agriculture, quarrying for minerals and stone for construction, industry, tourism and community development – is essential to the development of the entire West Bank, including creating jobs and reducing poverty. Area C is also vital for regional planning, including laying infrastructure and connecting Palestinian communities throughout the West Bank.

In contrast to the restrictive planning for Palestinian communities, Israeli settlements – all of which are located in Area C – are allocated vast tracts of land, drawn up detailed plans, connected to advanced infrastructure, and the authorities turn a blind eye to illegal construction in them. Detailed, modern plans have been drawn up for the settlements, including public areas, green zones and, often, spacious residential areas. They enjoy a massive amount of land, including farmland that can serve for future development.

Israel’s policy in Area C is based on the assumption that the area is primarily meant to serve Israeli needs, and on the ambition to annex large parts of it to the sovereign territory of Israel. To that end, Israel works to strengthen its hold on Area C, to further exploit the area’s resources and achieve a permanent situation in which Israeli settlements thrive and Palestinian presence is negligible. In doing so, Israel has de facto annexed Area C and created circumstances that will leverage its influence over the final status of the area.”

In First, Palestinian Authority Courts to Hear Lawsuits Against Settlers

For the first time since the Palestinian Authority was established in 1994, it will allow Palestinians to bring lawsuits against Isareli settlers in Palestinian courts. The Palestinian Authority’s Justice Minister Mohammed al-Shalaldeh announced that the PA had formed a national team to handle these cases, and the team was already working to collect evidence and file suits against settlers who have committed crimes against Palestinians in Hebron and in the village of Burin, located just south of Nablus.

Until this point, no Israeli citizen has been tried in a Palestinian court. Under the Oslo Accords (which established the Palestinian Authority), the Palestinian Authority holds no jurisdication over Israeli citizens – including Israeli citizens living in the West Bank. In May 2020, PA President Mahmoud Abbas announced that the PA considers all accords and agreements with Israel to be void following Israel’s announcement that it intends to annex large parts of the West Bank in accordance with the Trump Plan. Shalaldeh said that the announcement this week flows directly from Abbas’s decision to free the PA from the Oslo Accords’ provisions.

Explaining how these cases might work, Shalaldeh said

“The Israeli side will be notified as an occupying power to appear before the Palestinian court…If the [Israeli] side refuses the jurisdiction of the Palestinian courts, formal procedures will be followed and in absentia rulings will be issued, in accordance with Palestinian laws.”

JNF, Elad Face International Heat Over Sumreen Family Eviction Case – Will it Matter?

Over the past month, international audiences have directed heightened scrutiny towards the radical settler group Elad and the Jewish National Fund (JNF) for the role both organizations have played in spearheading the effort to evict the Palestinian Sumreen family from their home in the Silwan neighborhood of East Jerusalem. Due to the new attention, the JNF is reportedly reconsidering whether or not to carry out the eviction of the Sumreens – an eviction which the organization has pursued since 1991.

JNF donors – along with activists, religious leaders, members of Congress, and Israel prize winners – reportedly began to express concern and outrage over the JNF’s role in the Sumreen case following the September 2020 ruling by Jerusalem Magistrate’s Court against the Sumreen’s claim to the home. In response to the criticism, the JNF (via actions by the Board of its subsidiary organization, Himnuta, which was created to take the lead for JNF in litigating aggressive settlement takeover cases like this) has acted to freeze the eviction process internally, and was scheduled to consider a proposal for freezing the formal legal proceedings against the Sumreens this past week. Himnuta’s decision and deliberations  caused conflict with Elad, which had the Jerusalem Magistrate’s Court intervene to postpone Himnuta’s Board meeting to discuss the proposal. Elad argues that Himnuta transferred all legal authority over the Sumreen case to their organization, and cannot now interfere in the proceedings. The meeting was subsequently postponed at the request of the Court.

Elad is also coming under new international scrutiny following the revelation that Roman Abramovitch – a Russian oligarch and naturalized Israeli citizen who also is one of the owners of the renowned Chelsea football club – is Elad’s single largest donor, having anonymously donated over $100 million to the settler group over the past 13 years. The BBC produced an investigative feature report on Abramovitch’s connection to Elad, pointing out that over the past 15 years more than half of Elad’s funding has come from offshore companies in the Caribbean, which are now known to be owned or controlled by Abramovitch. The BBC feature connects Elad to the settlers’ struggle to evict the Sumreen family, and the larger effort to replace Palestinians in Silwan with Jewish Israelis. 

Peace Now writes:

“The news about Abramovich’s involvement highlights the injustice Palestinians face at the hands of these settlement groups. Impoverished families are up against the financial weight of a Russian oligarch. NGOs trying to protect these families are delegitimized and their work dismissed for receiving funding from democratic European aid agencies while settler groups rake in vast sums of non-transparent money from offshore Caribbean shell companies. And the JNF is profiting off of all of this. We can’t force Abramovich to stop his funding or the JNF to stop abetting Elad in its settling campaign, but we can make them worry about their reputation. Peace Now has been conducting a campaign inside Israel to call Abramovich out for his devious funding.”

Regarding the revelations of Elad’s funding source, Emek Shaveh writes:

“…the Elad Foundation, through a combined strategy of sponsoring excavations, developing tourism and settling in Palestinian homes, succeeded in recreating Silwan as the Jewish neighbourhood of Ir David (City of David) and one of the most popular tourist destinations in the country. The exploitation of archaeological tourism by the Elad Foundation has become a number one strategy for entrenching Israeli sovereignty over historic Jerusalem. “

The Sumreen family home is located in the middle of what today has been designed by Israel “the City of David National Park.” The area is managed by the radical Elad settler organization, which for years has also been pursuing the eviction of Palestinians from the homes in Silwan. For nearly three decades, the Sumreen family has been forced to battle for legal ownership of their home, after the state of Israel, prompted repeatedly by the JNF, declared the Sumreen’s home to be “absentee” property. After that designation – which was not communicated to the Sumreen family – Israeli law permitted the state to take over the rights to the building. The state then sold the rights to the home to the JNF in 1991. The JNF has pursued the eviction of the Sumreen family ever since. Israeli courts ruled in favor of the Sumreen family’s ownership claims to the home for years, until a September 2019 ruling by the Jerusalem Magistrate’s Court granted ownership of the family’s home to the JNF, a decision the family immediately appealed to the Jerusalem District Court.

Report: U.S. Will Not Back De Jure Annexation Until 2024 [But Friedman Says 2021 Is in Play]

A series of reports in mid-September suggested that, as part of its commitment to the U.A.E. in exchange for normalization with Israel, the U.S. promised to withhold its recognition of Israeli annexation until January 2024, at the earliest.

The 2024 timeline harkens back to a concept in Trump’s “Deal of the Century” which gave (oh so generously) the Palestinians a four year window to enter into negotiations with Israel on the basis of the Trump Plan’s conceptual map.

Following these reports regarding a 2024 timeline for the U.S. greenlighting Israeli annexation, U.S. Ambassador David Friedman (who has been a champion of annexation) told Israel’s Army Radio that annexation can happen next year. Friedman, pushing back on U.A.E. press leaks seeking to promote the notion that the Abraham Accords stopped annexation, said:

“We said in our statement that sovereignty will be postponed, and this does not mean that it has been abolished, but rather that it has stopped. It has been suspended for a year, maybe more, but it has not been cancelled.”

In Largest Settlement Surge Since Trump, Israel Advances Plans for 3,659 Settlement Units – Including Plan to Retroactively Legalize the Haresha Outpost

Following up on FMEP’s reporting last week, on April 4th the Israeli Civil Administration Higher Planning Council (the body responsible for regulating all construction in the occupied West Bank) advanced plans for at least 3,659 settlement units, including a plan to retroactively legalize homes in the unauthorized Haresha outpost.

This is the largest batch of settlement plans advanced at one meeting by the High Planning Council since President Trump took office in January 2017; previous High Planning Council meetings (which happen every three months, per a reported agreement with the U.S. Administration) advanced plans on the order of 1,000 to 2,000 units.

Of the total units advanced on April 4th, the High Planning Council granted final approval for 1,226 new settlement, to be built entirely on the west side of the Israeli separation wall. These are:

  • In Beitar Illit:
    • 31 new units
    • A 100 room building for the elderly, or a hotel
    • Map by Peace Now

      A new pedestrian bridge over privately owned Palestinian land for Israeli settlers to use on the Sabbath (when observant Jews do not drive, and had to walk a long route in order to reach other parts of the settlement). 

  • 603 new units in Maale Adumim
  • A plan to retroactively legalize residential units in the Sde Bar settlement; Peace Now has not yet verified how many units are involved in this plan. Sde Bar was first established as an outpost of the Nokdim settlement in 1998, but Israel granted full approval to that outpost, recognizing it as an educational institute and a full-fledged settlement, in 2005. Settlers recently built a residential neighborhood there without Israeli authorization. The plan approved by the council on April 4th will grant retroactive authorization to those residential settlement units.
  • 289 new units in the Alon settlement, located on the Palestinian side of the separation wall within sight of the Khan al-Ahmar bedouin village that Israel is prepared to forcibly relocate. There are plans to expand the neighboring Kfar Adumim settlement to takeover the land where Khan al-Ahmar currently stands.
  • 110 new units in the Givat Zeev settlement.
  • 108 new units in the Etz Efraim settlement.
  • 85 new units in the Karnei Shomron settlement.

Of the total units advanced on April 4th, the High Planning Council also approved for deposit for public review plans for 2,433 new settlement units, the majority of which (1,198) will be built on the east side of the Israeli separation barrier, including:

  • 1000 units in Efrat
  • A plan to retroactively legalize 720 units in the Haresha outpost. This is part of the Israeli government’s ongoing efforts to retroactively legalize the outpost, which hinges on Israel’s ability to build a legal access road to the outpost. The Israeli government has found several creative solutions to that problem – like building a tunnel or building a bridge – all of which will undoubtedly infringe on the property rights and livelihoods of the Palestinian land owners.
  • 210 units in Shiloh – expanding the footprint of the settlement to its north
  • 147 units in Ariel.
  • 147 units in Mitzpe Yericho.
  • 114 units in Elon Moreh.
  • 73 new units in Beitar Illit (in addition to the final approvals covered previously).
  • 66 units in Oranit.
  • 42 more units in Givat Zeev.
  • 32 units in Beit Arie.
  • 7 new units in Rehelim.
  • An unverified number of new units in the following settlements: Paduel, Karnei Shomron, and Elkana.

Peace Now said in response:

“Netanyahu has decided, officially or unofficially, to annex the West Bank to Israel, otherwise one cannot explain the promotion of thousands of units for Israelis in the Occupied Territories. The construction of the settlements only makes it harder to end the occupation and to get to a two states peace agreement and is bad for the Israeli interest to remain a democratic and secured state.”

Housing Ministry Publishes Tenders for 956 Settlement Units

On April 4th the Israeli Ministry of Housing and the Israel Lands Authority met and published tenders for the construction of 956 new settlement units, including commercial complexes; 106 tenders are for plans in settlements east of the separation barrier. These units are in addition to the 3,659 units advanced this week by the Civil Administration’s High Planning Council (discussed above).

The published tenders are:

  • 250 units in the Elkana settlement.
  • 195 units in the Ariel settlement.
  • 118 units in the Ofarim settlement.
  • 112 in the Alfei Menashe settlement.
  • 111 units in the Oranit settlement.
  • 62 in the Adam (Geva Binyamin) settlement, located east of the separation barrier.
  • 50 in the Emmanuel settlement.
  • 44 units in the Maale Ephraim settlement, located east of the separation barrier.
  • 14 units in the Beitar Illit settlement

As Peace Now explains, “some of the tenders are for units that were published in previous tenders but were not sold. The new tenders mean that the government is currently seeking to promote and build those units although failed to do so in the past.”

Ariel Medical School Gets Approval, But Faces High Court Petition

On April 12th, the Israel Higher Education Council voted to approve a new medical school in Ariel University, located in the West Bank settlement of Ariel. This approval contravenes the normal practice of the council, in that it ignores a vote to reject the school by the Higher Education Council’s own professional subcommittee. The medical school is slated to open this fall with significant financing from American casino magnate (and Trump supporter/financial backer) Sheldon Adelson.

However, the High Court of Justice is set to hear a petition regarding the unusual and scandal-ridden process by which the school gained approval at various stages of the planning process. The petition was filed by two Israeli academics – Prof. David Harel of the Weizmann Institute of Science and Prof. Alon Harel of the Hebrew University of Jerusalem – asserting that the approval “casts a heavy shadow on the decision making process in higher education.” It is unclear how the outcome of the petitions might affect the newly approved plan to open the medical school this fall.

Settlers Celebrate Right-Wing Election Victory

Settlers are mostly celebrating the results of Israel’s April 9th elections (in which West Bank and East Jerusalem Palestinians could not vote), which delivered incumbent Prime Minister Netanyahu an opportunity to form and lead the next government.

As has come to be expected, Netanyahu made an 11th hour election pitch by promising to start the process of annexation if he was reelected. Settlers received Netanyahu’s annexation promise and his reelection with predictable enthusiasm. The Yesha Council released a congratulatory statement saying:

“This morning we can say with certainty: In the face of all the campaigns and manipulations, the people of Israel chose the right. The people expressed their loyalty to the Land of Israel and chose in favor of applying Israeli sovereignty over Judea, Samaria and the Jordan Valley. We congratulate Prime Minister Benjamin Netanyahu on his election, and look forward to the establishment of a strong and broad right-wing government. In the next Knesset, too, we will continue to build, expand, legalize and jointly develop Israeli communities in the region.”

Not all settlers believe that Netanyahu will deliver on his promise to annex the settlements, but generally speaking, settlers dismiss the “will he/won’t he” debate (perhaps correctly) as a political decision that does not impact the reality of their presence on the ground.

Peace Now issued a sharp statement on the election results:

“Now the settlement lobby and its re-elected backers in the Knesset are doing what they know best – extorting and manipulating to save Netanyahu from prosecution in exchange for his compliance in working toward annexation. We at Peace Now were never relying on the election to change reality, but rather see grassroots public engagement as the only way to build pressure on the government. Now that Netanyahu has let the annexation genie out of the bag with his pre-election rhetoric, we stand even more equipped to go on the offense by showing fellow Israelis the bleak future the settler lobby and its Knesset backers are leading us, and what viable alternative path Israel can take toward a more prosperous, democratic, secure future.”

AirBnb Reverses Settlement Policy

On April 9th, AirBnB announced that it had reversed its decision to remove rental listings located inside of Israeli settlements in the occupied West Bank, despite previously acknowledging that settlements are at the core of the dispute between Israelis and Palestinians,” and that the listings there “contribute to existing human suffering.”

AirBnB’s new announcement acknowledges (again) that settlements are “central to ongoing tensions,” but says it will nonetheless continue to allow those listings to remain on their website. Giving a nod to the controversial nature of this decision, AirBnB promised to donate all profits derived from West Bank settlement listings to humanitarian groups, but it conspicuously specified that these will be humanitarian groups working in other parts of the world (as opposed to with the Palestinians).

Omar Shakir, the Israel/Palestine Director at Human Rights Watch – which issued a significant and damning report on the issue of tourism being used to normalize occupation –  tweeted in reaction:

“Disappointing @Airbnb decision reverses their stance to fully respect rights. Donating profits from unlawful settlement listings does nothing to remedy ‘human suffering’ they’ve acknowledged causing. By continuing to do business in settlements, they remain complicit in abuses.”

Along with AirBnB’s policy reversal, it settled several lawsuits filed against AirBnB in U.S. courts. FMEP President Lara Friedman tweeted on this important element:

“And just like that, US courts let themselves becomes weapons used to legitimize the violation of intl law, the re-definition of ‘lsrael’ to mean ‘all the land between the river and the sea,’ & the re-definition of ‘anti-Semitism’ to mean ‘refusal to endorse/normalize occupation.’ This is part of a broader trend that very few people are paying any attention to, which is a dangerous mistake. By the time folks wake up it will likely be too late. [link to: https://forward.com/opinion/417058/opinion-the-surprising-new-battleground-in-the-war-against-palestinian/]”

The Center for Constitutional Rights – which recently intervened in the legal cases involving AirBnB –  issued a response saying:

We are dismayed that Airbnb has caved to the legal bullying of Israeli settlers and re-listed properties in illegal settlements in occupied Palestinian territory. Airbnb’s decision reflects an alarming lack of commitment to human rights. When we filed counterclaims on behalf of the Palestinians who actually own the land the listed properties unlawfully sit on, we laid out the international and domestic law violations committed by the settlers, including war crimes and crimes against humanity. In backing down from its decision not to list properties in occupied Palestinian territory, Airbnb is in breach of its international human rights obligations, and is discriminating against Palestinians.”

Amnesty International – which also published a report on the complicity of online rental companies who list properties in East Jerusalem and the West Bank – said in response to AirBnB:

“Airbnb’s decision to continue to allow accommodation listings in illegal Israeli settlements in the occupied West Bank is a reprehensible and cowardly move that will be another devastating blow for the human rights of Palestinians…Airbnb are trying to absolve themselves by stating they will donate the profits from these listings to charity, but that fails to change the fact that by continuing to drive tourism to illegal settlements they are helping to boost the settlement economy. In doing so, they are directly contributing to the maintenance and expansion of illegal settlements, a breach of the Geneva Conventions and a war crime under Rome Statute of the International Criminal Court. Airbnb had a clear opportunity to make the right decision to uphold human rights and use their influence to set a precedent in the tourism industry. Instead, they have chosen to bury their heads in the sand – ignoring blatant evidence that they are helping to fuel violations that cause immense suffering to Palestinians. Airbnb’s reversal demonstrates why we can’t just rely on companies to take the right decisions, and that we need governments to fulfil their obligations by intervening and passing laws obliging their companies to respect human rights.”

U.S. Ambassador Friedman Touts East Jerusalem Settlement Business as “Path to Peace”

U.S. Ambassador David Friedman tweeted his support for the new Rami Levy mall,  located in the Atarot settlement industrial zone within sight of Ramallah but inside the security barrier and within Israel’s municipal border, as expanded by Israel after the 1967 war.

Friedman said:

“Great morning at the new Atarot Mall in northern Jerusalem, anchored by a Rami Levy Supermarket. Was given a tour by Rami Levy himself. Israelis and Palestinians working, shopping and doing business together — a simple path to peace!”

FMEP President Lara Friedman tweeted in response:

“Amb Friedman & co’s special notion of peace, based on racist notion that unlike Jews who for 1000s of years refused to forsake their history/narrative, Palestinians will be beaten into submission or bribed into giving up basic human demand for freedom & equal rights.”

When the Rami Levy mall opened in January 2019, FMEP explained:

“The massive new mall is the crown jewel of the shopping empire built by Israeli businessman Rami Levy, who already operates a network of supermarkets in settlements. Like all of Levy’s projects (and settlement industrial zones in general), the new mall is branded as a socially-conscience, ‘coexistence’-building business initiative, with Levy and government officials praising the fact that the new mall will attract both Israeli and Palestinian shoppers and be home not only to Israeli businesses, but to to a few Palestinian-owned/operated businesses as well.”

The ‘coexistence’ argument is dismantled by the Israeli watchdog group Who Profits, which explained:

“The Jerusalem mall would mark a new stage in Levy’s involvement in the occupation economy…[which] began with providing services to Israeli settlers and continued with the exploitation of Palestinians as a cheap labor force in his supermarkets. He now appears to be turning his attention to massive construction projects on occupied Palestinian land and the exploitation of a Palestinian captive market in the East Jerusalem…Rami Levy is in a position that would allow him establish a large mall on “virgin land” because the Israeli authorities have prevented Palestinian businesses from competing with Israelis. Levy’s plan would take advantage of the fact that Palestinians do not have other large-scale retail facilities. A flourishing market in Bir Nabala was destroyed by Israel’s wall in the West Bank. And venturing into West Jerusalem is not an option for Palestinians, most of whom live below the poverty line. Although there is every likelihood that the Israeli authorities will portray Levy’s mall as beneficial to Palestinians, there are important facts to be remembered. Palestinians entering his mall will not be exercising the right of a consumer to informed choice. Rather, they will be captive clients — belonging to an occupied people.”

Israel Nears Final Move to Carry Out Massive Land Theft to “Regulate” Illegal Outposts

As has become routine, Israeli settlers and their allies in government are exploiting the recent deaths of three Israelis (two soldiers and a baby) at the hands of Palestinian attackers as an opportunity to accelerate settlement-related activities. This includes advancing new legislation and  accelerating/expanding the application of new legal tools designed to entrench and expand the permanence of some of the most radical Israeli settlers living in isolated outposts across the West Bank.

If implemented, the plans and legislation detailed below (and in last week’s settlement report) will expropriate huge amounts of land that even Israel recognizes as privately owned by Palestinians, in order to retroactively legalize Israeli outposts scattered across the West Bank. Such a move will complete what has been a gradual but steady formal suspension of even the pretense of maintaining the rule of law with regard to Israeli settlers’ or the Israeli government’s’ actions in the West Bank (which comes on top of Israel’s official and open contempt for international law). As Haaretz columnist Zvi Bar’el writes:

“The legal criminality that the government invented in honor of the settlers… is an unbridled attack on the rule of law, the undermining of Palestinian landowners’ right to appeal at the High Court, and the destruction of the planning and building system. And mainly, it turns terror into a real estate perk for lawbreaking extortionists.”

Americans for Peace Now said:

“In reaction to murderous terrorist attacks targeting West Bank Jewish settlers and Israeli soldiers, the government of Israel has come under pressure from the settlers to exact retribution against Palestinians. Two of the measures adopted are bound to open the floodgates for the legalization of existing settlement-outposts and the establishment of new ones.”

Ministers Back a Bill to Legalize 66 Outposts

On December 16th, the Israeli Cabinet voted unanimously to give government backing to a bill (called “Regulation Law 2” or the “Young Settlement Bill”) that directs the government to treat 66 illegal outposts built on privately owned Palestinian land as legal settlements, while giving the government 2 years to find a way to retroactively legalize those outposts.

The bill, proposed by MK Bezalel Smotrich (Habayit Hayehudi) and MK Yoav Kisch (Likud), also freezes any/all legal proceedings against the outposts  and requires the government to connect the outposts to state infrastructure including water, electricity, provide garbage removal, and also approve budgets for them. The law also allows the finance minister to guarantee mortgages for settlers seeking to buy units in these outposts, even before the legal status of the land is resolved (a remarkable state-directed violation of normal practices in the mortgage industry). With government backing, the bill will now be introduced in the Knesset, where it must pass three readings before becoming law.

Though this bill has been ready for months, the Cabinet decided to advance the bill now in response to recent Palestinian terror attacks. MK Smotrich said: “This is the definitive answer to the murderous terrorism of the Arabs.” This sentiment was echoed widely across the settler movement.

The Cabinet voted to support the bill despite strong opposition from the Israeli Attorney General’s office. Deputy AG Ran Nizri told the Cabinet ahead of the vote that the bill has “significant legal problems,” represents a sweeping violation of the property rights of Palestinians in the West Bank, and will likely face a drawn out Court battle that might result in the High Court of Justice overturning the law. Notwithstanding these seemingly principled arguments opposing this tactic for legalizing outposts, it should be recalled that the Attorney General’s office has proposed what it believes is a more defensible means means to accomplish the same ends – called the Market Regulation principle (discussed below).

The Jerusalem Post speculates that passage of the “Regulation Law 2” in the Knesset may not be automatic, in light of past instances where international condemnation of such moves to legalize outposts led to hold-ups. The Times of Israel points out that the Trump Administration has failed to express any criticism about the new bill, which is unsurprising given Trump Administration officials’ statements and actions embracing and normalizing the settlements.

Israeli Justice Minister Shaked praised the bill, saying:

“[the bill is a] clear statement that will legalize young settlements [outposts] in Judea and Samaria. In the last three years, we changed the conversation from one of evacuation to one of legalization. There is no reason for the residents of Judea and Samaria to always have to live under the sword of evacuation.”

Peace Now said:

“Another populist and unconstitutional initiative is approved by the settler government, and only in such a state can an ‘illegal settlement’ be classified as a ‘young settlement.’  The settlers’ violence against Palestinian passerby that we witnessed during the weekend is a direct result of the government’s policy and of such bills that actually telling the settlers that they are above the law and whatever violation of the law the make, the government will legalize it.”

The bill is a follow-up to the first Regulation Law, which was passed by the Knesset in February 2017 but has since then been frozen by the High Court of Justice while it considers the law’s constitutionality. One month after passage of the Regulation Law, the Israeli Cabinet passed a resolution to enact the law expeditiously, at which point the cabinet created a committee – now headed by settler leader Pinchas Wallerstein – to build a list of outposts which the government can retroactively legalize and to complete the bureaucratic work required to do so. Wallerstein – who has a long history of ignoring Israeli law but is now responsible for massaging it to suit his needs – has been vocal about what the government can do immediately, telling the Knesset in October 2018 that there are at least 20 outposts which can be “easily” legalized as neighborhoods of existing settlements, and 50 more outposts that can be legalized but require more complex solutions.

The outposts slated to be legalized are scattered across the West Bank, many of which FMEP has reported on regularly, including: Haresha (the center of recent legal maneuvers aimed at legalizing an access road built on privately owned Palestinian land); Givat Assaf (where two Israeli soldiers were killed on December 13th); Havat Gilad (another outpost which gained political support following a Palestinian terror attack); Yitzhar South, Yitzhar East (satellites of the radical and violent Yitzhar settlement near Nablus; Ma’ale Rehavam (which was built on privately owned Palestinian land that the WZO illegally allotted to the settlers); Mitzpe Kramim (where once again  the WZO gave settlers land owned by Palestinians. A court recently ruled the WZO acted in “good faith” in the transaction despite evidence to the contrary); Netiv Ha’avot (FMEP extensively covered the saga of Netiv Ha’avot); and, Adei Ad (a violent outpost that has been approved to be added to the jurisdiction of the new Amichai settlement in the Shilo Valley).

In New Legal Opinion, Israeli AG Outlines Strategy for Legalizing Outposts

On December 13th, Israeli Attorney General Avichai Mandleblit issued a new legal opinion outlining how the government can implement the “market regulation” principle (which he invented) as a new legal basis for retroactively legalizing outposts and settlement structures built on privately owned Palestinian land. According to this principle – which contradicts any notion of rule of law or the sanctity of private property rights – settlement structures and outposts built illegally on private Palestinian land, can be legalized, if the settlers acted “in good faith” when they took over and built on the land. His opinion and subsequent arguments to the Israeli High Court of Justice (below) confirm that in the view of the Israel’s top law official, Israel has the right to expropriate privately owned Palestinian land in the occupied West Bank and give it to Israeli settlers; the only disagreement he has with the Knesset is over the method of doing so.

Peace Now has a comprehensive breakdown of the new legal opinion, including the specific criteria outlining which outposts can qualify under the new scheme. AG Mandelblit estimates that 2,000 illegal settlement structures qualify for retroactive legalization using this principle,

The Israeli government has already used the “market regulation principle” in court twice, both in defending against lawsuits filed by Palestinians (first in response to petitions by Palestinian landowners against structures on their land near the Ofra settlement, second in response to petitions filed by Palestinian landowners against the Mitzpe Kramim outpost). This week’s move by the Attorney General allows the government to proactively initiate proceedings to retroactively legalize unauthorized outposts and settlement structures.

Reportedly, the Attorney General prepared this legal opinion a while back, but was stopped from publishing it by Prime Minister Netanyahu, who was concerned about the international and diplomatic repercussions. It seems likely that the recent string of Palestinian terror attacks prompted Netanyahu to give the AG the green light to go ahead, along with advancing a number of other punitive settlement plans.

Shortly after approving the implementation of the “market regulation principle,” Mandleblit called on the High Court of Justice to overturn the Regulation Law, which the Court has been considering for more than a year. In a letter to the High Court Justices, Mandleblit argued that implementing  the “market regulation principle” is “a more proportionate and balanced measure than the arrangement prescribed in the Regulation Law,” providing a more narrow legal basis by which Israel can strip Palestinian landowners of their rights (estimating that 2,000 structures can be legalized under the “market regulation principle,” compared to an estimated 4,000 under the Regulation Law). Of course, this argument overlooks the severe violation of Palestinian rights, the rule of law, and international law inherent in Israel’s decision to in effect erase Palestinian private property rights in the occupied territory to benefit the settlers.

Peace Now said:

“The attorney general is crossing yet another red line by laying the foundations for an institutionalized theft mechanism that will expropriate land from Palestinians and allocate it to settlers who stole it.This is part of a larger move led by AG Mandelblit to reduce the rights of Palestinians in the occupied territories and to expand the privileges of the settlers, thereby bringing us closer to an apartheid reality.”

New Outpost #1 : Settlers & Government Officials Illegally Re-Build Amona Outpost

In recent days,  dozens of Israeli settlers moved two mobile homes placed on the hilltop where the illegal Amona outpost once stood, claiming to have purchased the land from its Palestinian owners. Prominent settler leaders and MK Bezalel Smotrich (Habayit Hayehudi) visited the site to celebrate the resurrection of the infamous outpost, an endeavor which was directly supported and facilitated by the Binyamin Regional Council (a settlement regional authority which draws its budget from Israeli taxpayer funds).

Settlers have reportedly submitted documents to the Israeli Civil Administration which they claim prove the land has been legally purchased (a claim which, even if true, does not justify the settlers’ illegal invasion of and construction in an area designated by Israel as a closed military zone). The Civil Administration – which is the sovereign power over the West Bank and responsible for enforcing the law there – has confirmed that it is aware of the new outpost and has received documents from the settlers, but has not yet reviewed the documents.

Yesh Din, an Israeli NGO representing the Palestinian landowners, immediately filed a petition to have the illegal structures removed. Yesh Din also filed a criminal complaint against the Israeli government officials who were involved with invading the hilltop. As of this writing they have not received a response on either front. Peace Now has also stated it will pursue legal action against the settlers.

Yesh Din explains key context in the Amona outpost saga:

“After the evacuation [of the Amona outpost] in 2017, the Israeli army declared the area a closed military zone, prohibiting entry of Israelis and Palestinians to the area where the outpost had been located. The closure, however, was not enforced for Israelis, who freely entered, while Palestinians – including the legal landowners – were forbidden to enter and cultivate the very land for which they had struggled for years. In addition to the audacity of blatantly defying the High Court of Justice ruling and trampling on the rights of the landowners, the placing of the new structures this weekend violates the closure order and constitutes a further infringement of the law as the establishment of a new settlement in Amona was never authorized – certainly no permits or outline plans exist. But in the ‘land of the settlers,’ the concept of rule of law has long since lost any meaning. Any Israeli can decide to build a settlement on a hill, merely because they feel like it. The buildings then remain regardless of their illegality, Israeli authorities not daring to challenge their imposing presence.”

Benyamin Regional Council Chairman Yisrael Gantz said in a statement:

After two years of this place being uninhabited, we are fortunate to resume Israeli life here. The plots upon which we erected the structures were legally purchased. Yesterday, I promised to establish a new settlement in Binyamin in response to the deadly attacks and today we are carrying it out.”

Yossi Dagan, head of the Samaria Regional Council said at the event:

“In these dark days, when terrorist attacks are so numerous and the honor of the people of Israel is harmed, we must get fired up and today’s ascent to Amona is an appropriate Zionist response.”

Peace Now said in a statement:

“There is no limit to the cynicism of the hilltop criminals who exploit the events of recent days to trample the law and ignite disturbances, all with public funds. These pyromaniacs are backed by Knesset members and local politicians… It is difficult to understand how an order has not yet been issued to evacuate them, and we ask whether the IDF and the police would have allowed this if they were Palestinians. This disgrace should be addressed today.”

Re-establishing the Amona outpost would hand a complete and total victory to the settlers who were forcibly evacuated from the site in 2017 – proving that not only does settler law-breaking go unpunished, but it is handsomely rewarded by the Israeli government, and that establishing illegal outposts is an effective route to establishing new settlements. Since being evacuated, the Amona outpost settlers have (so far) been “compensated” by the government with financial compensation and two new settlements:

  1. The first new government-backed settlement in 25 years, Amichai. The Israeli Civil Administration High Planning Council subsequently approved a plan to triple the size of the Amichai settlement to include the Adei Ad outpost and the lands between the two; and,
  2. The Shvut Rachel East settlement. This is an outpost that was granted authorization as a “neighborhood” of the Shilo settlement, but is properly understood as a new settlement unto itself. Teh Amona outpost settlers were first offered the Shvut Rachel East hilltop as a relocation site, but rejected it in favor of the nearby Amichai hilltop. Despite rejection, Shvut Rachel East received authorization anyways.

New Outpost #2: Settlers Build Outpost Overlooking Hebron

In recent days,  a group of settlers have moved back into the site of an evacuated outpost near the city of Hebron, just north of the Kiryat Arba settlement, which settlers are calling Givat Mevaser. At a celebration of the decision by settlers to reestablish the outpost, the chairman of the Kiryat Arba settlement local council,  Eliyahu Libman, said:

“We made a decision in light of the harsh news endured by the people of Israel last week to permanently move families into Givat Mevaser.”

The IDF was present at the celebratory event to protect the settlers, but an official at the Defense Ministry admitted that the settlers did not coordinate their actions with authorities. The site was previously approved to be developed into a settlement industrial zone, and according to a spokesperson for the new outpost, settlers are in the process of changing the building plan in order to get authorization for residential housing. Nonetheless, the settlers are at present violating Israeli law by taking up residence at the site.

More Details on the Plan to Dig a Tunnel Road to the Haresha Outpost

Kerem Navot has published a Justice Ministry opinion that provides further details on the government’s plan – approved on December 6th – to retroactively legalize the Haresha outpost by building a tunnel road underneath privately owned Palestinian land (an olive grove). The Justice Ministry document explains that while the Israeli government in principle has the right to permanently expropriate the land from its Palestinian owners, such an action would likely be challenged in the High Court of Justice, where it might be overturned. The Justice Ministry suggests instead that the government should “temporarily” expropriate the land while a tunnel is dug and road paved beneath the olive grove – with the plan being, ostensibly, to return the land to its Palestinian owners after construction is complete.

Kerem Navot comments:

“now, in order to legalize the outpost, shady legal advisers (of the type to whom Justice Minister Ayelet Shaked is drawn) write documents in which they lay down their doubts on whether to expropriate the grove ‘permanently,’ which will be cheaper and faster (but it is likely to be rejected by the High Court of Justice), or to ‘temporarily’ expropriate it solely for the construction of a tunnel through the ‘excavation and cover-up’ method.”

As a reminder, in November 2017 the Attorney General gave the Israeli government a green light to permanently expropriate the privately owned land based on a legal argument that holds Israeli settlers to be part of the “local population” of the West Bank, and therefore eligible to be the sole beneficiaries of state land expropriated for “public use.”

High Court Criticizes State Over Illegal Road on Palestinian Land

At a December 18th hearing, the High Court of Justice gave the government of Israel 60 days to explain why it should not be required to demolish a road and several buildings that were built on land that the state has admitted it believes is privately owned by Palestinians. The case is before the court on a petition by Palestinians who claim that a 200-meter (650-foot) stretch of the road is built on their land.

The Court also slammed the State for allowing the construction of the road and buildings to be completed after a stop-work order was issued against the construction, a stop-work order the State assured the Court would be implemented. At the December 18th hearing, an attorney from the State Prosecutor’s Office told the Court that the road in question was a dirt road, and argued that the state had not sanctioned or had a hand in its construction.

New Report Documents Israel’s “Severe and Regular” Violation of International Law in Hebron

Haaretz shares details from a leaked report written by the Temporary International Presence in Hebron (TIPH), which documents the totality of Israel’s policies in Hebron,  serve to aid and protect settler and which collectively impose severe human rights violations and restrictions on Palestinians.

The report accuses Israel of being in “severe and regular breach” of international law, highlighting the many ways in which the human rights of Palestinians are systematically trampled on – specifically as it relates to radical settlers, their increasing activities in Hebron’s Old City, and the role of nearby settlements.

The Temporary International Presence in Hebron (TIPH) was first established in 1997 as part of the Oslo Accords’ Hebron Protocol, which allowed the partial redeployment of Israeli military forces to the part of the city that remained under its control. Israel must renew the TIPH’s mandate every six months; some fear that the next renewal has been jeopardized by the leaked report’s publication.

High-Rise Settlement Housing Promoted As a Means to Achieve 2020 Settler Vision & As a Solution to Israel’s Affordable Housing Shortage

Haaretz reports that the Yesha Council – the umbrella group representing all settlements in the West Bank – has adopted a strategic goal to advance “high quality, high density” settlement schemes in order to reach their goal of having 1 million settlers living in the West Bank by 2020. The basic idea is to build high-rise apartment complexes in settlements close to major highways in the West Bank and aggressively market them to Israelis who are seeking cheap rent and a fast commute, two key complaints of Israelis living and working in sovereign Israeli territory.

The strategy marks a shift in how settlements have typically been marketed to the Israeli public; once sold as an answer for young Israeli families looking for a single family unit with land, housing in settlements is now being marketed as the answer for young professionals looking for affordability, convenience and accessibility. The Yesha Council has coupled the new strategy with pressure on the government (and a promise to potential purchasers) to expedite West Bank infrastructure projects that will ease traffic, including bypass roads and detours around Palestinian towns.

In a February 2018 article, the Chairman of the Yesha Council wrote:

“Looking ahead, the patterns of thinking and action in the settlement movement need to be changed in two main areas: high-rise construction and doing away with admission committees. The available land for building is not plentiful. Until now, we’ve been used to rural communities with a one-family home on a half-dunam plot, but the goal from now on should be to build as many housing units as possible on that same land. High-density construction — building up or in a terraced fashion, depending on topography — will change the balance in the area and also require a new approach to infrastructure development to suit the number of residents in the future.” [Note: the Haaretz article explains that “admission committees” are a function of settlements which have standards for who is permitted to live there, mostly in ultra-orthodox and ideological settlements]

Fourth Quarter Decline in 2018 Settlement Construction Starts Doesn’t Tell the Whole Story

The Israeli Central Bureau of Statistics (CBS) released new data showing a 52% decrease in the number of settlement construction starts in the third quarter of 2018 compared to the second quarter of 2018. News about a “decline,” relative to the last quarter, obscures the clear and alarming settlement surge currently taking place. As Peace Now has reported, by August 2018 the total number of settlement tenders and plans that have been advanced (6,319) is more than double the total amount in 2016 (3,189).

In addition, it is important to bear in mind that the number of construction starts do not begin to depict or reveal the level of settlement activity happening in the West Bank. Israel’s settlement enterprise is not solely a matter of residential housing plans, but also the unceasing expansion of infrastructure and security measures that exclusively benefit Israeli settlers, the normalization and development of settlement industrial zones, and illegal settlement activity (outposts, which are now regularly legalized ex post facto) that does not register in numbers tracking the settlement planning process.

Israel Seizes on Palestinian Attacks as Pretense to Advance Settlement on Multiple Fronts

Seizing on a series of deadly Palestinian attacks this week as his pretext, Prime Minister Netanyahu announced he will:

  • retroactively legalize thousands of settlement structures and outposts;
  • initiate a plan to build 82 new units in the Ofra settlement;
  • build two new settlement industrial zones (one near the Avnei Hefetz settlement and one near the Beitar Illit settlement); and,
  • implement a range of policies that collectively punish Palestinians in the West Bank.

In addition, the Israeli Ministerial Committee on Legislation (a committee within the Israeli cabinet that decides whether to give government-backing to Knesset legislative proposals) will consider supporting a bill written by MK Bezalel Smotrich (Habayit Hayehudi) which would allow the government to provide municipal services, like water and electricity, to some illegal outposts. The bill assumes the series of outposts will be retroactively legalized, an assumption based on the work to achieve that end spearheaded by settler leader Pinchas Wallerstein (who has his own history of ignoring the law).

Many other senior Israeli officials joined Netanyahu in advocating for the immediate legalization of every unauthorized (i.e., illegal under Israeli law) structure in the Ofra settlement. The Ofra settlement – located northeast of Ramallah – was first established by settlers on land that had been expropriated in 1966 by the Jordanian government in order to build a military base (which was never built, as Israel took control of the West Bank in 1967). The Israeli government used this pretext to expropriate the land in 1977 in order to recognize the Ofra settlement, which had been established in the area illegally (i.e., without government approval, but with its tacit cooperation) two years prior. However, the majority of the Ofra settlement was not built on the land expropriated by the Israel in 1977, but instead on land that is registered to Palestinian owners from the nearby village of Ein Yabroud. In light of the legal status of the land, no Israeli government has yet been able to find a way to fix the legal status of these homes (not for lack of trying) – meaning that the majority of the structures in Ofra were built without permits, making them illegal under Israeli law.

Peace Now elaborates:

“Most of the houses built in Ofra (approximately 413 out of 625) were built on an area of ​​550 dunams of privately owned Palestinian land. In addition, hundreds of dunams of Palestinian private land were seized for roads in Ofra, as well as infrastructure and agricultural lands for the settlers. The only way to regulate the theft of these lands would be to expropriate them from the Palestinian landowners for the benefit of the settlers, in complete contradiction to the positions of previous Israeli governments and legal advisors, and contrary to binding rulings of the High Court. Although the current legal advisor (Avichai Mandelblit) allowed land expropriation in some places for settlement purposes (for example, in Haresha), in the regulation of massive land theft such as in Ofra the Israeli government would be crossing a new red line.”

Justice Minister Ayelet Shaked said that she already has a draft resolution and a legal opinion supporting retroactive legalization of Ofra. Shaked further threatened:

“Facing the price tag of Abu Mazen [Palestinian President Mahmoud Abbas], we pose our own price tag. Every terror attack will strengthen the settlement establishment instead of weakening it, and every potential attacker will know in advance that he will be considered responsible for strengthening settlements.”

Speaker of the Knesset Yuli-Yoel Edelstein vowed to push a plan through the Knesset to regulate Ofra, saying:

“The immediate answer to such an incident is to finally regulate Ofra, one of the oldest and most beloved communities. The 20th Knesset has been good and the Government has been positive towards the settlement enterprise. There have been important achievements and laws, but it’s not enough…  I pledge to support the plan that will be formulated and advance it myself in the Knesset. This is our duty towards millions of citizens. The fate of Ofra must be the same as the fate of Petah Tikva.”

Yisrael Gantz, the new chairman of the Binyamin Regional Council, called for the:

“immediate approval of thousands of housing units… in order to deepen our roots here.”

The WZO Used Non-Existent Land Plots as “Collateral” for Loans to Build Illegal Outposts

The Israeli NGO Kerem Navot discovered more proof that the World Zionist Organization’s Settlement Division is directly financing the construction of illegal outposts with public funds — by providing loans to settlers based on non-existent assets, including fictitious plots of land in the West Bank. This reporting builds on previous revelations about the WZO’s complicity in illegal settlement construction on privately owned Palestinian land in the West Bank, including in the cases of the Mitzpe Kramim outpost and the Ma’aleh Rahavam outpost. Nonetheless, the Israeli government is rapidly advancing plans to hand over even more West Bank land to the WZO for settlement expansion.

On its latest findings, Kerem Navot founder Dror Etkes told Haaretz:

“This story exposes again the Settlement Division’s swindling ways and dirty dealings. [Like in the case of MK Bezelal Smotrich] who received a mortgage in the Kedumim settlement for a plot that doesn’t exist. It’s obvious from that and from the other cases that this is only the tip of the iceberg of a much broader practice.”

As a reminder, the WZO’s Settlement Division was created by the Israeli government in 1968 and is funded entirely by Israeli taxpayers. Its mandate is to manage West Bank land expropriated by Israel, in order to facilitate the settlement of Israeli Jews in the occupied territories. To make this possible, the Israeli government has allocated approximately 60% of all “state land” in the West Bank to the WZO’s Settlement Division [over the past 50 years Israel has declared huge areas of the West Bank to be “state land,” including more than 40% of Area C, where most of the settlements are located]. In addition, settlement and human rights watchdogs have repeatedly documented how the WZO’s Settlement Division has worked to take over additional land, including privately owned Palestinian land, in order to build more settlements.

Israeli AG Freezes New Grants Program for Illegal Outposts

Israeli Attorney General Avichai Mandelblit has reportedly frozen the implementation of a resolution, passed by the Israeli cabinet last week, designating three outposts as “national priority areas” for development. The resolution would direct enormous amounts of state resources to the outposts for construction.

Mandelblit wrote a letter slamming Housing Minister Yoav Gallant for bypassing the Attorney General in approving the resolution. According to Haaretz, Mandelblit had previously told the Housing Minister that the inclusion of settlements in the list of national priority areas needs to be thoroughly reviewed before the resolution was passed. Ignoring Mandelblit, Gallant advanced the resolution without a thorough review and without the permission of the government’s top legal official.

At the Opening of New West Bank Highway Interchange for Settlers, Netanyahu Celebrates Erasing the Green Line

Israeli Prime Minister Benjamin Netanyahu attended a ceremony marking the opening of a newly renovated traffic interchange on Highway 60 (the main north-south highway in the West Bank). Located near the Adam/Geva Benyamin settlement and the Palestinian village of Hizma, the new interchange is meant to ease traffic congestion for settlers travelling to Jerusalem from the northern West Bank. More importantly, it advances the seamless integration of infrastructure serving Israeli settlements and sovereign Israeli territory – a key effort by settlers and their government allies to effectively erase the Green Line.

At the event, Netanyahu said:

“We are not stopping here. We will yet complete the paving of bypass roads, the widening of lanes and the improvement of infrastructures. There is a combined transportation-security aspect here. We are making yet another great link. While we are joining the country geographically, we are also joining the present to the future. Today and in this place we are doing something else, we are also joining the present to the past. Our ancestors walked here and took in this view of these valleys and these hills. The greatest dramas in the history of our people and of humanity took place here in this place; therefore, we are also joining our past to our future and this is a very great privilege.”

Minister Katz, who was also in attendance, said:

“We’re promoting a strategic plan on a very wide range with light rail routes at high-risk areas and traffic lights to make Judea and Samaria part of the Israeli norm of a developed and connected country…After we completed these two projects (Adam Interchange and Givat Assaf Traffic Light) we’ll work to enable this connection with a road with better conditions. This is part of the large and complementary projects to allow traffic to flow here.”

In September 2018, the United Nations Office for the Coordination of Humanitarian Affairs (OCHAS) released a report looking at the impact of Israeli roads on the the village of Hizma, as a case study of the effects road closures have on Palestinian rights. OCHA wrote:

“Hizma is a Palestinian village of over 7,000 residents in Jerusalem governorate. The bulk of its built-up area is in Area B but small parts of the village lie in Area C or within the municipal boundaries of Jerusalem, although it is separated from the rest of the city by the Barrier. Between 28 January and the end of March 2018, the three access roads into the village were either totally or partially closed to Palestinian traffic. The Israeli army hung posters on village shops stating that the army ‘will continue its work so long as you [residents] continue to be disruptive’. Other posters showed broken windshields. Following communications with the Israeli military, the head of the village council reported that the posters justified the closures as a response to stone throwing by Palestinian youths at vehicles with Israeli number plates. In 2017 and the first two months of 2018, OCHA recorded 11 incidents of Palestinians throwing stones at Israeli vehicles near Hizma that resulted in Israeli injuries or damage to vehicles.


The closures disrupted access by Hizma’s residents to services and livelihoods. Traffic between the north and south of the West Bank that passed through the village was diverted, undermining the commercial life of the village. Service providers, including a third of the teachers in village schools who commute on a daily basis, faced delays reaching the village. Over 50 shops/businesses that are the main source of income for 150 households were affected by the diversion of Palestinian traffic away from the village. Family life was also affected by the unpredictable nature of the closures.”

Hanukkah Event Draws Political Support for Settlers’ Bid to Take Over Site in the Old City’s Muslim Quarter

The Israeli archeological group Emek Shaveh reports that the Ateret Cohanim settler organization hosted a Hanukkah celebration –  drawing the participation of the incoming Mayor of Jerusalem Moshe Lion, Minister of Jerusalem Affairs Ze’ev Elk, and the son of the Israeli Prime Minister, Yair Netanyahu – at the “Little Western Wall.”  The site (which Israelis call the “Kotel Ha’Katan”) is a section of the retaining wall of the Temple Mount/Haram al-Sharif located within the Old City’s Muslim Quarter. It is viewed by some religious Jews as the closest point to the Holy of Holies at which Jews are permitted to pray. For historical background on the site and Ateret Cohanim’s role and goals related to it, see this 2016 report by Haaretz’s Nir Hasson.

Emek Shaveh writes:

“The recent Hanukkah ceremonies demonstrate an increase in political support for Ateret Cohanim and, no less important, the growing importance of the Little Western Wall, a politically and religiously charged place, attesting to a growing consensus among the Israeli Right regarding strengthening Jewish presence in areas immediately adjacent to the Temple Mount/Haram al-Sharif.”

Ateret Cohanim is a radical settler organization working to increase the presence of Israeli Jews living inside Palestinian neighborhoods of Jerusalem – including in the Old City, where the group recently succeeded in purchasing a Palestinian house in the Muslim Quarter (a property sale that continues to stoke controversy within the Palestinian community). Ateret Cohanim, along with their compatriots in the Elad settler group, also leads efforts to take over land and evict Palestinians from their homes in the Silwan neighborhood. Ateret Cohanim’s recent efforts in Silwan include using the guise of a Yemenite cultural center to build a new settlement in Silwan with government financing, and winning a High Court ruling that permits them to continue their campaign to evict 700 Palestinians from their homes.

Huge Holes Open on Streets of Silwan…Above Settler Excavations

The Israeli archeological group Emek Shaveh reports that holes have begun appearing in the ground of Silwan, along the route of an underground excavation run by the Israeli Antiquities Authorities and funded by the Elad settler group. Elad has invested heavily in archeological excavations in Silwan in a campaign to co-opt the ancient history of Jerusalem to strengthen the Jewish hold on and presence in Palestinian neighborhoods in East Jerusalem. Emek Shaveh writes:

“There’s rarely a dull moment in Silwan. Last weekend, after the rain came, large holes opened up in the ground. This is not normal. And no amount of cement poured into the holes will make it so. Perhaps the reason for this odd occurrence can be found in the fact that Israel Antiquities Authority is excavating a tunnel along an ancient Roman road which runs right underneath the places where the holes opened up. There are 15 houses along the route of the tunnel. In some of them cracks have shown up. Others have shown signs of sinking into the ground. A few months ago we asked the Antiquities Authority to examine the homes and were assured the engineer would look into it. We’re still waiting for answers.”

The new holes are just the latest in a long series of above-ground damage related to excavations which the Israel Antiquities Authority (IAA) started in 2013. The IAA began the excavations without notifying Palestinian residents of the project. Palestinians began complaining about the work when cracks began appearing in their homes, threatening their structural integrity, and forcing many to leave their homes.

Emek Shaveh has repeatedly asked the IAA to investigate the issues caused by the excavations, but has not received an answer to date. Emek Shaveh also shared footage of Israelis haphazardly attempting to fill in the new holes with concrete.

Israel’s Top Court Slams State Rail Company for Moving Debris to Private Palestinian Land as Part of Plan to Build a Settlement Park

The Israeli High Court of Justice sharply criticized Israel Railways, the state rail company, for moving debris on to privately owned Palestinian land in the West Bank, as part of a plan to use the debris to develop a new park in the nearby Nili settlement. The debris comes from tunnelling a path for the Tel Aviv to Jerusalem rail line, meaning the debris was transported from sovereign Israeli territory into the West Bank, where it was deposited on Palestinian land.

Back in 2011, the Court chastised Israel Railways for its actions and ordered the debris to be removed. Seven years later, the Palestinian land is still a dumpsite while the Israeli government and Israeli Railways bicker over who is responsible for clearing the refuse. This week the Court rebuked the company and hinted that it would soon issue a ruling against it.

Settlement Wave, Part 1: High Planning Council Advances Plans for 1,004 Settlement Units (96% Located Deep in the West Bank)

On August 22nd, the Israeli Defense Ministry’s High Planning Council (the body in the Israeli Defense Ministry responsible for regulating all construction in the West Bank) advanced plans for 1,004 new settlement units, 96% of which are located deep inside of the West Bank. Of the total, 620 units were approved for deposit for public review and 382 units were given final approval for construction.

As reported by Israeli settlement watchdog Peace Now, the plans approved for deposit for public review (totalling 620 units) are:

  • 370 units in the Adam settlement (aka Geva Benyamin). This project was urged on by Defense Minister Liberman following a stabbing attack in the settlement, which resulted in one death and injuries to three others. The 370 units are part of a larger plan for 1,000+ units that will, if built, connect the Adam settlement to two large settlements in East Jerusalem (Neve Ya’akov and Pisgat Ze’ev) that are on the Israeli side of the separation barrier (the route of the barrier juts far beyond the 1967 Green Line to include Pisgat Ze’ev and Neve Ya’akov on the Israeli side while the Adam settlement is on the West Bank side). If the larger plan is implemented, the Adam settlement will have built up areas on both sides of the separation barrier, which could (in all likelihood) present Israel an opportunity to re-route the barrier around Adam — which would de facto annex even more West Bank land to Israel and further choke off Palestinian East Jerusalem from the West Bank to its north. [Note: FMEP’s Lara Friedman and Peace Now’s Hagit Ofran published an op-ed in Haaretz in 2008 warning of this plan – you can read that background here].
  • 85 units in Karnei Shomron settlement. Israel has repeatedly confiscated as “state land” located between Karnei Shomron and the Palestinian village of Qalqilya (which is literally surrounded on three sides by the separation barrier). In November 2017, Israel began clearing landmines from that “state land” in order to prepare for settlement construction. At the time, Deputy Defense Minister Eli Ben-Dahan said that the new construction in the Karnei Shomron area will bring “a million Jews [to] live in Judea and Samaria in the future.”
  • 84 units in the Kiryat Netafim settlement, located about half way between the Ariel settlement and the cluster of settlements close to the 1967 Green Line that are slated to be united into a “super settlement” area (Oranit, Elkana, Shiva Tikva, and others). The expansion of Kiryat Netafim will go towards creating a contiguous corridor of Israeli settlements stretching from sovereign Israeli territory, though the super settlement, to Ariel. As FMEP has repeatedly said, the Ariel settlement is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to attach Ariel to Israel (with a finger of land running through settlements like Kiryat Netafim) will cut the northern West Bank into pieces.
  • 52 units in the Beit El settlement. This is the second major approval for new units in Beit El in 2018, with a third plan for 300 more units coming soon, according to Israel Hayom. The construction boom is being hailed by the settler-aligned Arutz Sheva outlet, which wrote that the plans will increase the size of Beit El by 65%. If any of the units are constructed it will be first new, government-sanctioned construction in Beit El in over 10 years. U.S. Ambassador to Israel David Friedman is closely associated with the Beit El settlement, having donated to and fundraised for it prior to his appointment as ambassador (including in his capacity as the President of the American Friends of Beit El, reportedly from 2011 until he became ambassador).
  • 29 units in the Otinel settlement, located south of Hebron. MK Yehuda Glick (Likud) lives in Otinel.

Plans that gained final approval, meaning no additional formal approvals are required to move ahead with construction (totalling 382 units) are:

  • 168 units in the Tzofim settlement, located on the Israeli side of the separation barrier, but jutting towards the Karnei Shomron settlement, which also received advancements this week. See the section on Karnei Shomron, above, for context and news regarding this area of settlements.
  • 108 units in the Nofim settlement, located on the Israeli side of the separation barrier but jutting towards the Karnei Shomron settlement, which also received advancements this week. See the section on Karnei Shomron, above, for context and news regarding this area of settlements.
  • 56 units in the Barkan settlement, located near the Kiryat Netafim settlement. Both Barkan and Netafim are located about half way between the Ariel settlement and the cluster of settlements slated to be united into a “super settlement” area (Oranit, Elkana, Shiva Tikva, and others). See the section on Kiryat Netafim, above. for context and news regarding this area of settlements.
  • 44 units in Ma’ale Adumim, the mega settlement just east of Jerusalem.
  • 6 units in the Avnei Hefetz settlement, located southeast of the Palestinian city of Tulkarem.

Notably, Netanyahu intervened to remove two items from the High Planning Council’s agenda, both of which would have led to the retroactive legalization of illegal outposts. Those plans are:

  1. A plan to retroactively legalize the Ibei Hanahel outpost, which is a non-contiguous “neighborhood” of the Ma’ale Amos settlement, located deep in the southern West Bank. The plan would have allowed the outpost to be demolished and then rebuilt legally with residential units, transforming the outpost into a new, fully authorized settlement.
  2. A plan to build an education center in the Nofei Prat South outpost, which is a non-contiguous“neighborhood” of the Kfar Adumim settlement, located northeast of Jerusalem. The land on which the project would be built is located just 1.5 km away from the Khan Al-Ahmar Bedouin community – the same one that the Israeli government plans to forcibly evacuate in order to cleanse the area of Palestinians and expand settlements. The outpost was established by the Haroeh Ha’ivri (“the Hebrew Shepherd”) nonprofit association, which is funded by the Israeli Education Ministry.

In response to Netanyahu’s directive to remove these two items from the agenda, the heads of the Knesset’s “Land of Israel Lobby,” Bezalel Smotrich (Jewish Home) and Yoav Kisch (Likud), said that the Prime Minister should “ act with greater rigor to promote settlement, rather than doing the opposite.”

Settler leaders were also unsatisfied with the High Planning Council’s overall numbers. Yossi Dagan, head of the Samaria Regional Council (a municipal body for settlements in the northern West Bank), said:

“We are happy about every new house in Samaria, but we have to tell the truth. Hundreds of housing units are not enough for an area that constitutes 12% of the State of Israel…We expect the government to step in the gas, stop worrying about what they will say overseas, and develop this beautiful region.”

Settlement Wave, Part 2: Housing Ministry Published Tenders for 420 Settlement Units

On August 23rd, one day after the Defense Ministry’s High Planning Council advanced a huge tranche of settlement plans (detailed above), the Israeli Housing Ministry published tenders for a total of 425 settlement units (under plans previously approved by the High Planning Council).

Those tenders include:

  • 211 units in the Ma’ale Efraim settlement, located in the Jordan Valley.
  • 54 units in the Givat Ze’ev settlement, located north of Jerusalem.
  • 52 units in the Beit Aryeh settlement, which comes in addition to the the publication of tenders for 511 units in the settlement last week.
  • 42 units in the Ariel settlement. See reporting below for extensive coverage of the many reasons settlers in Ariel are celebrating this week.

Settlement Wave, Part 3: Jerusalem District Committee Advances Plans for 603 Settlement Units in East Jerusalem

In addition to the tranche of settlement plans advanced by the Defense Ministry’s High Planning Council and the tenders published by the Housing Ministry (detailed above), the Jerusalem District Committee deposited for public review (one of the final steps before approval) plans for a total of 608 new settlement units in East Jerusalem, with 345 units slated for the Gilo settlement and 263 units in the Ramot settlement. 

On the plan for the Gilo settlement, Ir Amim explains:

“The Gilo plan is being promoted in tandem with development of the new Green Line branch of the Light Rail (construction of which was launched in May), which will be built adjacent to the settlement expansion. This sequencing of events once again exemplifies a pattern of the state investing billions of shekels in transportation infrastructures to allow for extensive construction beyond the Green Line.”

As Ir Amim notes, this week’s advancements come on the heels of Israel’s August 15th decision to publish tenders for 603 units in Ramat Shlomo, and its June 2018 advancement of plans for 1,064 settlement units in the Pisgat Ze’ev settlement — bringing Israel’s two-month total of settlement advancements in East Jerusalem to 2,275 units.

As a reminder, approvals/advancement of settlement plans is not the only ongoing threat to Palestinians in East Jerusalem. Settlers and settler-run organizations continue their campaign to take over sensitive areas in East Jerusalem neighborhoods neighborhood – like Silwan and Sheikh Jarrah – and to create more settler run tourist sites – like the Jerusalem cable car, the Kedem Center, the Abu-Tor footbridge, the Yemenite “heritage center,” and more – to erase the visibility of Palestinians in Jerusalem. Meanwhile, pending legislation in the Knesset seeks to gerrymander the borders of Jerusalem to create a Jewish majority by annexing settlements and cutting out Palestinian neighborhoods from the borders of the city. Sounding the alarm on all of these trends, Ir Amim writes:

“It is vital that the traditional calculus of settlement building be readjusted to a) treat these coordinated efforts to consolidate control of the Old City and surrounding Palestinian neighborhoods with the same urgency afforded to settlement building throughout the whole of East Jerusalem; b) ensure a holistic response that regards private settlement inside the Old City Basin and touristic settlement not as individual phenomena but as multiple elements of a unified and politically lethal strategy.”

Settlement Wave, Part 4: More Settlement Construction Coming Soon

In addition to the plans for 1,004 units that were advanced this week by the High Planning Council, the 425 tenders published by the Housing Ministry, and the 608 units advanced in East Jerusalem (all detailed above), this week saw reports that additional plans are expected to advance soon. Those are:

  1. Ir Amim reports that on September 2nd, the Jerusalem District Committee is expected to discuss a plan to build a six-story building in Sheikh Jarrah, a neighborhood in which at least 75 families face eviction by radical settlers, with the backing of the Israeli government and courts. For detailed reporting on the building, plans for which were deposited for public review in May 2018, see FMEP reporting here.
  2. Peace Now reports that tenders are expected to be issued (having already been marketed) for more units in the Adam (Geva Binyamin) settlement. If true, this will be another step towards uniting Adam to the East Jerusalem settlements – the details of which are covered above.
  3. Peace Now also notes that a plan for 300 units in Beit El is expected to be advanced. This comes in addition to the 52 tenders issued for Beit El this week.
  4. The Times of Israel reports that plans for hundreds of additional settlement units will soon be marketed for construction by the Defense Ministry. These plans received final approval before this week’s High Planning Council meeting. A Civil Administration official hinted that the plans will be marketed for the Alfei Menashe and Ma’ale Efraim settlements. [NOTE: This reporting was before the subsequent publication of tenders for 211 units in Ma’ale Efraim, covered above.]

U.S. Stands By Israeli “Intentions” on Settlements

When asked for comment on the various major settlement announcements, the U.S. State Department said that the Trump Administration believes the Israeli government has clearly demonstrated an intent to “adopt a policy regarding settlement activity that takes the president’s concerns into consideration” – a statement that suggests unequivocally that the Trump Administration has given a green light for massive settlement expansion across the length and breadth of the West Bank and East Jerusalem.

Notably, on the same day that the bulk of the settlement announcements were made, President Trump’s National Security Advisor, Ambassador John Bolton, was on the ground in Jerusalem. Not only did he offer no comment or criticism of the settlement announcements, he very publicly joined Israeli politicians and settlers leaders for dinner in East Jerusalem, dining in the “City of David National Park,” the archeological/touristic/residential site in the Palestinian neighborhood of Silwan that is run by the radical Elad settler organization. As FMEP has repeatedly covered, the Elad settler organization is spearheading a government-aided campaign to evict Palestinians from their homes in Silwan, replace them with Jewish Israeli settlers, and transform the neighborhood into a Biblical tourist site emphasizing exclusively the area’s Jewish history.

The head of the Peace Now Settlement Watch program, Shabtay Bendet, told Al-Monitor:

“The situation on the ground is changing rapidly…Restraints on construction in the settlements have been lifted. The Americans don’t care…”

State Tells High Court: We Can Annex the West Bank, International Law Be Damned

On August 7th, the state’s private attorney Harel Arnon submitted a second brief [Hebrew] to the High Court of Justice in defense of the settlement “Regulation Law.” In it he argues that the Knesset is not bound by international law and has the right to apply its own laws outside of its borders and annex land, if it wishes.

Arnon argues:

“The mere application of a certain Israeli norm [law] to an anonymous place outside the state does not necessarily make that anonymous place part of Israel. The Knesset is not restricted from legislating extra-territorially anywhere in the world, including in the region, the Knesset can legislate in Judea and Samaria.”

The brief also argues:

“The Knesset is permitted to impose the powers of the military commander of the West Bank region as it sees fit. The Knesset is permitted to define the authorities of the military commander as it sees fit. The authority of the government of Israel to annex any territory or to enter into international conventions derives from its authority as determined by the Knesset…[and] the Knesset is allowed to ignore the directives of international law in any field it desires.”

Lawyers representing Adalah responded:

“the Israeli government’s extremist response has no parallel anywhere in the world. It stands in gross violation of international law and of the United Nations Charter which obligates member states to refrain from threatening or using force against the territorial integrity of other states – including occupied territories. The Israeli government’s extremist position is, in fact, a declaration of its intention to proceed with its annexation of the West Bank.”

Harel was ordered to submit a second defense of the bill in response to a petition filed by Adalah and Al-Mezan on behalf of seventeen local Palestinian authorities. The petition argues that the Regulation Law violates international law and that the Knesset cannot enact laws over the West Bank where the majority of the population is Palestinians (who are not Israeli citizens and cannot vote).

The High Court of Justice is widely expected to strike down the “Regulation Law,” but has yet to make a ruling. Just last week, Arnon made the case that the recently passed Nation-State Law, which makes “Jewish settlement,” a “constitutional value,” can help him defend the settlement law before the High Court.

This Week in Ariel: Settlers Celebrate 40 Years, A Construction Boom, A Medical School, & An Evangelical “Leadership Camp”

Haaretz published a lengthy report this week on the history of the the Ariel settlement – which is celebrating its 40th anniversary this month – and the dramatic spike in construction in the settlement in 2018. Even before tenders were issued for 42 new units this week (see above), plans for 839 units had already been approved during the first eight months of 2018, compared to tenders for fewer than 5 units each of the past three years. One of the original settlers of Ariel said:

“During the Obama years, everything here was frozen. But thanks to Donald Trump, we’re starting to see the light at the end of the tunnel.” 

Not only has Ariel seen a massive surge in construction advancements this year, but the settlement broke ground on a new medical school heavily financed by U.S. casino magnate, and Trump backer, Sheldon Adelson (who this week gave $25 million to the GOP to help it keep the Senate, and in May gave the GOP $30 million to help it keep the House). Many settler leaders and Israeli officials, as well as Adelson and his wife Miriam, were in Ariel this weekend to attend a dedication ceremony for the medical school, despite ongoing controversy around its accreditation under domestic Israeli law. Prime Minister Netanyahu was notably absent from (and reportedly was not invited to) the ceremony, fueling rumors regarding the growing disaffection between him and Adelson.

According to another recent report in Haaretz, Ariel university is illegally dumping construction debris on land that Israel acknowledges is not “state land.” The dump site is outside of the so-called “Blue Line” which the Israeli government uses to demarcate the land that it considers “state land.” Since the dump site is not within the Blue Line, it is likely on land that even the government of Israel recognizes as being privately owned by Palestinians. Anti-settlement watchdog and founder of Kerem Navot, Dror Etkes, commented:

“It’s not surprising that Ariel University, which is the only university in the world built and existing by military order, has adopted the standards accepted in the West Bank involving the takeover of private Palestinian land.”

According to a third Haaretz report, the Israeli Education Ministry has signed a contract to sponsor 3,000-4,000 Israeli high school students of Ethiopian descent to take part in a leadership training program located in Ariel.  The program, called “JH Israel,” was founded by American evangelical mega-church pastors Bruce and Heather Johnston, the latter of whom also runs the U.S. Israel Education Association, a pro-Israel, pro-settlement, non-profit group which works with the Family Research Council to lead Congressional delegations to Israel. The JH Israel website says its mission is to help Jewish Israeli students who are “disconnected from the roots of their faith” to establish “a deeper connection to God by embracing their biblical and cultural heritage.” The website also says that Ariel is “at the forefront of biblical prophecy unfolding in modern Israel.”

As FMEP has repeatedly documented, Ariel is located in the heart of the northern West Bank, reaching literally to the midpoint between the Green Line and the Jordan border. The future of Ariel has long been one of the greatest challenges to any possible peace agreement, since any plan to connect Ariel to Israel will cut the northern West Bank into pieces.

Peace Now Settlement Watch Director Shabtay Bendet spoke to Haaretz about the future of the Ariel settlement and the (other) significant repercussions of opening the new medical school. Bendet said:

“Most places in Israel don’t get recognized as cities unless they have 20,000 to 30,000 residents. Ariel became a city when it had just 11,000 residents. Why was this so significant? Because maybe you can uproot a settlement, but you don’t uproot a city. The same holds true for the university. Why was it so important for him to get it accredited? Because when a place has a university, that means it’s established — no pulling it out of the ground….By creating a buffer between the northern and southern parts of the West Bank it makes any future Palestinian state unviable. But besides that, it is also causing damage in the present because its continued expansion impinges on the ability of the surrounding Palestinian villages to develop and grow.”

Amana (the Official Settler Movement) Moves Its HQ to Sheikh Jarrah

The Ynet news outlet reports that the Amana settler organization – the official body of the settlement movement, operating since the 1970s – has moved into its new headquarters in the heart of the Sheikh Jarrah neighborhood of East Jerusalem, where settlers are continuing to wage a displacement campaign against Palestinian residents. Though Amana has owned the plot of land since 1992, various legal challenges and incredibly sensitive geopolitical considerations have slowed construction of the building, called the “Amana House” (see a detailed history here).

Regarding the strategic implications of the location, Ynet reports:

“Amana says the new headquarters will help bolster the territorial contiguity of Jewish settlements in east Jerusalem.”

Agriculture and Rural Development Minister Uri Ariel (Bayit Yehudi) who previously served as the CEO of Amana, commented that the organization’s relocation:

“constitutes a significant reinforcement to the (Jewish) settlement in east Jerusalem and the bolstering of the Jewish territorial contiguity in the area.”

Several settlement plans are currently proceeding in Sheikh Jarrah, underscoring the strategic location and goals of settler activity in Sheikh Jarrah. As covered previously in this report, Israel is expected to advance a plan for a 6-story office building for settlers, located at the entrance to the neighborhood. Across the street from that building, a highly consequential plan for a new religious school (the Glassman yeshiva) was approved for deposit for public review in July 2017. The goal is clear: to unite the enclaves of settlers living inside of the Palestinian neighborhood by creating a contiguous area of settlement that connects to West Jerusalem, thereby cementing an immovable Jewish Israeli presence in a key Palestinian neighborhood – closing off the possibility of evacuation under a future peace deal.

Settlement Gains in East Jerusalem Result in Palestinians Self-Demolishing Their Homes

OCHA reports that two Palestinian homes in the East Jerusalem neighborhood of Beit Hanina were self-demolished after the Israeli Supreme Court ruled in favor of settlers’ ownership claims.  OCHA writes:

“In recent decades, Israeli settler organizations, with the support of the Israeli authorities, have taken control of properties within Palestinian neighbourhoods in East Jerusalem, and some 180 Palestinian families are currently facing eviction cases, filed mainly by settler organizations.”

Israel Launches New Settlement “Heritage Center” in Silwan

On August 1st, senior Israeli government officials were on hand to celebrate the beginning of construction on a new settlement complex, under the guise of a cultural center, located in the heart of the Batan al-Hawa section of the Silwan neighborhood in East Jerusalem. The event was heavily guarded by Israeli forces, in an open acknowledgement of the provocative nature of the settler campaign targeting Palestinian homes in Batan al-Hawa, which is located near the walls of the Old City in view of the Temple Mount/Al Aqsa Mosque.

The new settlement initiative is part of a campaign by the Ateret Cohanim settler organization (which works to establish Jewish enclaves inside densely populated Palestinian neighborhoods of East Jerusalem) to exploit the area’s historical connection to Jewish immigrants as a pretext for taking land and establishing Jewish-Israeli control over the area. Israel’s Ministry of Jerusalem Affairs and Ministry of Culture and Sport are contributing an estimated $1.23 million USD to the cost of renovating an old Yemenite synagogue into a settler-run Jewish Yemeni heritage center — in a example of how the government is directly funding extremist settler activity in an area that Ir Amim identifies as “the site of the most substantial settler takeover campaign in Jerusalem since the annexation of East Jerusalem in 1967.”

Attendees at the launch included Cultural Affairs Minister Miri Regev, Jerusalem Affairs Minister Ze’ev Elkin (who is currently campaigning to become the mayor of Jerusalem), former U.S. presidential candidate and governor (and father of the current White House spokeswoman) Mike Huckabee, and former White House Communications Director Anthony Scaramucci (the latter two have been touring Israel and praising the settlements, with Huckabee going so far as to suggest that he might want to have his own home in a settlement someday).

The launch of the project ignores an ongoing legal case before the High Court of Justice that could affect Ateret Cohanim’s ownership claim to the land and building in question. Settlers are acting on the assumption that both are legally owned by the Benvenisti Trust (a historic trust that resettled Jewish Yemenite immigrants in the area in the late 1800s). Ateret Cohanim took control of the Benvenisti Trust in 2001, and in 2002 the Israeli Custodian General transferred land in Batan al-Hawa to the Trust/Ateret Cohanim. Since then, Ateret Cohanim has accelerated its multifaceted campaign to remove Palestinians from their homes, claiming that the Palestinians are illegally squatting on sacred religious land owned by the Trust.

So far, Ateret Cohanim has acquired the deed to six Palestinian homes in Batan al-Hawa, inserting some 20 Israeli Jewish families in place of evicted Palestinian residents. The organization has eviction orders pending against an additional 21 homes, with 800 Palestinians at risk of eviction.

On June 17, 2018, just two months ago, the Israeli High Court of Justice ordered the Israeli government to provide more information regarding its decision to transfer ownership of land in Batan al-Hawa to the Benvenisti Trust/Ateret Cohanim. The Court’s order was in response to a petition filed by Palestinian residents fighting eviction from their homes, and the State’s admission during oral arguments on June 10, 2018 that the land had been transferred to the Benvenisti Trust/Ateret Cohanim without a proper investigation into its legal status. The petitioners argue that the State’s decision to transfer the land was illegal on two fronts: (1) The Benvenisti Trust never owned the land in Batan al-Hawa, but only owned the buildings – all but one of which were demolished in the 1940s; and, (2) the land was transferred without the necessary legal notification to the residents living there.

Yakoub al-Rajabi, a Palestinian resident of Batan al-Hawa, told The Washington Post:

“We know that this was a well-orchestrated plan to force us to leave. And if we stay, it will paralyze us and isolate us in our homes.”

In a 2016 report that covers the Batan al-Hawa situation in detail, Ir Amim and Peace Now underscore the significance of Ateret Cohanim’s efforts, of which the new cultural center would be the crowning jewel:

“If the settlers are successful, Batan al-Hawa is anticipated to become the largest settlement compound in a Palestinian neighborhood in the Historic Basin of the Old City, with the outcome of significantly tightening the emerging ring of settlements around the Old City and severely undermining the possibility of a future two state solution in Jerusalem.”

Ateret Cohanim director Daniel Luria said:

“Every acquisition is very difficult. We’re up against a mobilized Arab world, parts of which are violent. There is huge pressure and millions of dollars are being pumped in to strengthen the Arab hold on the city…[the] biggest problem is trying to get the Jewish world to understand what needs to be done. We have the best relations ever with a US administration. For [US Vice President Mike] Pence and [US Ambassador to Israel David] Friedman and the others, [settling Jews in East Jerusalem] is a no-brainer. What’s our right-wing government waiting for? It’s not about what the US says. It’s about what we do. We are not doing anything to stop the peace process but will not compromise on a millimeter of Jerusalem. You have to show strength of conviction and sovereignty to have peace and coexistence. This can only happen when you live together under Jewish sovereignty.”

Cultural Minister Miri Regev said at the event:

“Look around. We are surrounded by Jewish heritage. The archaeologists won’t find a single Palestinian coin here! We have come home.”

University Heads Challenge Approval of the Ariel Settlement Medical School

The Israeli Committee of University Heads wrote a letter to the Higher Education Council  demanding that it reconsider the approval granted to the new medical school in the Ariel settlement, which is already under construction. In a letter addressed to the Chairman of the Planning and Budgeting Committee of the Higher Education Council, Israeli university heads expressed concern that the decision to approve the medical school was tainted by political interference, and was carried out by an “expedited and improper” procedure. A source told Haaretz that the University Heads share a concern “that the Planning and Budgeting Committee [of the Higher Education Council] will be turned into a rubber stamp for [Education Minister Naftali] Bennett.” The signers call on the Planning and Budgeting Committee to hold new hearings on the settlement school to reconsider the data and merits of the proposal.

The letter comes on the heels of claims made publicly last week by three members of the Planning and Budgeting Committee that Education Minister Naftali Bennett interfered in the committee’s work, in order to expedite the approval of the medical school despite the fact that information about the project was missing.

As FMEP has repeatedly covered, the Ariel medical school is part of a government-backed agenda of exploiting academia to normalize and de facto annex settlements. Earlier this year, a part of this effort, the Israeli Knesset passed a law that extends the jurisdiction of the Israeli Council on Higher Education over universities in the settlements (beyond Israel’s self-declared and internationally recognized sovereign borders). This move ensures that the Ariel settlement medical school (and its graduates) are entitled to all the same rights, privileges, and certifications as schools and students in sovereign Israel. The Ariel settlement medical school enjoys the financial backing of American casino magnate, settlement benefactor, and close friend of President Trump Sheldon Adelson.

Liberman Promises 400 Settlement Units in Response to Terror

Defense Minister Avigdor Liberman promised to advance plans for 400 units in the Adam settlement in response to a Palestinian knife attack in the settlement that resulted in the death of one settler and injury to two others. In a tweet, Liberman claimed: “The best answer to terrorism is the expansion of settlements,” continuing, “That’s why I left this morning to promote a plan to build 400 housing units in Adam and approve it in planning institutions in the coming weeks.”

The Times of Israel notes that Liberman’s promise for 400 units is not a new plan but part of an existing plan – for a total of 1,000 units – already being advanced. Liberman’s promise is better understood as a signal to the High Planning Council to expedite the approval of the plan that is already in motion.

The Not-So-New Trump Policy on Visiting Settlements

The Palestinian Authority issued a sharp criticism this week of U.S. Ambassador David Friedman – and U.S. policy – after Friedman traveled to the Adam settlement to pay a condolence call on the widow of a settler murdered in a terror attack. Although Friedman is not the first U.S. Ambassador to visit an Israeli settlement, Friedman has made a habit of it (see here, here, and here for example), leading some observers to point out the self-evident fact that the Trump administration has – without making an official announcement – adopted a concrete change in U.S. policy regarding settlements, and is now not only refraining from criticizing settlement expansion, but is actively engaged in actions that legitimize settlements.

This week the Palestinian Authority said in a statement that the Trump administration and its “religious Zionist staff” were:

“continuing to make a mockery of international law in a bid to impose their positions and policies, which are blindly biased in favor of the Israeli occupation, on the international community with unprecedented arrogance.”

In a rare moment of agreement, settler leaders articulated a similar view of regarding this shift in the Trump Administration’s settlement policy, with the Binyamin Regional Council issuing a statement after Friedman’s visit saying:

“It seems as if we are talking about a change in US policy with respect to the Jewish communities of Judea and Samaria…they are being treated just like the rest of the country.”

Hananel Durani, head of the powerful Yesha Council which advances the interests of the settlements, said:

“I hope the US government will continue to support Israel and the settlements with the same kind of courageous friendship the ambassador demonstrated today.”

Settler leader Oded Revivi, who is head of the Efrat settlement council and foreign envoy for the Yesha Council, commented:

“I want to express my appreciation to Ambassador Friedman who saw fit to visit the settlement of Adam in Binyamin and comfort the bereaved family. This sends an important message to the world regarding strengthening the positive forces and combating the negative forces in the region.”

Peace Now recently released two 2018 settlement maps, one map the entire West Bank and a second detail map of East Jerusalem. Both are must-have resources for anyone tracking anything related to settlements and the factors that must be addressed in a negotiated solution to the conflict.

In Jerusalem’s North: The “Adam-Neve Ya’akov” Plan Resurfaces

The Israeli Construction & Housing Ministry announced impending plans for a 1,100 unit housing project to Jerusalem’s immediate northeast.

The plan aims to connect large settlements in East Jerusalem (Neveh Ya’akov and Pisgat Zeev) with an isolated settlement in the West Bank (Adam, aka Geva Binyamin). The land identified for the project is within the municipal boundaries of Adam, but on the Israeli side of the separation barrier (the route of the separation barrier in this area cuts deep into the West Bank). If implemented, the Adam settlement would have built up areas on both sides of the barrier.

Israeli Housing Minister Yoav Galant’s office issued a statement explaining, “We will be everywhere that it is possible to build and to provide solutions to the housing shortage, particularly, as in the case of Adam, in the vicinity of Jerusalem. In Greater Jerusalem, there is also particular security importance in Israeli [territorial] contiguity from the Gush Etzion Bloc in the south to Atarot in the north, and from Ma’aleh Adumim in the east to Givat Ze’ev in the west.”

Ir Amim writes that the plan would, “further fracture a future Palestinian state by… breaking contiguity from north to south… while isolating the southern perimeter of Ramallah from East Jerusalem, the future capital of the Palestinian state. Advancing a project of this size, given its extreme geo-political ramifications, would have a fatal impact on the two-state solution.”

The same plan was developed in the early 2000s and explored in 2007 and again in 2008, but shelved because of its political sensitivity and international concern for the future of Jerusalem and the prospects for a two-state solution. Jerusalem expert Daniel Seidemann of Terrestrial Jerusalem writes, “What is different now than in the past is talk of the plan comes in the context of an opening of the settlement floodgates in East Jerusalem, including green lights and expediting of plans the implementation of which, for any number of reasons, in the past was far-fetched or even inconceivable. Consequently, it is important to flag this scheme as early as possible, and to monitor in vigilantly.”

 

In Jerusalem’s South: The “Gilo Southeast” Plan Expected to Advance

The Israeli government is set to advance a plan to expand the borders of the Gilo settlement (between Jerusalem and Bethlehem) in order to build 3,000 new units. This plan, called “Gilo Southeast,” is expected to be considered at a meeting on July 26th.

If implemented, Gilo Southeast would further surround the Palestinian city of Beit Safafa, severing the town from the West Bank. An area of intense Israeli settlement infrastructure growth (a settler-only freeway divides the community, and the area has been the focus of demolitions of Palestinian homes), Beit Safafa’s Palestinian residents describe a life under siege.

Gilo Southeast is just one of several alarming plans threatening to sever Palestinian contiguity between East Jerusalem and the southern West Bank:

  • Gilo Southeast would abut the border of the Givat Hamatos doomsday plan, which is only waiting for the publication of tenders to begin construction. The Givat Hamatos plan has remained blocked under the previous political calculations, but can be tendered at any moment.
  • The plan would also connect Gilo to Har Homa, a fast growing settlement that was built with the Netanyahu’s approval in 1997 – the last official settlement to be built until the recent approval of the Amichai settlement.

Ir Amim writes that Gilo Southeast would create “one more link in a chain of developments designed to seal off the southern perimeter of Jerusalem from the West Bank, nullifying prospects for a two state solution.”

 

In the Shadow of Jerusalem’s Old City: Settler-Run Visitor Center is Approved

Last week the controversial Visitor’s Center in the Palestinian neighborhood of Silwan (known to Israelis as the “City of David” and located just outside the walls of Jerusalem’s Old City in the shadow of the Temple Mount/Haram al-Sharif) took another important step forward in the final stages of the planning process. According to the Israeli NGO Emek Shaveh, the plan “awaits final approval by the Israel Antiquities Authority, which will only be granted once the archaeological excavations at the site are completed. In our assessment this should happen soon.”

Known as the “Kedem Center,” the building is being financed and promoted by the settler-run Elad Foundation, whose goal is to establish Jewish hegemony over all of Jerusalem (i.e. erase all Palestinian presence, history, and any visibility in the city). The Center will be the largest, state-of-the-art tourism center in Jerusalem and will also serve as a station for the new cable car line approved this year, a cable car line that is designed to facilitate tourists visits to Jewish sites in East Jerusalem while preventing tourists from encountering Palestinians.

Emek Shaveh issued a statement saying, “this project will change the landscape in the area between the Old City and the village of Silwan, and will have a considerable impact on the identity of the Historic Basin. The purpose of the Kedem Center is first and foremost political – to Judaize Silwan and prevent a political solution for Jerusalem.”

The Jerusalem Post reports the Kedem Center plan was approved by Prime Minister Netanyahu as a defiant gesture following UNESCO’s decision to designate sites in Hebron as World Heritage Sites, which Netanyahu incorrectly says deny Jewish history.

 

In the Heart of East Jerusalem: Plans Advance as Expected

In addition to the north, south, and center settlements plans detailed above, previously reported settlement plans targeting East Jerusalem were all approved for deposit for public review at a government meeting last week. We reported extensively on these in our last edition, here. The plans approved for deposit for public review include the incendiary plans in the Palestinian East Jerusalem neighborhood of Sheikh Jarrah, and more.

Though the plans were all approved for deposit for public review, as of this writing none have been deposited (yet). Like almost every step in the Israeli settlement planning process, actually depositing the plans for public comment is itself a political decision.

 

U.S. Department of State: Settlements & Settlers Provoke Violence

In the recently released 2016 Country Reports on Terrorism, Secretary Tillerson’s State Department writes, “Continued drivers of violence included a lack of hope in achieving Palestinian statehood, Israeli settlement construction in the West Bank, settler violence against Palestinians in the West Bank, the perception that the Israeli government was changing the status quo on the Haram Al Sharif/Temple Mount, and IDF tactics that the Palestinians considered overly aggressive.” [emphasis added]

Notably, the 2015 Country Reports on Terrorism (an Obama Administration document) did not focus on the role of settlements or identify settlements/settlers as a “driver of violence.” The 2015 document simply noted a handful of terrorist incidents, including the trend of “price-tag attacks,” committed by settlers and committed by Palestinians near settlements.

 

Settlement Outpost Near Bethlehem is Angling to Avoid Demolition

A settlement outpost near Bethlehem – built illegally even under Israeli law – is fighting a decision by the Israeli Supreme Court to demolish 17 buildings that were found to have been built on land owned by Palestinians. A 2016 decision ruled that buildings in the center of the outpost sit partially on Palestinian land and must be demolished by March 2018. The NGO Yesh Din has an additional, broader petition before the High Court that seeks to prove that the whole outpost is on Palestinian land.

The Netiv Ha’avot outpost was built in 2001 as an additional “neighborhood” of the Elazar settlement southwest of Bethlehem, but was in fact built on a hilltop near the outskirts of the settlement, on land located beyond the settlement’s borders. Forty Israeli settler families currently live there, 15 of which will be affected by the demolition orders.

The outposts’ residents are aggressively pressuring Prime Minister Netanyahu to intervene in their favor (Netanyahu has already caved to vociferous settler protests several times this year). At a demonstration in support of the outpost, signs read “This destruction too is on your watch” (referring to the Amona evacuation) and “Bibi wake up and intervene.”

 

Court Wants Settlers/Palestinians to “Negotiate” Land Theft Ex-Post Facto

The Israeli Supreme Court made an unusual move to try to avoid having to return private land to Palestinians. The ruling pertains to a case in the Jordan Valley, where the Israeli military seized Palestinian private land for military uses, and subsequently (and improperly, according to Israeli law) gave the land to settlers. Rather than compel the settlers to return the stolen land to its owners, the court wants the Palestinians to negotiate with the settlers for compensation. The court’s move – which is in response to a 2013 petition – is an attempt to resolve the issue without having to rule on the validity of the land seizure, and without having to compel Israel to forfeit the land and evict the settlers (even if doing so requires suspending even the pretense of the rule of law).

Haaretz explains how we got here, “After the Israeli occupation of the West Bank began in 1967, the army issued an order prohibiting Palestinians from entering the area between the border fence and the Jordan River. At the beginning of the ‘80s, the government decided to encourage farmers to work the fields to create a buffer zone with Jordan. The World Zionist Organization was given the land and leased it to settlers.”
